Basic Operating Costs definition

Basic Operating Costs shall have the meaning given to such term in Section 6.
Basic Operating Costs means all commercially reasonable and customary expenses and costs of every kind and nature which Landlord shall pay or become obligated to pay because of or in connection with the management, maintenance, preservation and operation of the Building and the Project (determined in accordance with generally accepted accounting principles, consistently applied) including but not limited to the following:
Basic Operating Costs shall have the meaning given in Section 3.5.

Examples of Basic Operating Costs in a sentence

  • If Tenant does not so review or audit Landlord’s books and records, the Basic Operating Costs for a particular Computation Year shall be final and binding upon Tenant.

  • Such insurance shall be maintained at the expense of Landlord (as a part of the Basic Operating Costs), and payments for losses thereunder shall be made solely to Landlord or the mortgagees of Landlord as their interests shall appear.

  • Notwithstanding such abatement of Base Rent, (a) all other sums due under the Lease, including Tenant’s Proportionate Share of Basic Operating Costs, Tenant’s Proportionate Share of Property Taxes and Additional Rent, shall be payable as provided in the Lease, and (b) any increases in Base Rent set forth above shall occur on the dates scheduled therefor.

  • In addition to the Base Rent required to be paid hereunder, Tenant shall pay as Additional Rent, Basic Operating Costs in the manner set forth below.

  • Repairs and maintenance by Landlord pursuant to this Section 12 are included in Basic Operating Costs, except to the extent excluded by Section 6(e).


More Definitions of Basic Operating Costs

Basic Operating Costs means the building operating costs for the calendar year 1998. Landlord shall determine the basic operating costs and ----- shall notify Tenant in writing of the amount thereof. Tenant's percentage share of the increasing costs shall be determined by dividing the total number of square feet then currently leased by Tenant by the total gross leasable square feet of the buildings comprising of approximately 61,693 square feet. -------------------
Basic Operating Costs has the meaning given to such term in Exhibit "H" attached hereto and made a part hereof for all puiposes.
Basic Operating Costs means all direct and, to the extent provided in Paragraph 1(a), indirect costs and expenses incurred in each calendar year of operating, maintaining, repairing, managing and, to the extent specifically provided below, owning the Complex. "Basic Operating Costs" includes, without limitation, the following: (a) Wages, salaries and other compensation of all employees engaged in the direct operation and maintenance of the Complex, employer's social security taxes, unemployment taxes or insurance and any other taxes which may be levied on such wages, salaries and other compensation, and the cost of medical, disability and life insurance and pension or retirement benefits for such employees (but if employees are engaged in the operation and maintenance of other buildings owned by Landlord or an affiliate of Landlord, other than the Complex, the employee-related costs will be fairly apportioned among all such buildings); (b) Electricity Costs for the Complex incurred in the use, occupancy and operation of the Complex and all related improvements and appurtenances, including, but not limited to, electricity use for heating and air conditioning and perimeter lighting for the Complex, net of Submetered Power; (c) Cost of leasing or purchasing all supplies, tools, equipment and materials used in the operation, maintenance, repair and management of the Complex; (d) Cost of all utilities for the Complex (both interior and exterior), such as, water and power, sewage, heating, lighting, air conditioning and ventilation (but specifically excluding Electricity Costs for the Complex);
Basic Operating Costs means all reasonable costs and expenses incurred in each calendar year for operating, maintaining, repairing, managing the Building save and except those costs and expenses which Landlord is to be reimbursed by tenants of the Building. Basic Operating Costs include, but are not limited to, the following:
Basic Operating Costs. MEANS ALL DIRECT AND, TO THE EXTENT PROVIDED IN SECTION 6(d)(1), INDIRECT COSTS AND EXPENSES INCURRED IN EACH CALENDAR YEAR OF OPERATING, MAINTAINING, REPAIRING, MANAGING AND, TO THE EXTENT SPECIFICALLY PROVIDED BELOW, OWNING THE COMPLEX, INCLUDING, WITHOUT LIMITATION, THE FOLLOWING: 4.1. Wages, salaries and other compensation of all employees engaged in the direct operation and maintenance of the Complex, employer's social security taxes, unemployment taxes or insurance and any other taxes which may be levied on such wages, salaries and other compensation, and the cost of medical, disability and life insurance and pension or retirement benefits for such employees; provided, however, with respect to employees engaged in the operation and maintenance of other buildings owned by Landlord (or an affiliate of Landlord), other than the Complex, such items shall be fairly apportioned among all such buildings;
Basic Operating Costs has the meaning given to such term in Section 4.2.
Basic Operating Costs means all costs and expenses incurred by Landlord in each calendar year for operating, maintaining, repairing, managing and, except as otherwise specifically provided in Section 4.2(g) below, owning the Complex. “Basic Operating Costs” includes, without limitation, utilities attributable to the Common Areas, insurance, Taxes, general landscaping, mowing of grass, care of shrubs (including replacement of plants), operation and maintenance of lawn sprinkler system, operation and maintenance of exterior security lighting, water service and sewer charges, repainting of exterior surfaces of truck doors, handrails, down spouts and other parts of the Buildings that require periodic preventative maintenance, roof repairs and maintenance (to the extent not directly paid by Tenant), parking lot maintenance (including paving repairs and maintenance), common area maintenance, security service, pest control service for the Common Areas and Service Areas, property management fees, property ownersassociation dues and assessments, costs of insurance relating to the Complex, legal expenses incurred with respect to the Complex which relate directly to the operation of the complex and which benefit all of the tenants of the Complex generally, and any and all sales, use or other taxes with respect to the foregoing charged by 1 or more applicable authorities. Landlord may, at its option, amortize over a period of time reasonably determined by Landlord in accordance with generally accepted accounting principles using the straight-line method of depreciation, and collect through Basic Operating Costs, the amortized costs and expenses associated with the replacement of capital investment items which (i) Landlord reasonably believes will reduce (or avoid increases in) Basic Operating Costs, to the extent the replacement actually reduces or avoids increases in Basic Operating Costs, (ii) Landlord reasonably believes is required for the safety of tenants and occupants of the Complex, or (iii) may be required in order to comply with any federal, state or municipal law, code or ordinance, or regulation which was not promulgated, or which was promulgated but was not in effect or applicable to the Complex as of the Effective Date.
