Use of the Settlement Fund. As further described in this Agreement, the Settlement Fund shall be used by the Settlement Administrator to pay for: (i) all Administrative Expenses; (ii) any Taxes; (iii) any Service Awards; (iv) any Fee Award and Costs; and (v) the Settlement Payments and/or Settlement Benefits, pursuant to the terms and conditions of this Agreement.
Use of the Settlement Fund. As further described in this Settlement Agreement and in Exhibit B, the Settlement Fund shall be used by the Settlement Administrator to pay for the following: (1) Settlement Payments to satisfy Approved Claims of Settlement Class Members; (2) payment of the Designated Cy Pres amount; (3) Notice and Administrative Expenses; (4) Fee Award and Expenses as awarded by the Court; and (5) transfer of Remainder Funds to the extent any exist following the preceding administration of payments. No amounts may be withdrawn from the Settlement Fund unless expressly authorized by this Settlement Agreement or approved by the Court. Responsibility for effectuating payments described in this Paragraph shall rest solely with the Settlement Administrator, and neither Defendant nor Defendant’s agents shall have any responsibility whatsoever with respect to effectuating such payments.
Use of the Settlement Fund. As further described in this Agreement and in Exhibit C, the Settlement Fund shall be used by the Settlement Administrator to pay for the following: (1) reimbursement for Out-of-Pocket Losses, Lost Time, and Pro Rata Cash Compensation (2)
Use of the Settlement Fund. As further described in this Agreement, the Settlement Fund shall be used by the Settlement Administrator to pay for the following: (i) Notice and Administrative Expenses, (ii) Taxes and Tax-Related Expenses, (iii) Approved Claim(s) for Out-of-Pocket Losses; (iv) Approved Claim(s) for Lost Time; (v) Approved Claims for Credit Monitoring and Identity Theft Protection Services; (vi) Approved Claims for Cash Payment for Identity Theft or Data Misuse; (vii) Service Awards Payments approved by the Court, (viii) Fee Award and Costs approved by the Court; and (ix) Residual Cash Payments. Following payment of all of the above expenses, any amount remaining in the Net Settlement Fund shall be paid to the Non-Profit Residual Recipient in accordance with Paragraph 70. No amounts may be withdrawn from the Settlement Fund unless expressly authorized by this Agreement or approved by the Court.

As further described in this Agreement, the Settlement Fund shall be used by the Claims Administrator to pay for the following: (i) Notice and Administrative Expenses; (ii) Taxes and Tax-Related Expenses; (iii) Service Award Payment approved by the Court; (iv) Fee Award and Costs; (v) reimbursement for Out-of-Pocket Losses and Attested Time; and (vii) Credit Monitoring/ID Theft Protection Services. No amounts may be withdrawn from the Settlement Fund unless expressly authorized by this Agreement or approved by the Court.
Use of the Settlement Fund. As further described in this Agreement and in Exhibit B, the Settlement Fund shall be used by the Settlement Administrator to pay for the following: (i) all costs of claims administration, (ii) Plaintiffs’ counsel’s fees and expenses and Court-approved service awards, (iii) the costs of providing the Expanded Identity Theft and Fraud Monitoring for three bureau monitoring and $1,000,000 in insurance; (iv) approved Class Member Claims and Alternative Cash Benefit Claim payments on a pro rata basis to exhaust the balance of the fund. Any remaining funds shall be provided to the non-profit recipient approved by the Court. No amounts may be withdrawn from the Settlement Fund unless expressly authorized by this Agreement or approved by the Court. Responsibility for effectuating payments described in this paragraph shall rest solely with the Settlement Administrator and neither Xxxxxxxxxx nor Xxxxxxxxxx’x agents shall have any responsibility whatsoever with respect to effectuating such payments.
Use of the Settlement Fund. As further described in this Agreement, the 8 Settlement Fund shall be used by the Settlement Administrator to pay for: (i) all 9 Administrative Expenses; (ii) any Taxes; (iii) any Service Awards; (iv) any Fee 10 Award and Costs; (v) the cost of the Credit Monitoring and Identity Theft Insurance 11 Services; (vi) any Approved Claims for any Monetary Payments, Out-of-Pocket 12 Costs Payments, and Documented Time Payments pursuant to the terms and 13 conditions of Paragraph IV.E.77 of this Agreement; and (vii) any other Settlement
Use of the Settlement Fund. The Settlement Amount shall be used for the payment of: Administration Expenses; a Settlement Share to each of the Settlement Class Members; any Service Award to the Plaintiff as approved by the Court; any Fee and Expense Award as approved by the Court; and, any taxes owed by the qualified settlement fund (but not any taxes owed by individual Settlement Class Members). The Parties must approve any payment of costs or expenses under this paragraph, and such approval shall not be unreasonably withheld.
