A voluntary sick leave bank shall be established whereby a certificated school employee, as defined herein in Article I, who is absent from assigned duties due to personal illness and who has utilized all sick leave, personal leave, and all other paid leave benefits of whatever nature may petition a committee, as established herein, for sick leave days from the bank under the following conditions: 1. The number of accumulated days in the bank shall not exceed two hundred sixty (260) days, provided, however, that (a) a veteran teacher who is not a current member of the bank may become a member by contributing one (1) sick leave day to the bank not earlier than August 1st nor later than September 15th of any school year, and (b) a teacher who is newly hired in the school corporation shall have fifteen (15) days from the date of initial duty assignment, or until September 15th of any school year, whichever is later, during which time such teacher may choose to participate in the bank by contributing one (1) sick leave day, even though such contribution by such veteran or newly hired teacher would cause an accumulation of days in excess of the maximum specified herein; 2. Said employee may be granted days from the bank under the following conditions: a. The teacher must have chosen to become a current member of and participate in such bank by contributing one (1) sick leave day to the bank not earlier than August 1st nor later than September 15th each year, and such day contributed shall be nonreturnable to the employee. However, in the event that the number of accumulated days in the bank at the beginning of a school year is of sufficient number that a contribution of one (1) sick leave day by all teachers who are current members of the bank would cause the maximum number of days specified hereinabove in Paragraph One (1) to be exceeded, the current year's contribution by all such current members shall be suspended, except that in case the bank is depleted during the school year, the current year's contribution shall be assessed at the time of such depletion; b. The teacher must have utilized and exhausted all paid leave benefits of whatever nature, including said teacher's own accumulated sick leave and personal leave; c. Written certification will be provided from said teacher's physician substantiating the illness and certifying that the absence will continue during a period of at least ten (10) consecutive days following the utilization and exhaustion of all said paid leave benefits as provided herein; d. Written application must be made no later than twelve (12) days after exhaustion of said paid leave benefits; 3. A four (4) member sick leave bank committee shall be established to receive written requests and allot days from the bank according to the provisions herein under guidelines established by the committee. The committee shall be composed of three (3) appointed by the association and one (1) person appointed by the superintendent. Days allotted by the committee to an individual employee shall be available for use beginning with the fifth (5th) consecutive day of absence after exhaustion of the employee's said paid leave benefits, and such allotment to a teacher by the committee shall not exceed a fixed maximum as is established by the committee. The committee shall be limited to a total allotment of two hundred sixty (260) days per year. 4. Any days granted by the committee to an individual teacher shall terminate effective the earliest date as hereinafter provided: a. Xxxx Leave Bank. 1. A voluntary Sick Leave Bank shall exist as follows:
a. The purpose of the Sick Leave Bank is to provide paid days for catastrophic illness or immediate family illness to contributors to the Bank who have exhausted their accumulated sick days and who are experiencing prolonged personal or immediate family illness. Allotments will be limited to participating employees for use only in cases of illness, injury or nonelective surgery occurring under unusual, severe or emergency conditions as determined by the SBC. Xxxx Leave Bank. When the member belongs to the Sick Leave Bank, the following procedures shall be followed:
1. The Board shall cooperate in the establishment of a Sick Leave Bank on a voluntary basis. Any certificated staff member is eligible to participate, provided they meet the criteria established by the Sick Leave Bank. Sick Leave Bank information will be communicated through a designated building representative as per Sick Leave Bank bylaws. The building representative will sit on the Sick Leave Bank Council and attend all meetings. New employees will be advised of Sick Leave Bank benefits by the building representative and their mentors.
2. Each employee enrolling in the bank after their first year with the district will contribute four (4) days from his/her accumulated sick leave to enter the bank. Two (2) days will be contributed for each of their first two years of membership. A voluntary person can apply for membership in the bank in September or April after their first anniversary of employment in the district. An applicant will become a member after approval by the Sick Leave Bank Committee. Conditions for joining the Sick Leave Bank after the first anniversary are described on the application form. Should the total number of bank days fall below 4 times the total number of bank members, each member will be equally assessed additional days as determined by the sick leave bank shall council. See application in the back of the Master Agreement.
