VETERANS EMPLOYMENT. Capital Metro is a recipient of Federal financial assistance on this Contract. The Contractor shall give a hiring pref- erence, to the extent practicable, to veterans (as defined in Section 2108 of Title 5 C.F.R.) who have the requisite skills and abilities to perform the construction work required under the Contract. This subsection shall not be under- stood, construed or enforced in any manner that would require an employer to give a preference to any veteran over any equally qualified applicant who is a member of any racial or ethnic minority, female, an individual with a disability, or a former employee.

VETERANS EMPLOYMENT. The Contractor shall provide a Veterans Employment Certification Report, on a quarterly basis listing the following: Total number of employees at time of proposal submission Total number of Veterans employed at time of proposal submission Total number of current employees Total number of current Veterans employed The Contractor shall make a good faith effort to maintain its Veterans employment numbers as provided at time of proposal submission and incorporated into the basic contract. The prime Contractor's efforts towards, and results in, maintaining or exceeding its Veterans employment numbers may be considered by the CO in his/her evaluation of the prime contractor's past performance on future task order awards. The prime contractor is cautioned that failure to make a good faith effort to maintain its overall Veterans employment numbers for this contract or to provide detailed supporting documentation and/or rationale when it falls short of meeting its Veterans employment numbers may prevent the contractor from receiving future task orders. The Contractor’s Veterans employment numbers set forth in its Veterans Employment Volume shall become a requirement of this contract as follows: Total number of employees at time of proposal submission: 70 Total number of Veterans employed at time of proposal submission: 14 Percentage of Veterans employed by the Prime Offeror: 20.00% The Government shall monitor the contractor's performance against its Veterans employment numbers to ensure compliance. Additionally, the Government reserves the right to review and verify the Contractor’s employment records and/or conduct site visits. The Contractor is advised that the CO may use the services of a support contractor(s) retained by VA to verify compliance. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.
