Common use of Witness Fees Clause in Contracts

Witness Fees. 13/14/1 Where an employee is subpoenaed to testify in a legal action and the Employer determines that such subpoena resulted directly from the performance of the employee’s required duties, the Employer shall permit the employee to take time off without loss of pay to comply with the subpoena if required to appear during the employee’s regularly scheduled hours of employment; provided however, that the employee shall turn over to the Employer any witness fee received. The employee shall be reimbursed for necessary expenses pursuant to Article XIII, Section 12 (Travel & Lodging).
