Ancillary Program definition

Ancillary Program means any software agent or tool owned or licensed by Oracle that Oracle makes available to You for download as part of the Cloud Services for purposes of facilitating Your access to, operation of, and/or use with, the Services Environment. The term “Ancillary Program” does not include Separately Licensed Third Party Technology.

Ancillary Program means the third party software specified in the Documentation and in one or more Order Forms issued pursuant to this Agreement and which are delivered with or embedded in the Program.

Ancillary Program means any Software agent or tool owned or licensed by ORock that ORock makes available to Customer for use or download as part of the Services for purposes of facilitating Customer’s access to, operation of, and/or use with, the ORock Infrastructure. The term “Ancillary Program” does not include Separately Licensed Third-Party Technology.

Examples of Ancillary Program in a sentence

• In addition to CMC's warranties in Section 7.1, Customer shall have the benefit of any third party warranties available to end users of the Ancillary Programs; provided however, that Customer's sole remedy for breach of any third party warranties shall be against the third party licensor providing the Ancillary Program and not against CMC.

• To use a Program, Xxxxxxxx Consulting may need to use an Ancillary Program.

• The Ancillary Program may be used only in combination with Programs for the purpose of installing or operating Programs as described on the Order Form(s) or Documentation, and for no other purpose.

• In the event that an Ancillary Program causes the Programs to fail to perform in all material respects the functions described in the Documentation when operated on a Supported Platform, Siebel will use commercially reasonable efforts to provide Customer with a workaround or fix pursuant to EXHIBIT B where such workaround or fix may include, at Siebel's option, replacing the Ancillary Program with a replacement Ancillary Program having substantially equivalent functionality at no additional charge.

• In the event that an Ancillary Program or other third party product is not Year 2000 compliant, Siebel shall use commercially reasonable efforts to provide Customer with relevant information regarding such product or the vendor of such product; provided, however, that Customer's sole remedy for any failure of any Ancillary Programs or other third party products to be Year 2000 compliant shall be against the third party vendor of such products and not against Siebel.

Each Order Form shall incorporate this Agreement by reference. 2.7 “Program” shall mean (i) the version of our software identified as Program(s) specified in an Order Form, and (ii) Updates to such Programs. Programs shall not include Ancillary Programs. 2.8 “Services” shall mean all services provided by us under this Agreement, including Maintenance Services. 2.9 “Statement of Work” shall mean a document provided by us to you under which you may order Services, other than Maintenance Services, at the rates set forth therein , and which is executed by the parties. All Services provided under a Statement of Work shall be provided on a time and material basis unless otherwise set forth therein.
