Use of the Settlement Fund. As further described in this Agreement, the Settlement Fund shall be used by the Settlement Administrator to pay for: (i) all Administrative Expenses; (ii) any Taxes; (iii) any Service Awards; (iv) any Fee Award and Costs; and (v) the Settlement Payments and/or Settlement Benefits, pursuant to the terms and conditions of this Agreement.
Use of the Settlement Fund. As further described in this Agreement and in Exhibit B, the Settlement Fund shall be used by the Settlement Administrator to pay for the following: (1) reimbursement for Unreimbursed Economic Losses, Lost Time, and Alternative Cash Payments;

Use of the Settlement Fund. As further described in this Agreement, the Settlement Fund shall be used by the Settlement Administrator to pay for the following: (i) Notice and Administrative Expenses, (ii) Taxes and Tax-Related Expenses, (iii) Approved Claim(s) for Out-of-Pocket Losses; (iv) Approved Claim(s) for Lost Time; (v) Approved Claims for Credit Monitoring and Identity Theft Protection Services; (vi) Approved Claims for Cash Payment for Identity Theft or Data Misuse; (vii) Service Awards Payments approved by the Court, (viii) Fee Award and Costs approved by the Court; and (ix) Residual Cash Payments. Following payment of all of the above expenses, any amount remaining in the Net Settlement Fund shall be paid to the Non-Profit Residual Recipient in accordance with Paragraph 70. No amounts may be withdrawn from the Settlement Fund unless expressly authorized by this Agreement or approved by the Court.

As further described in this Agreement and in Exhibit A, the Settlement Fund shall be used by the Settlement Administrator to pay for the following: (1) reimbursement for Out-of-Pocket Losses, Lost Time, and Pro Rata Cash Compensation (2) Notice and Administrative Expenses; (3) Fee Award and Costs as awarded by the Court; (4) Service Awards payments approved by the Court; and (5) transfer of Remainder Funds to the extent any exist following the preceding administration of payments. No amounts may be withdrawn from the Settlement Fund unless expressly authorized by this Agreement or approved by the Court. Responsibility for effectuating payments described in this paragraph shall rest solely with the Settlement Administrator and neither Defendant nor Defendant’s agents shall have any responsibility whatsoever with respect to effectuating such payments.

As further described in this Agreement, the Settlement Fund shall be used by the Settlement Administrator to pay for the following: (i) Notice and Administrative Expenses; (ii) Taxes and Tax-Related Expenses; (iii) Service Award Payment approved by the Court; (iv) Fee Award and Costs; (v) reimbursement for Out-of-Pocket Losses and Attested Time; (vi) Residual Cash Payments, and (vii) payments to the Non-Profit Residual Recipient, if relevant. No amounts may be withdrawn from the Settlement Fund unless expressly authorized by this Agreement or approved by the Court.

Use of the Settlement Fund. As further described in this Settlement Agreement and in Exhibit A, the Settlement Fund shall be used by the Settlement Administrator to pay for the following: (1) Notice and Administrative Expenses; (2) Fee Award and Expenses, as approved and awarded by the Court; (3) documented Out-of-Pocket Losses; (4) Cash Fund Payments (as defined infra); (5) Service Awards; and (6) transfer of Remainder Funds to the extent any exist following the preceding administration of payments. No amounts may be withdrawn from the Settlement Fund unless expressly authorized by this Settlement Agreement or approved by the Court. Responsibility for administering the Settlement Fund or effectuating payments described in this Paragraph shall rest solely with the Settlement Administrator in cooperation with the Escrow Agent, and in accordance with the Settlement Administrator Agreement and the Escrow Agreement. Neither Defendant, Defendant’s Counsel, nor Defendant’s agents shall have any responsibility whatsoever with respect to effectuating such payments.
Use of the Settlement Fund. 22. THIS COURT ORDERS that the Class Settlement Fund shall be held by the Ontario Plaintiffs in the Settlement Trust until such later date that the Ontario Plaintiffs have a Plan of Allocation approved by this Court.
Use of the Settlement Fund. 8. The Settlement Fund shall be used to pay: (a) any Taxes; (b) any Notice and Administration Costs; (c) any Litigation Expenses awarded by the Court; (d) any attorneys’ fees awarded by the Court; and (e) any other costs and fees approved by the Court. The balance remaining in the Settlement Fund, that is, the Net Settlement Fund, shall be distributed to Authorized Claimants as provided in ¶¶ 20-29 below.
