Provider’s Processing of Personal Data shall be governed by the Agreement and the Protocol, which sets out the subject matter, duration, nature, and purpose of the Processing, type of Personal Data and categories of data subjects, and obligations and rights of Sponsor as Data Controller.

2. Council officers will visit targeted and non-targeted addresses, where appropriate to assess eligibility for the scheme and collect the necessary documentation. When visiting an address, the Council officers will complete an electronic NIHE application form named ‘Affordable Warmth Scheme’ application.
3. As part of the process, the applicant is required to provide documentation to verify eligibility including proof of ownership, occupancy and income. These eligibility documents will be photographed by Council staff on a Council issued electronic tablet at the time of the visit and in the home of the applicant. Eligibility documents will be shared with NIHE electronically and the eligibility document data is then deleted beyond recovery from the tablets. Where documents cannot be submitted electronically, hardcopies can be accepted if necessary.
4. The tablets have a security feature that secures all data being stored on and transmitted to a device and provides functionality to lock down and wipe data from a device if it is lost or stolen.
5. In certain cases the original hard copy eligibility documents are removed by the Council officers instead of photographing onto the electronic tablet in the home of the applicant. These documents will be photographed or scanned and checked that the copy is legible before sharing with NIHE. The originals will be returned to the applicant in such a way to protect the data in accordance with Council policy.
6. If the property is privately rented, the Council officers will send a consent form to the landlord.
7. Data gathered for this purpose will not be disclosed to any other person or organisation. The data is used to confirm the eligibility of the applicant to receive a grant.

Upon return to the Council office, the eligibility documents are printed from the electronic tablet and the eligibility document data is then deleted beyond recovery from the tablets. The purpose of collecting PERSONAL DATA is in order to assist in processing the loan. In accordance with this AGREEMENT the SUPPLIER will collect the name, address, email address and phone number of the RECIPIENT.

2.1. Service Provider shall only Process Personal Data in accordance with Company’s instructions and as necessary to carry out an obligation under the Underlying Agreement, including any Statement of Work thereunder, or as otherwise required by Applicable Law. Service Provider will only Process the minimum amount of Personal Data required to meet its obligations under the Underlying Agreement or Applicable Law.
2.2. Except as provided in the Underlying Agreement or Applicable Law, neither Service Provider nor any of its employees, agents, consultants or assigns shall have any right to Process Personal Data for their own commercial benefit in any form (including, without limitation, to create de-identified or anonymized data) or to Sell, retain, use or disclose Personal Data for any commercial purpose or outside of the direct business relationship between the Parties.
2.3. Service Provider certifies that it understands the restrictions contained in this Addendum and will comply with them.
Use and Disclosure of Personal Data. 18.1.1 Personal data is data which relates to a living individual. By way of example (and without limiting its meaning in any way) it includes the name and address of staff, details of their next of kin and information relating to their performance at work.
18.1.2 The Employer processes personal data relating to its staff. All personal data processed is used in connection with the Employer’s or Group Company’s businesses. The Employer will not process personal data other than in connection with its business or the business of Group Companies.

2.1. Service Provider shall only Process Personal Data in accordance with Company’s instructions and as necessary to carry out an obligation under the Underlying Agreement, including any Statement of Work thereunder, or as otherwise required by Applicable Law. Service Provider will only Process Personal Data for those limited and specified purposes and will Process the minimum amount of Personal Data required to meet its obligations under the Underlying Agreement or Applicable Law.
2.2. Except as provided in the Underlying Agreement or Applicable Law, neither Service Provider nor any of its employees, agents, consultants or assigns shall have any right to Process Personal Data for their own commercial benefit in any form (including, without limitation, to create de-identified or anonymized data); to Sell or Share Personal Data; to retain, use or disclose Personal Data for any purpose (including to provide services to any other person or entity) other than the purposes permitted in Section 2.1; to retain, use or disclose Personal Data outside of the direct business relationship between the Parties; or to combine Personal Data received from or collected on behalf of Company with Personal Data collected or received from other sources, except as expressly permitted by Applicable Law.
2.3. Service Provider certifies that it understands the restrictions contained in this Addendum and will comply with them. Service Provider agrees that it shall promptly inform Company if it makes a determination that it, its Subprocessors, or its Affiliates can no longer meet their obligations under this Appendix or under Applicable Law. This Section 2.3 shall survive the termination of the Agreement.

Athennian will only use Personal Data to provide the Services to Customer, except with the prior written consent of Customer or as otherwise expressly permitted under the Agreement or this DPA, or unless otherwise required under Applicable Laws. Athennian will not disclose Personal Data outside of Athennian or its Affiliates except (a) as Customer directs or as required to provide the Services, (b) to Customer’s third party service providers as directed by Xxxxxxxx, (c) to Sub-processors as described in the section titled “Sub-processors”, (d) as otherwise described in the Agreement or this DPA, or (e) as required by Applicable Laws.

Subject to the terms of this Agreement, Client grants to Legends a limited right and license to use the Client Personal Data provided by Client in connection with the services provided under the Agreement (solely in accordance with this Agreement and to the extent permitted under applicable Data Protection Laws and privacy policies, and for no other purposes) to:

5.3. Engage in marketing and advertising (including email marketing and digital advertising campaigns) to drive online traffic to the Online Store for future purchase;
5.4. Operate the Online Stores and provide the Merchandise Services;
5.5. Ensure the safety and security from fraud or third-party security threats (e.g., malware, ransomware, etc.) of the Merchandise Services, Online Stores, Legends, Client, and Legends Affiliates; and
5.6. Optimize and personalize the Online Store for individuals.
5.7. Notwithstanding anything to the foregoing, Client hereby grants to Legends a perpetual, worldwide, royalty-free, non-exclusive, sublicensable and transferable right and license during the Term and after the Term to anonymize and/or aggregate the Client Personal Data as long as such aggregated or anonymized data does not identify the Client as the source of such data. For the avoidance of doubt, all aggregated and/or anonymized data created from or in connection with the Client Personal Data shall be owned by Legends.
