Change in Scope definition

Change in Scope. For substantial modifications in authorized Project scope, and/or specifications previously accepted by City, when requested by City and through no fault of Consultant, the Consultant shall be compensated for time and expense based upon the fee schedule in Exhibit B (Cost Proposal) attached hereto and incorporated herein chargeable for this service; provided, however, that any increase in Total Fee must be approved through a written Supplemental Agreement. Consultant shall correct or revise any errors or deficiencies in its designs, drawings, or specifications without additional compensation when due solely to Consultant’s negligent acts, errors, or omissions. If not solely Consultant fault, then the parties will negotiate an equitable sharing of the fees associated with such changes and the fixed fee will be increased or decreased accordingly. This Agreement may be amended to provide additions, deletions, and revisions in the Professional Services or to modify the terms and conditions thereof by written Supplemental Agreement.
Change in Scope has the meaning set forth in Section 3.3;

  • The County reserves the right at any time during the Term of this 1913 Agreement to modify these insurance requirements, including limits, based on the nature of the 1914 risk, prior experience, insurer, coverage, or other special circumstances, provided that any such 1915 modifications shall be deemed a Change in Scope subject to Section 8.3 above.

  • Any Rate adjustment due to a Change in Scope, a Change in Law or an 1629 Extraordinary Cost Increase shall be in the reasonable discretion of County.

  • In the event that any works required by the Safety Consultant shall fall beyond the scope of Schedule-B, Schedule-C or Schedule-D, the Contractor shall make a report thereon and seek the instructions of the Authority for Change in Scope.