3. Additions will be established whereby a certificated made to the bank at the beginning of each school employee, as defined herein year according to the above limitations.
4. A person withdrawing from membership in Article I, who is absent the bank will not be able to withdraw his/her contributed days.
5. The first fifteen (15) days of illness or disability will not be covered by the bank but must be covered by the person's own accumulated sick leave or absence without pay.
6. A maximum of forty-five (45) days each school year can be drawn by one individual from assigned duties due to personal illness and who has utilized all sick leave, personal leave, and all other paid leave benefits of whatever nature may petition a committee, as established herein, for the bank.
7. Persons withdrawing sick leave days from the bank under the following conditions:
1. The number of accumulated will not have to replace these days in the bank shall not exceed two hundred sixty (260) days, provided, however, that (a) except as a veteran teacher who is not a current regular contributing member of the bank. 5. A Sick Leave Bank Oversight Committee shall be responsible for handling all transactions related to the maximum aforementionedoperation of said sick leave bank. The Committee shall consist of three (3) representatives appointed by the Association President. This Committee shall be empowered to adopt rules and regulations and to make decisions required to administer the sick leave bank, two-hundred sixty so long as those rules, regulations, and decisions do not modify this
a. Distributing and collecting of the Sick Leave Bank Donation Forms each contract year;
b. Recording of all donations and submitting a list of all donations to the Treasurer’s office by October 25th;
c. Processing of all requests for use of days in the sick leave bank (260receipt of requests, notification of Treasurer’s office, etc.);
d. Monitoring of all usage of days from the sick leave bank;
e. Soliciting of additional donations when the sick leave bank is within fifty (50) days or less of depletion;
f. Developing of all forms needed to operate the sick leave bank;
g. On or before July 31st of each year, publishing and filing with the Treasurer’s office an annual report that includes an itemized listing of members who donated sick leave days, the number of sick leave days donated by each unit member, the number of sick leave days used, and the number of days remaining in the sick leave bank;
h. Performing its duties in a way that respects the confidentiality of donors to and recipients from the sick leave bank.
6. The sick leave bank committee mayshall be administered by the Sick Leave Bank Oversight Committee in accordance with the following provisions:
a. All days once donated to the bank become the property of the bank and will not be returned in the event a member withdraws his/her participation in the bank.
b. Any member submitting a request to use the bank must have made his/her proper c contribution and met all eligibility requirements. If a member is physically unable to submit the form, the forms may be submitted by simple majority votea proxy.
c. A member can apply prior to using all his/her days, waive but he/she will not be able to use days from the consecutive bank until his/her own accumulated and advanced sick leave has been depleted.
d. No employee is permitted to use sick leave from the bank for any period during which he/she receives benefits under workers’ compensation laws.
e. Days granted will be compensated at the recipient’s per diem.
f. In the event a member no longer requires leave for the committee-approved reason, any remaining unused days shall be credited to the sick leave bank. The member’s sick-leave balance will be reduced within thirty (30) days to reflect the removal of unused days.
g. The Oversight Committee will review and present to the Treasurer’s office approval or denial of all requests to draw on the bank within ten (10) working days after such request and supporting documentation are received by the Committee. The Committee will also make its decisions known to the applicant within this ten (10) day requirement period.
7. To use the sick leave bank, a member must meet all of 2the following requirements:
a. The member’s personal sick leave accumulations, including any advancement outlined in this article, must be exhausted.
b. The need for additional sick leave must be based upon catastrophic illness or injury of the member, their spouse, or child but shall not include use for normal pregnancy or for purposes of adoption.
c. A physician must verify in writing the member’s need to be off work.
d. The member must agree in writing at the time of application for use of sick leave bank days as follows: I acknowledge and agree the granting of days from the sick leave bank shall be at the sole discretion of the Sick Leave Bank Oversight Committee and that all decisions of the Committee will be final, binding, and not subject to the grievance-c arbitration procedure of the VBEA Master Agreement. I further agree to abide by such decision and to waive, release, indemnify and hold harmless the provisions Vandalia-Xxxxxx City Schools District Board of 4Education, its Board members and employees, the Vandalia Xxxxxx Education the Sick Leave Bank Oversight Committee, the Ohio Education Association, and their agents (“Releases”) for any loss that I and/or members of my immediate family may sustain as a result of any claim or legal proceeding that I and/or members of my immediate family may bring against any of the aforementioned parties with respect to a decision made by any of them concerning this application, including attorney fees incurred by Releases.
