Use of Electronic Documents. Copies of documents that may be relied upon by Client are limited to the printed copies (also known as hard copies) or fully-scaled PDF files that are signed and sealed by CobbFendley’s authorized design professionals. Files in electronic formats, or other types of information furnished by CobbFendley to Client such as text, data or graphics, are only for convenience of Client. Any conclusion or information obtained or derived from such electronic files will be at the user’s sole risk. When transferring documents in electronic formats, CobbFendley makes no representations as to long-term compatibility, usability, or readability of documents resulting from the use of software application packages, operating systems or computer hardware differing from those in use by CobbFendley at the beginning of this project.
Use of Electronic Documents. The Parties shall endeavour: not to adopt or maintain domestic laws and regulations containing the requirement to confirm the authenticity of the transactions made in electronic form by presenting documents in paper form; and to ensure that the documents related to trade transactions are presented to the competent authorities of the Parties in the form of an electronic document that is digitally signed. The Parties shall endeavour to ensure that in cases where any document is required for the importation of a product, a participant of trade transaction could receive such document confirming that the product is imported in accordance with the requirements of the importing country in electronic form.
Use of Electronic Documents. 1. The Parties shall endeavor to ensure that the documents related to external trade transactions can be presented to the competent authorities of the Parties in the form of an electronic document that is electronically signed.
2. Neither Party may adopt or maintain measures containing the requirements to confirm the authenticity of the documents related to external trade transactions in the form of an electronic document that is electronically signed by presenting documents in paper form.
Use of Electronic Documents. Electronically stored copies of this Master Agreement or other documents related to transactions with Lender are considered to be the true, complete, valid, authentic and enforceable records of this Agreement and the Borrower's other transactions with Lender, admissible in judicial or administrative proceedings to the same extent as if the documents and records were originally generated and maintained in printed form. Borrower agrees not to contest the admissibility or enforceability of Lender's electronically stored copies of this Master Agreement or any other documents generated with respect to any existing or future loans. Use of Electronic Documents. § 12.4.1 When authorized by the Owner and upon receipt of a letter of release from liability from the intended recipient, the Architect will provide copies of the Architect’s Instruments of Service in electronic format to the Owner, Owner’s contractors, subcontractors, and consultants under contract to the Owner.
§ 12.4.2 The Architect cannot release the electronic files produced by the Architect’s Consultants. Nevertheless, the Architect’s Consultants for this Project shall be bound by the terms of their respective Architect/Consultant Agreements to provide their electronic files directly to the Owner, and to the contractors and consultants under contract to the Owner, upon receipt of a similar letter of release provided by the Consultant.
§ 12.4.3 The Architect currently uses Autodesk Building Design Suite 2018 for computer aided design and drafting, and the Architect’s electronic Instruments of Service will be provided to all Parties in that format. If the Architect upgrades to a subsequent Release, the Instruments of Service will be provided in the upgraded Release.
