Use of the Properties. (a) The Hotel/Casino Property is used exclusively as a hotel and casino at a standard at least equal to Comparable Hotel/Casinos, including, without limitation, comparable food and beverage outlets and other amenities, and otherwise as a top-end hotel and other appurtenant and related uses, and (b) the Café Property and the Adjacent Property are used for Permitted Adjacent/Café Uses and other appurtenant and related uses.
Use of the Properties. During the term of this Agreement, the Board shall have the exclusive right to possess, use, occupy and improve any properties identified in Exhibit A for public school purposes, including without limitation the right to conduct surveys, soil borings and other necessary testing upon the property prior to construction, the right to use, operate, maintain and repair said property for such public school purposes thereafter until termination as hereinafter provided. In addition, the Board shall have the right to authorize the use of any of the identified properties by third parties for non-school use consistent with Board policies.
Use of the Properties. Use and purposes of the properties:
Use of the Properties. The Indemnitor shall not, and --------------------- shall not permit any of its Subsidiaries to, change or permit to be changed the Use of any Property unless (a) such change is permitted by the Loan Documents and undertaken in accordance with such Loan Documents and (b) the Indemnitor shall have notified the Agent in writing that such change will not result in the presence of Hazardous Materials (other than as may be reasonably required in connection with such use) at or on such Property, and (c) the Required Banks shall have determined (and shall have communicated such determination in writing to the Indemnitor) that such change will not result in the presence of Hazardous Materials (other than as may be reasonably required in connection with such use) at or on such Property. Notwithstanding any such determination by the Required Banks and the communication thereof to the Indemnitor, in the event that such determination shall subsequently be determined to have been incorrect or shall have been rendered incorrect or should such change in Use of any Property result in the presence of Hazardous Materials (other than as may be reasonably required in connection with such use) upon, about, beneath or above such Property or any Environmental Claim, the Indemnitor agrees that the Required Banks' approval shall not release the Indemnitor from its obligation under this Agreement and the provisions of this Agreement shall apply to any such Hazardous Materials or Environmental Claim, as the case may be.
Use of the Properties. (a) Tenant may use the Properties as they are generally used on the Commencement Date, including for warehouse, office, distribution and television studios (each use, a “Use” and collectively “Uses”), but for no other uses without the prior written consent of Landlord. Notwithstanding the foregoing, Tenant may use the Tenant Retained Parcel for any lawful use. Tenant has or will obtain, prior to the Commencement Date, all necessary permits, consents, licenses and other permissions required for the lawful operation of each Property for the Uses thereon and shall comply with all applicable laws, codes, ordinances and regulations, including all zoning and other use restrictions and regulations applicable to the Properties.
(b) Tenant covenants and agrees that it shall not install and, it shall during the term of this Lease prevent any sublessee or other occupant of the Properties from installing, any water well or other water tank, pump or related equipment for the storage or use of potable water at the Properties. In addition, Tenant covenants and agrees that it shall not improve or use, and shall prohibit any sublessee or other occupant of the Properties from using or improving, the Properties for residential purposes.
Use of the Properties. Prior to the Completion Date, each Property shall be used in a manner consistent with the Construction Agency Agreement and, after the Completion Date for such Property, (a) the Headquarters Building shall be used as a corporate headquarters building and (b) the other Properties shall be used as distribution centers, except as otherwise consented to by the Lessor which consent shall not be unreasonably withheld. Each Lessee shall pay, or cause to be paid, all charges and costs required in connection with the use of the Properties as contemplated by this Master Lease and the Construction Agency Agreement. No Lessee shall commit or permit any waste of the Properties or any part thereof.
Use of the Properties. Commission, on behalf of itself and its successors, assigns, and each successor in interest to Commission's interest in the Properties or any part thereof, hereby covenants and agrees as follows:
a. Commission covenants and agrees for itself, its successors, its assigns and every successor in interest to the Properties or any part thereof, that Commission, such successors and such assignees shall use the Properties only for residential uses specified in the Redevelopment Plan, any development agreements entered into by and between City and Commission, the Grant Agreement, and this Agreement. No change in the use of the Properties shall be permitted without the prior written approval of City.
b. Notwithstanding the generality of subsection (a), above, Commission, its successors and assigns, shall use the Properties only for the uses permitted in this Agreement, specifically residential rental uses, consisting of 10 Affordable Units.
Use of the Properties. The Borrower will not, and will not allow any other Person to, (a) use the Properties in a manner that is improper, dangerous, or otherwise not in compliance with Prudent Industry Practice or (b) move the ATP Titan from its present location except as movement is permitted under the terms of the Platform Use Agreement. The Borrower will not permit any Person to use the Properties other than ATP pursuant to the Platform Use Agreement.
Use of the Properties. The Borrower will not, and will not allow any other Person to, (a) use the Properties in a manner that is improper, dangerous, or otherwise not in compliance with Prudent Industry Practice or (b) move the Bennu Titan from its present location except in connection with a Sale pursuant to and in accordance with an Acceptable Sale Process.