8. Members who wish to request days from the sick leave bank shall submit a written application to the Oversight Committee. In order to withdraw days from the sick leave bank, the member must have enrolled in the bank prior to the appropriate enrollment deadline referenced in this article. The application shall include the following:
a. The date on which the member’s personal sick leave accumulation will be exhausted;
b. The reason why the member must be off work;
c. The number of days up to thirty (30) requested from the sick leave bank;
d. The above-c abovereferenced acknowledgement, indemnity, and hold harmless agreement;
e. The written physician’s statement verifying the member’s need to be off work. A member may make further requests for withdrawals from the sick leave bank in increments of up to thirty (30) days. The discretion to approve additional withdrawals from the sick leave bank rests with the Oversight Committee.
9. Sick leave days will not be granted for days beyond a member’s contracted employment period. However, a member may make an application for withdrawals from the sick leave bank to commence at the beginning of their next contracted employment period.
10. A member who has applied for and been recommended by a STRS/SERS physician(s) for disability retirement may not apply for days from the sick leave bank so that he/she may extend the date on which he/she will begin his/her STRS/SERS disability retirement. However, if a member’s disability is denied by the STRS/SERS Board, a member may apply for withdrawals from the sick leave bank.
11. Whenever the number of days available in the sick leave bank totals fifty (50) days or less, the Oversight Committee shall solicit donations of additional days from all bargaining unit members.
12. All days accumulated in the sick leave bank and not used during a given school year shall remain in the bank and be carried over to the next contract year.

Xxxx Leave Bank. 1. A voluntary Sick Leave Bank is established for teachers and to be used only when a participating teacher is incapacitated by a long-term personal injury or illness.
2. Only regular probationary or tenured teachers shall be eligible to participate in the Sick Leave Bank. Such eligible teachers shall have one (1) opportunity to enroll in the Sick Leave Bank program. Any eligible teacher who wishes to NOT participate must submit a written statement to that effect to the PFA President with a copy to the Superintendent of Schools. Such decision is binding for the duration of the teacher’s employment at Pavilion Central and must be made with in thirty (30) days of the teacher’s initial start date of employment. Information regarding this choice shall be prepared by the District and attached to the teacher’s appointment letter.
3. A member of the Sick Leave Bank may withdraw from membership in the Bank during the first thirty (30) days of the start of any school year by submitting their withdrawal request, in writing, to the President of the PFA with a copy to the Superintendent of Schools. Such request, once submitted, is irrevocable and the teacher may not rejoin the Bank.
4. The Sick Leave Bank shall be established by deducting one (1) annual paid leave day from each participating teacher and placing such days in a pool which shall be available to members of the Sick Leave Bank who have exhausted their annual and/or accumulated leave days allowance. Whenever the pool of days is depleted to ten (10) days, the District shall again deduct one (1) paid leave day from each participating teacher and deposit such days into the pool. Members who are half time will be permitted to participate in the sick leave bank on a pro-rata basis. Those half time members will be assessed 14 day upon hiring and 14 day whenever the pool of days is depleted to ten days. Half-time members who utilize the sick bank will utilize it in half day increments.
5. The PFA shall be established whereby a certificated school employeehave the full responsibility for forming, as defined herein in Article I, who is absent from assigned duties due to personal illness and who has utilized all sick leave, personal leaveconvening, and all other naming members to the Sick Leave Bank Committee.
6. Any participating member of the Sick Leave Bank may apply to the Sick Leave Bank Committee and request paid leave benefits of whatever nature may petition a committee, as established herein, for sick leave days from the bank under Bank after such member’s accumulated paid leave days are totally depleted. However, the following conditions:first thirty (30) consecutive school days of personal illness or injury will not be covered by the Bank, but must be covered by the member’s own accumulated leave days or absence without pay.
