USE, PURPOSE, TERM. Entry and use are limited to the Licensed Premises and are granted specifically, and exclusively, to the Licensee, its invitees, guests and permittees solely for the following purpose: Such entry and use by the Licensee, its invitees, guests and permittees, shall be exercised for the hours of a.m./p.m. through a.m./p.m., commencing on , 20 , and ending on , 20 . Such entry and use shall be further limited by the provisions of Section VII.
USE, PURPOSE, TERM. The CITY hereby grants LICENSEE a license to locate, construct, install, lay, drill, maintain, inspect, repair, or replace the Geothermal Facilities, and all necessary and proper equipment and fixtures necessary for the Proposed Improvements, as the LICENSEE may from time-to-time desire, along, upon, under, across and over the License Premises. Except as otherwise provided in Section VII below, any alteration, extension, or removal of the Geothermal Facilities shall require the CITY’s prior written approval. The location of said at grade or underground Geothermal Facilities and all necessary appurtenances are to be located within the License Area. Any above ground appurtenance associated with the Geothermal Facilities installed by the LICENSEE shall be reviewed and approved in writing by the CITY. All Proposed Improvements and Geothermal Facilities constructed across or below the License Premises pursuant to this License shall be in accordance with the PLANS. Entry and use are specifically, but not exclusively, granted to the LICENSEE and its contractors, agents, representatives, employees, invitees and permittees, solely for the above- stated purposes and for all purposes and uses incidental to the purposes stated herein, within, along, under and across the License Premises. Unless otherwise provided by a separate agreement, it is agreed that such Geothermal Facilities and each and every part thereof installed across and below the Property, whether fixed to the realty or not, shall be and remain the property of the LICENSEE, its successors and assigns, as their interests may appear, and the LICENSEE shall pay all taxes assessed thereon. Such entry and use by the LICENSEE, its contractors, agents, representatives, employees, invitees, permittees, and licensees, shall be exercised from the date of the execution of this License and shall continue for a period of three years or sooner terminated in accordance with the provisions of Section VII below. Such entry and use shall be further limited by the provisions of Section VI. The LICENSEE expressly agrees to restore the surface area of the Property disturbed by the Proposed Improvements permitted under this License to substantially the same condition as existed prior to the Proposed Improvements as soon as practicable after any such disturbance. USE, PURPOSE, TERM. Entry onto the road(s) is specifically, but not exclusively, granted to the Town, its Highway Surveyor, contractors, agents, representatives, employees, invitees, permittees and licensees, for the purpose of snowplowing the Road.
USE, PURPOSE, TERM. The Town hereby grants Licensee and its agents, representatives, employees, customers and invitees the right to use that portion of the Town Property depicted as “Parcel A” on the plan attached hereto as Exhibit A and incorporated herein, having an area of approximately 1,244 sq. ft. (the “Licensed Premises”) for the Permitted Use. Such entry and use by the Licensee may be exercised from the date of the execution of this License and shall continue until terminated in accordance with the provisions of Section 7 below. Such entry and use shall be further limited by the provisions of Section 4.
USE, PURPOSE, TERM. The Licensor hereby grants to the Town a license to enter upon and use the Licensed Premises for public beach purposes and beach parking purposes subject to the following specified terms and conditions hereof. Entry and use are limited to the Licensed Premises and are granted specifically, but not exclusively, to the Town, its contractors, agents, representatives, employees, volunteers, invitees, permittees and the public, solely for beach purposes, access and parking in and upon the Licensed Premises, and its use shall be subject to the supervision by the duly designated representative of the Town. Such entry and use by the Town, its contractors, agents, representatives, employees, volunteers, invitees, permittees and the public, shall be exercised from date of execution of this License until the conveyance of the Licensed Premises by the Licensor to the Town in consideration of the Town’s conveyance of the land at 0 Xxxxxxxxx Xxxxxx, Xxxxxxxxx, xxxxxxxx to the Memorandum of Understanding between the Licensor and the Town, at which time this License shall be terminated The Town shall be solely responsible for the upkeep and maintenance of the Licensed Premises, at its sole cost. The Town shall be responsible for all removal and disposal of trash related to the operation of the Licensed Premises and the removal of debris from traveled areas and walkways and shall provide disposal receptacles for the trash.
USE, PURPOSE, TERM. Entry and use are specifically, but not exclusively, granted to the LICENSEE, its contractors, agents, representatives, employees, invitees, permittees and licensees, solely for the purposes of conducting an archaeological survey of the Premises to determine the existence, if any of any archaeological relics or artifacts or an archaeological site and an endangered species inspection of the Premises. The LICENSEE agrees to deliver a copy of the inspection reports by the appropriate parties upon their completion. Such entry and use by the LICENSEE, its contractors, agents, representatives, employees, invitees, permittees, and licensees, shall be exercised from the date of the execution of this license and shall continue until 6 months from the date hereof, unless sooner terminated as set forth in Section V below. Such entry and use shall be further limited by the provisions of Section IV. The LICENSEE expressly agrees, if requested by the LICENSOR, to restore the Premises to its original condition, as nearly as possible, upon the termination of the rights granted hereunder.
USE, PURPOSE, TERM. This License is specifically, but not exclusively, granted to the Licensee for the operation of a Farmers’ Market on Pearl Street from 8:00 AM to 2:00 PM every Sunday, starting on June 10th and ending on October 21, 2018, provided that: • Pearl Street shall be closed to vehicular traffic but shall remain open to pedestrian traffic during said times. • The farmers market shall be open to the general public at all times. • The Town’s emergency vehicles (fire, police, ambulance, and other public safety vehicles) may access Pearl Street at all times for public safety or other emergency purposes. This License shall be revocable by either party upon written notice of revocation at least fourteen (14) days prior to the termination date stated within said notice. USE, PURPOSE, TERM. Entry onto and use of the Road and abutting parcels are specifically, but not exclusively, granted to the Town, its Highway Surveyor, contractors, agents, representatives, employees, invitees, permittees and licensees, for the purpose of inspecting the Road and associated drainage facilities and regrading the Road and repairing, if necessary, any drainage facilities. Such regrading shall be not more than twice per year except in an emergency declared for Mattapoisett by an authorized public officer.
USE, PURPOSE, TERM. The Agreement is for the purpose of having a banner of the Advertise placed at the Opachinski Athletic Complex according to the following terms and conditions. This Agreement commences upon execution of the Agreement, and expires on December 31, 20 . This Agreement may be extended for an additional period by payment of the advertising rate in effect at the extension date. 2023 Advertising Rates are depicted on Exibit A to this Agreement. The advertising banner shall consist of a 40” x 90’ banner, manufactured using the business logo, art, or text. A representative of the Kingston Youth Sports Organization (“KYSO”) will coordinate production with the Sign Company with final review by the Advertiser prior to production. KYSO is responsible for installation/hanging of banners at Opachinski Athletic Complex.
