Enhanced Extended Links (EELs). 5.3.1 EELs are combinations of Loops and Dedicated Transport as defined in this Attachment, together with any facilities, equipment, or functions necessary to combine those Network Elements. BellSouth shall provide AFN with EELs where the underlying Network Element are available and are required to be provided pursuant to this Agreement and in all instances where the requesting carrier meets the eligibility requirements, if applicable. 5.3.2 High-capacity EELs are (1) combinations of Loop and Dedicated Transport, (2) Dedicated Transport commingled with a wholesale loop, or (3) a loop commingled with wholesale transport at the DS1 and/or DS3 level as described in 47 C.F.R. § 51.318(b). 5.3.3 By placing an order for a high-capacity EEL, AFN thereby certifies that the service eligibility criteria set forth herein are met for access to a converted high-capacity EEL, a new high-capacity EEL, or part of a high-capacity commingled EEL as a UNE. BellSouth shall have the right to audit AFN’s high-capacity EELs as specified below.

Enhanced Extended Links (EELs). 5.2.1 EELs are combinations of unbundled Loops and unbundled dedicated transport as defined in this Attachment, together with any facilities, equipment, or functions necessary to combine those Network Elements. BellSouth shall provide Southern Telecom with EELs where the underlying UNEs are available and in all instances where the requesting carrier meets the eligibility requirements, if applicable. 5.2.2 High-capacity EELs are combinations of loop and transport UNEs or commingled loop and transport facilities at the DS1 and/or DS3 level as described in 47 CFR 51.318(b). High-capacity EELs must comply with the service eligibility requirements set forth in 5.2.4 below. 5.2.3 By placing an order for a high-capacity EEL, Southern Telecom thereby certifies that the service eligibility criteria set forth herein are met for access to a converted high-capacity EEL, a new high-capacity EEL, or part of a high-capacity commingled EEL as a UNE. BellSouth shall have the right to audit Southern Telecom’s high-capacity EELs as specified below. 5.2.4 If a high-capacity EEL or Ordinarily Combined Network Element is not readily available but can be made available through routine network modifications, as defined by the FCC, Southern Telecom may request BellSouth to perform such routine network modifications. The request may not be used to place fiber. Each request will be handled as a project on an individual case basis. BellSouth will provide a price quote for the request, and upon receipt of payment by Southern Telecom, BellSouth shall perform the routine network modifications.

Beginning June 29, 2010, and with respect to any period of time, either before of after such date, AT&T shall have the right to audit TWTC’s high-capacity EELs as specified below. AT&T may not deny, except as set forth in Section 4.3.5 below, TWTC’s request for a high-capacity EEL based upon eligibility criteria, but shall have the right to clarify the order back to TWTC rather than processing the order should the AT&T representative identify that TWTC does not have a collocation arrangement that meets the requirements of 47 C.F.R. 51.318(c).

This offering is intended to provide connectivity from an end user’s location through that end user’s SWC to DSL Telecom’s POP serving wire center. The circuit must be connected to DSL Telecom’s switch for the purpose of provisioning telephone exchange service to DSL Telecom’s end-user customers. The EEL will be connected to DSL Telecom’s facilities in DSL Telecom’s collocation space at the POP SWC, or DSL Telecom may purchase BellSouth’s access facilities between DSL Telecom’s POP and DSL Telecom’s collocation space at the POP SWC. 5.3.3 BellSouth shall provide EEL combinations to DSL Telecom in Georgia regardless of whether or not such EELs are Currently Combined. In all other states, BellSouth shall make available to DSL Telecom those EEL combinations described in Section 5.3.4 below only to the extent such combinations are Currently Combined. Furthermore, BellSouth will make available EEL combinations to DSL Telecom in density Zone 1, as defined in 47 CFR 69.123 as of January 1, 1999, in the Atlanta, GA; Miami, FL;