17. The number of accumulated days in the bank shall not exceed two hundred sixty (260) days, provided, however, that (a) a veteran teacher who is not a current Any member of the bank Sick Leave Bank may become be granted and may utilize no more than one hundred (100) Sick Leave Bank days over a period of two (2) school years for the same illness or injury, unless the PFA President and the Superintendent of Schools agree, in writing, that “special conditions” exist that warrant waiver of this limit.
8. All requests for assistance from the Sick Leave Bank must be in writing, addressed to the President of the PFA, copied to the Superintendent of Schools, and be accompanied by a Physician’s statement regarding the period of disability and/or the next scheduled date of examination. Such request must explicitly state the number of days requested from the Bank, the nature of the illness or injury, and the dates of requested assistance coverage, excepting if the request is being made for “special conditions” as referenced in #7.
9. Upon receiving a request, the President of the PFA shall be responsible for convening a meeting of the Sick Leave Bank Committee. The President of the PFA shall convey the results of the Sick Leave Bank Committee’s decisions to the Superintendent of Schools within three (3) school days after the committee has met. The Committee may request from the applying member medical statements and other reasonable evidence and/or documentation in support of the request. Decisions of the Committee, which are by contributing majority rule, are final, subject to a review by the Superintendent of Schools for compliance with applicable laws and legal standards. Decisions made under the Sick Leave Bank are not subject to the Grievance and Arbitration provisions of this agreement.
10. Should the PFA, by majority vote of its members, decide to discontinue the Sick Leave Bank, all accumulated days within the Bank shall be carried until the Bank is depleted or for one (1) sick leave day to the bank not earlier than August 1st nor later than September 15th of any school year, and (b) a teacher who is newly hired in the school corporation shall have fifteen (15) days from the date of initial duty assignment, or until September 15th of any more school year, whichever is later, during which time such teacher may choose comes first.
I. Unit members granted long-term unpaid leave are to participate in notify the bank by contributing one District at least sixty (160) sick leave day, even though such contribution by such veteran or newly hired teacher would cause an accumulation of days in excess of the maximum specified herein;
2. Said employee may be granted days from the bank under the following conditions:
a. c. Written certification will be provided from said teacher's physician substantiating the illness and certifying that the absence will continue during a period of at least ten (10) consecutive days following the utilization and exhaustion of all said paid leave benefits as provided herein;
d. Written application must be made no later than twelve (12) days after exhaustion of said paid leave benefits;
3. A four (4) member sick leave bank committee shall be established their intent to receive written requests and allot days from the bank according to the provisions herein under guidelines established by the committee. The committee shall be composed of three (3) appointed by the association and one (1) person appointed by the superintendent. Days allotted by the committee to an individual employee shall be available for use beginning with the fifth (5th) consecutive day of absence after exhaustion of the employee's said paid leave benefits, and such allotment to a teacher by the committee shall not exceed a fixed maximum as is established by the committee. Xxxx Leave Bank. A The purpose of the sick bank is to offer financial protection for those teachers who suffer serious and long-term illness or injury. The source of the sick days in such bank will be voluntary contributions of the teachers in the District. Xxxx Leave Bank. However, in the event that the number of accumulated days in the bank at the beginning of a school year is of sufficient number that a contribution of one (1) sick leave day by all teachers who are a teacher that is a current members member of the bank would cause the maximum number of days specified hereinabove in Paragraph One (1) to be exceeded, the current year's contribution by all such current members shall be suspended, except that in case the bank is depleted during the school year, the current year's contribution shall be assessed at the time of such depletion;
b. The teacher must have utilized and exhausted all paid leave benefits of whatever nature, including said teacher's own accumulated sick leave and personal leave;
c. Written certification will be provided from said by the teacher's physician or in the case of family illness, the family member's physician substantiating the illness and certifying that the absence will continue during a period of at least ten five (105) consecutive days following the utilization and exhaustion of all said paid leave benefits as provided herein;
d. c. Written application must be made no later than twelve (12) days after exhaustion of said paid leave benefits;
3. A d. The teacher must have been absent for at least four (4) duty days after exhaustion of said paid leave benefits;
e. Upon resumption of employment after using days from the bank, said teacher shall repay the number of days owed to the bank (number of days borrowed minus number of days contributed) at the rate of two (2) sick leave days per year, plus said teacher shall continue to contribute one (1) day per year as provided hereinabove in Paragraph 2 (a):
f. If a teacher leaves employment at this school corporation, any days owed to the bank shall be waived.
