Warranty Terms & Conditions. If Buyer returns any Goods covered by this warranty in accordance with Section 9 and within the warranty period and, upon examination, Lumato determines to its satisfaction that such Goods failed to satisfy this warranty, Lumato will, at its option, repair or replace the Goods or the defective part thereof. If Lumato chooses to replace the Goods and is not able to do so because it has been discontinued or is not available, Lumato may replace the product with a comparable product (that can show small deviations in design and product specification) at its discretion. This limited warranty does not include any removal or reinstallation activities, costs or expenses, including without limitation, labor costs or expenses. This warranty only applies when the Goods have been properly wired and installed and operated within the electrical values, operating range and environmental conditions provided in the specifications, application guidelines, standards or any other document accompanying the Goods. This warranty shall be void if any person makes any unauthorized repairs or alterations to the Goods. No agent, distributor or dealer is authorized to change, modify or extend the terms of the limited warranty on behalf of Lumato, in any matter. Lumato reserves the right to make the final decision on the validity of any warranty claim. Third party products sold by Lumato are not covered under this warranty.
Warranty Terms & Conditions. Xxxxx & Xxxx flooring products must be installed in strict adherence to Our Installation and Maintenance Guide, including installation over a subfloor conforming to Our specifications or published NWFA guidelines. Installed floors must not be exposed to extreme variations in heat, humidity, moisture or dryness (including water saturation caused by wet mopping), or any other sources of extreme moisture, or changes in ambient moisture, humidity, or temperature, including installation over improperly used or functioning radiant floor heating systems or failure to maintain appropriate environmental conditions, including any failure by the HVAC systems to maintain environmental conditions. No Warranty Coverage is provided for ordinary wear and tear, including surface scratches, reduction in the shine of the finish, impact damage, wear and tear from any furniture or equipment installed or used without providing adequate protection to the installed floor, or any damage caused by failure to follow ordinary maintenance procedures, or any other damages caused by spiked heel shoes, pet claws, abrasives, including sand or pebbles, or damage caused by insects. No Warranty Coverage is provided for noises such as popping, clicking, squeaking or crackling. No Warranty Coverage is provided for variations in color, grain, or markings which are ordinary to natural products or which develop over time because of natural processes such as variant exposure to sunlight. Any damage caused during shipping is the responsibility of the shipping company and is not covered under this Warranty. Any damage to the installed flooring due to earth movement or settlement of the structure where the floor is installed, as well as any damage caused by natural events or acts of God, is not covered under this Warranty.
Warranty Terms & Conditions. The obligation of Riello under this warranty shall be to repair or replace those parts determined by Riello to be defective in material or workmanship in accordance with the warranty service procedure agreed with Client within a territory of Central Eastern European Countries (including Poland, Czech Republic, Slovakia, Lithuania, Latvia, Estonia, Hungary) provided this warranty has not otherwise been voided.
