VACANCIES AND NEW POSITIONS. 10.1 Except as otherwise provided in Article 10.13, except for positions of Trackman “B” which need not be bulletined, employees shall be advised by bulletin on the first Monday of each month of all vacancies or new positions in their department (except official positions), including the positions of Extra Gang Xxxxxxx and Assistant Xxxxxxx. (When the first Monday is a statutory holiday, the bulletin will be issued on the next regular working day.) Bulletins will be posted promptly in places accessible to all employees affected. A copy of each bulletin will be furnished to the Union officers of the territory involved. Note: Initial gang bulletins, when issued, will remain open for a minimum of twenty-one (21) days to a maximum of twenty-eight (28) days. Effective August 18, 1997, in the event that an employee's driver's license is revoked for the first time, the following will apply: i) The employee will be temporarily removed from that position and, will be assigned to the first available position in the same bulletin must stateclass, either in ordermaintenance or construction where a driver's license is not a requirement, their preferenceor; ii) If no such vacancy exists, the employee will be assigned to the first available position in a lower classification where a driver's license is not a requirement, or; iii) If no vacancies pursuant to (i) or (ii) above are available, the employee will be allowed to exercise displacement rights over the junior employee in the lowest classification in which he/she holds seniority, or; iv) If no position is available after applying paragraph (iii) above, the employee will be laid off until such time as a position becomes available or he regains his driver's license. For the second and any subsequent revocations of driver's license, this Article will not apply, however, the System General Chairman and the Manager, Labour Relations will meet to decide how the situation should be handled. 10.4 Applicants 9.01.6 A local bidding process may be used to all positions on seasonal work gangs shorten the normal time required to fill temporary vacancies.