5. A three (3) member sick leave bank committee shall be established to receive written requests and allot days from the bank according to the provisions herein herein, under guidelines established by the committee. The committee shall be composed of three two (32) persons appointed by the association Federation and one (1) person appointed by the superintendentSuperintendent. Days allotted by the committee to an individual employee teacher shall be available for use beginning with the fifth (5th) consecutive day of absence after exhaustion of the employeeteacher's said paid leave benefits, and such allotment to a teacher by the committee shall not exceed a fixed maximum as is established by the committeeof thirty (30) days for teacher use and fifteen (15) for family medical support per application. The committee shall be limited to a total allotment of two hundred sixty fifty (260250) days per school year.
46. A teacher who is unable to return to assigned duties when the allotted days are exhausted may re-apply to the committee for additional days. Any days granted by the committee to an individual teacher shall terminate effective the earliest date as hereinafter provided:
a. The day after the last day of the term of employment for the school year, or
b. The day after the last day of allotted number of days granted by the committee, or
c. The first day of return to employment subsequent to the granting of days by the committee.
5. After having met the maximum severance, a certificated school employee’s unused sick days, after they have met their maximum severance, shall automatically be donated to the sick leave bank. Donated days that exceed the cap of two hundred sixty d. Long-term disability (260LTD) days shall be placed in an unlimited reserve account. Days in the unlimited reserve may only be transferred to the sick bank at the start of the next school year, and only the amount of days needed to fill the sick leave bank to the maximum aforementioned, two-hundred sixty (260) daysinsurance takes effect.
6. The sick leave bank committee may, by simple majority vote, waive the consecutive day requirement of 2-c and the provisions of 4-c above.

Xxxx Leave Bank. A voluntary sick leave bank The Board agrees to establish a Sick Leave Bank to cover teachers in the event of a long-term illness. The Sick Leave Bank shall be established whereby a certificated school employee, as defined herein in Article I, who is absent from assigned duties due to personal illness and who has utilized all sick leave, personal leave, and all other paid leave benefits of whatever nature may petition administered by a committee, as established herein, for sick leave days from hereinafter called the bank under the following conditions:
1. 2. Said employee may be granted days from the bank under the following conditions:
a. 1. The number of accumulated days Participation in the sick bank is mandatory for all teachers. 2. Said employee may be granted days from the bank under the following conditions:
a. The teacher must have chosen to become a current member of and participate in such bank by contributing one (1) sick leave day to the bank not earlier than August 1st nor later than September 15th each year, and such day contributed shall build it up again.
3. Additions will be nonreturnable made to the employee. However, in the event that the number of accumulated days in the bank at the beginning of each fiscal year according to the above limitations.
4. A teacher must first utilize all of his/her personal sick leave accumulation before applying to the Sick Bank. Sick Bank use shall not exceed the number of leave days between the exhaustion of the teacher’s personal sick leave days and the commencement of long-term disability coverage. If the teacher has less than twenty-five (25) days of leave accumulation, the illness or injury must be covered by absence without pay, except that when a teacher who has been on the Bank suffers a relapse, the teacher will not be subject to the waiting period. Following the twenty-fifth (25) day of absence, or the expenditure of accumulated leave days as indicated above, whichever is later, a teacher may apply for use of the Bank. A tenure teacher shall have the use of the Sick Leave Bank extended into the following school year for up to a maximum usage if the injury or illness shall make it necessary.
5. Application for withdrawals from the Bank shall be made to the Sick Bank Committee, which is selected by the teachers. The Committee shall be responsible for authenticating the claim of sufficient number that illness or injury, as well as the eligibility of a contribution of teacher to draw on the Bank. Each September, the teachers shall select one (1) sick leave day by all teachers who are current members of the bank would cause the maximum number of days specified hereinabove in Paragraph One (1) to be exceeded, the current year's contribution by all such current members shall be suspended, except that in case the bank is depleted during the school year, the current year's contribution shall be assessed at the time of such depletion;
b. The teacher must have utilized and exhausted all paid leave benefits of whatever nature, including said teacher's own accumulated sick leave and personal leave;
