Environmental Trust Assets definition

Environmental Trust Assets means all Owned Sites and related assets that are identified in the Environmental Claims Settlement Agreement and which will be transferred to the Environmental Response Trusts on the Effective Date; provided, however, that Tronox may, at its expense and in accordance with applicable health and safety requirements, remove certain equipment and other assets related to Tronox’s operations from each of the Savannah, GA, Soda Springs, ID and Mobile, AL sites and transfer such equipment and assets to alternate locations to be determined by Reorganized Tronox.

  • The Environmental Trust Beneficiaries shall hold all of the Environmental Custodial Trust Interests, which shall entitle the Environmental Trust Beneficiaries to their share of the recoveries with respect to the Environmental Trust Assets in accordance with the terms of the Environmental Custodial Trust Agreement.

  • The Environmental Response Trust shall regularly, but not less often than annually, and otherwise upon the reasonable request of the Environmental Agencies, provide documentation to the Environmental Agencies to substantiate compliance with the applicable approved budget and application of Environmental Trust Assets consistently with the terms of this Agreement and the Stipulation and Settlement Agreement.

  • Response Trust hereby accepts and agrees to hold the Environmental Trust Assets in the Environmental Response Trust for the benefit of the Beneficiaries for the purposes described in Section 2.3 below, subject to the terms of the Stipulation and Settlement Agreement, this Agreement, and any applicable orders of the Court.

Environmental Trust Assets means all Owned Sites and related assets that are identified in the Environmental Claims Settlement Agreement and which will be transferred to the Environmental Response Trusts on the Effective Date; provided, however, that Tronox with the consent of the Equity Committee may, at Tronox’s expense and in accordance with applicable health and safety requirements, (a) with the consent of the Equity Committee, remove certain equipment and other assets related to Tronox’s operations from each of the Savannah, GA, Soda Springs, ID and Mobile, AL sites and transfer such equipment and assets to alternate locations to be determined by Reorganized Tronox; and (b) at the direction of the Equity Committee, remove the Savannah, GA facilities in part or in their entirety.
Environmental Trust Assets means: (a) the Gulfport Facility and any portion of the Gulfport Adjoining Parcels that are ultimately transferred to the Environmental Response Trust; (b) the Funds (defined herein), and any documents and/or information (including Environmental Information or Real Property Information, as defined in the Settlement Agreement) concerning the Gulfport Property in the possession of Debtors or environmental contractors or consultants previously retained by the Debtors, to be transferred to the Environmental Response Trust; (c) the funds currently held in the Reichhold Chemicals, Inc. Standby Trust to be transferred into the Environmental Response Trust; and (d) such other assets acquired or held by the Environmental Response Trust from time to time pursuant to the Settlement Agreement, this Agreement, or an order of the Court.
Environmental Trust Assets means (a) those assets and properties, including without limitation the Transferred Debtor Assets, the NPP Bond Payments, and the Initial Funding, transferred by any party to the Environmental Response Trust pursuant to the Consent Decree and Settlement Agreement (see Paragraphs 6, 7, 9, 10, 32-34 of the Consent Decree and Settlement Agreement), and (b) such other assets acquired, earned, or held by the Environmental Response Trust from time to time pursuant to this Agreement and the Consent Decree and Settlement Agreement, including the Environmental Trust Proceeds (defined below).
Environmental Trust Assets means any and all assets of the Environmental Trust, including, without limitation, all of the stock of Poor Charlie and Company and the Poor Charlie Assets.

Related to Environmental Trust Assets

  • Supplemental Trust Agreement means any trust agreement then in full force and effect which has been duly executed and delivered by the Authority and the Trustee amendatory hereof or supplemental hereto; but only if and to the extent that such Supplemental Trust Agreement is executed and delivered pursuant to the provisions hereof.

  • Trust Assets means, with respect to the Appointments and to the extent held, deposited or invested by any Seller for the benefit of others (whether or not constituting all or a portion of the corpus of any trust) as collateral, trust assets or otherwise by the applicable Corporate Trust Contracts or any other applicable legal obligation, (a) all cash on hand or held in bank accounts (including the Deposits) or in money market funds, and (b) all shares, stock, bonds, debentures, notes, mortgages, guarantees, letters of credit, certificates of indebtedness, warrants, treasuries or other securities or financial instruments or property of any type or description.

  • Liquidating Trust Assets means the assets of a Debtor or Debtor-Controlled Entity to be transferred to a Liquidating Trust as may be determined by the Plan Administrator, which shall be described in a Liquidating Trust Agreement.
