Use of the Settlement Fund. As further described in this Agreement, the Settlement Fund shall be used by the Settlement Administrator to pay for: (i) all Administrative Expenses; (ii) any Taxes; (iii) any Service Awards; (iv) any Fee Award and Costs; and (v) the Settlement Payments and/or Settlement Benefits, pursuant to the terms and conditions of this Agreement.

Use of the Settlement Fund. As further described in this Settlement Agreement and in Exhibit B, the Settlement Fund shall be used by the Settlement Administrator to pay for the following: (1) Settlement Payments to satisfy Approved Claims of Settlement Class Members; (2) payment of the Designatited Cy Pres amount; (3) Notice and Administrative Expenses; (4) Fee Award and Expenses as awarded by the Court; and (5) transfer of Remainder Funds to the extent any exist following the preceding administration of payments. No amounts may be withdrawn from the Settlement Fund unless expressly authorized by this Settlement Agreement or approved by the Court. Responsibility for effectuating payments described in this Paragraph shall rest solely with the Settlement Administrator, and neither Defendant nor Defendant’s agents shall have any responsibility whatsoever with respect to effectuating such payments.
Use of the Settlement Fund. As further described in this Agreement and in Exhibit B, the Settlement Fund, upon final approval, shall be used by the Settlement Administrator to pay for the following (although not in this order): (1) reimbursement for Unreimbursed Economic Losses; (2) Credit Monitoring Services; (3) Pro Rata Cash Payments; (4) Notice and Administrative Expenses; (5) Service Award payments approved by the Court; and (6) the Attorney Fee Award and Expenses awarded by the Court.

Following payment of all of the above expenses, any amount remaining in the Net Settlement Fund shall be paid to the Non-Profit Residual Recipient in accordance with Paragraph 70. No amounts may be withdrawn from the Settlement Fund unless expressly authorized by this Agreement or approved by the Court.

Use of the Settlement Fund. 22. THIS COURT ORDERS that the Class Settlement Fund shall be held by the Ontario Plaintiffs in the Settlement Trust until such later date that the Ontario Plaintiffs have a Plan of Allocation approved by this Court.

Use of the Settlement Fund. 8. The Settlement Fund shall be used to pay: (a) any Taxes; (b) any Notice and Administration Costs; (c) any Litigation Expenses awarded by the Court; (d) any attorneys’ fees awarded by the Court; and (e) any other costs and fees approved by the Court. The balance remaining in the Settlement Fund, that is, the Net Settlement Fund, shall be distributed to Authorized Claimants as provided in ¶¶ 20-29 below.
Use of the Settlement Fund. As further described in this Agreement and in Exhibit B, the Settlement Fund shall be used by the Settlement Administrator to pay for the following: (i) all costs of claims administration, (ii) Plaintiffs’ counsel’s fees and expenses and Court-approved service awards, (iii) the costs of providing the Expanded Identity Theft and Fraud Monitoring for three bureau monitoring and $1,000,000 in insurance; (iv) approved Class Member Claims and Alternative Cash Benefit Claim payments on a pro rata basis to exhaust the balance of the fund. Any remaining funds shall be provided to the non-profit recipient approved by the Court. No amounts may be withdrawn from the Settlement Fund unless expressly authorized by this Agreement or approved by the Court. Responsibility for effectuating payments described in this paragraph shall rest solely with the Settlement Administrator and neither Xxxxxxxxxx nor Xxxxxxxxxx’x agents shall have any responsibility whatsoever with respect to effectuating such payments.
Use of the Settlement Fund. As further described in this Agreement, the 20 Settlement Fund shall be used by the Settlement Administrator to pay for: (i) all Administrative 21 Expenses; (ii) any Taxes; (iii) any Service Awards; (iv) any Fee Award and Costs; (v) any 22 Settlement Payments and/or Settlement Benefits, pursuant to the terms and conditions of this 23 Agreement; and (viii) any other Settlement Benefits.
