Entry Into Commercial Service. 15.1 Commercial Operation Date (COD)
Entry Into Commercial Service. 10.8.1. The construction and development of the Project shall be deemed to be complete when the Completion Certificate is issued under the provisions of Clause 10.7.8 or 10.7.9, and accordingly the Commercial Operation Date (the “COD”) of the Project shall be the date on which such Completion Certificate is issued. The Project shall enter into commercial service on COD whereupon the Concessionaire shall be entitled to receive the Storage and Handling Charge from the Authority in accordance with the provisions of Article 15.

15.1.1. Storage Facility shall be deemed to be complete when the Completion Certificate or the Provisional Certificate, as the case may be, is issued under the provisions of Article 14, and accordingly the commercial operation date of the Project shall be the date on which such Completion Certificate or the Provisional Certificate is issued (the “COD”).
15.1.2. The Storage Facility shall enter into commercial service on COD whereupon the Concessionaire shall be entitled to receive Storage and Handling Charges from the Authority in accordance with the provisions of Article 25.
15.1.3. For avoidance of all doubt it is, hereby, agreed and accepted by the Parties that the declaration of COD, in case of earlier completion of the Storage Facility and issue of Completion Certificate as detailed in Clause 14.2, will be at the sole and exclusive discretion of the Authority.

15.1.1 The Storage Facility shall be deemed to be complete when the Completion Certificate or the Provisional Certificate, as the case may be, is issued under the provisions of Article 14 and the commercial operation date of the Storage Facility shall [, subject to the provisions of Clause 15.1.3,] be the date on which such Completion Certificate or the Provisional Certificate is issued (the “COD”). The Storage Facility shall enter into commercial service on COD whereupon the Concessionaire shall be entitled to demand and collect the Fixed Charge in accordance with the provisions of Article 27, provided, however, that the entry of Storage Facility into commercial service shall always be subject to compliance with the provisions of Clause 14.7. For the avoidance of doubt, the Parties expressly agree that if the Storage Facility is substantially completed but COD is delayed for reasons attributable to the Authority, 20% (twenty per cent) of the Fixed Charge shall be due and payable hereunder as if COD has occurred for the Project or any section thereof, as the case may be, in addition to the extension of Concession Period under and in accordance with Clause 36.3.
15.1.2 In the event that the Authority prevents, or causes to be prevented, or in any manner delays the entry of the Storage Facility into commercial service after issuance of Completion Certificate or the Provisional Certificate, as the case may be, or where such delay occurs in the issuance of such certificate by the Independent Expert for any reason attributable to the Independent Expert or the Authority, as the case may be, the Concessionaire may declare COD and notify the Authority forthwith. In the event of any Dispute relating to the declaration of COD hereunder, the Dispute Resolution Procedure shall apply.

Entry Into Commercial Service. 13.1.1. The rights, privileges, liberties and obligations of the Concessionaire, particularly the Concession shall commence from the date on which all Conditions Precedent have been satisfied in accordance with Article 4 (the "Appointed Date"), and determination of the Appointed Date by the Contracting Authority shall be final, conclusive and binding on the Concessionaire. The Project Highway shall for the purposes of this Agreement enter into commercial service on the Appointed Date whereupon the Concessionaire shall be entitled to demand and collect Fee and perform its O&M Obligations subject to and in accordance with the provisions of this Agreement.

Each Phase of the Airport shall be deemed to be complete when the Completion Certificate or the Provisional certificate for such Phase, as the case may be, is issued under the provision of Article 14, and accordingly the commercial operation date of the respective Phase of the Airport shall be the date on which such Completion Certificate or the Provisional Certificate is issued and the Concessionaire shall have obtained the Applicable Permits, including the licence from DGCA to operate the respective Phase of the Airport (“the COD”). The Airport shall enter into commercial service on COD for Phase I whereupon the Concessionaire shall be entitled to demand and collect Fee in accordance with the provisions of Article 32.
15.1.2. In the event that the Authority prevents, or causes to be prevented, or in any manner delays the entry of the Airport into commercial service after issuance of Completion Certificate or the Provisional Certificate, as the case may be, or where such delay occurs in the issuance of such certificate by the Independent Engineer for any reason attributable to the Independent Engineer or the Authority, as the case may be, the Concessionaire may declare COD for respective Phase and notify the Authority forthwith. In the event of any Dispute relating to the declaration of COD for respective Phase hereunder, the Dispute Resolution Procedure shall apply.
