More Definitions of General Exclusions

General Exclusions the health Benefits and services excluded from Coverage that are listed in Section 11 of this Policy and apply to all Covered Persons.
General Exclusions. This inspection is limited to the real property and does not include personal property unless so indicated in the report. Xxx Xxxxxxxx will not inspect or report on systems and items that are not included or that are specifically excluded in the “Standards of Practice” unless otherwise agreed to in writing and signed by the parties. No representation is made as to how long any equipment will continue to function. Maintenance conditions may be discussed, but they are not a part of this inspection. The inspection to be performed is a visual inspection only. Latent and concealed defects and deficiencies are excluded from the inspection. Xxx Xxxxxxxx shall have no liability for conditions that are concealed from view or inaccessible to Xxx Xxxxxxxx. A system or component is not accessible if inspection requires moving personal property, dismantling, destructive measures, or any action that will, in the opinion of Xxx Xxxxxxxx, may likely involve risk to persons or property. Anything not readily observable because it is concealed or inaccessible due to obstructions including, but not limited to, floor coverings, suspended ceiling tiles, insulation, furniture or other personal property, soil, vegetation, water, ice or snow cannot be inspected. Xxx Xxxxxxxx is not required to move or disturb such items in order to diminish or eliminate the obstruction. SPECIFIC EXCLUSIONS:
General Exclusions. Any incidents that require maintenance or Repair within the first 28 days of Your Start Date. • Any boiler in commercial premises including schools or care homes. • Any inadequacy attributing to original installation or design of the System. • Any damage due to the failure of water, gas or electricity supply. • Any work including de-scaling that may arise due to hard water scale deposits or aggressive water supply. • Oil tanks, oil fire valves, oil pipe line/pipework leading from the tank to the boiler and any other oil components that are not internal to the boiler. • LPG tanks, regulators, hoses and pipework leading from the Cylinders to the boiler and any other LPG components that are not internal to the boiler. • Mechanical breakdowns due to Sludge build-up within the System, removal of products or corrosion from within the System should the heat exchanger or heat bank fail, this will deem the boiler to be Beyond Economic Repair. • Any damage or defect caused by lightening, frost, explosion, war, flood, xxxxx, xxxxxxx, fire, impact or other extraneous causes or any other risk normally insured under household or other insurances. • Any defect caused through Accidental Damage (except where Accidental Damage caused by you is specifically stated as being included under Your Boiler Service and Maintenance Product), intentional risk taking, negligence, misuse, third party interference or malicious or wilful action. • The Replacement of decorative parts. • Any adjustment of time and temperature controls, bleeding radiators or pressurising sealed systems and relighting pilot lights. • The fabric of the building and any pipework including flues buried in it. • Any faults present at the time of signing the initial Contract, any call-outs deemed to have been preexisting to the commencement date of the Boiler Service and Maintenance Product and within the first 28 days of the Contract will not be covered and may incur a charge for the callout and any parts required, at the current MJC Home Services LTD rates, variable to the day and time of the call-out. • Replacement of flues. • Consumables (e.g. batteries, filters, inhibiter, fuses, oil nozzles and igniter’s). • Asbestos associated with Repairing the Central Heating appliance/System. General Exclusions. The foregoing restrictions shall not apply to information to the extent that it: (a) is or becomes publicly available through no act or omission of the receiving Party; (b) was already in the lawful possession of the receiving Party without an obligation of confidentiality; (c) is lawfully disclosed to the receiving Party by a third party without restriction; (d) is required to be disclosed by subpoena or other legal process, limited to the extent required by the terms of such subpoena or other legal process;

  • Classroom exclusion means the exclusion of a student from a classroom or instructional or activity area for behavioral violations, subject to the requirements of WAC 392-400-330 and 392-400-335. Classroom exclusion does not include action that results in missed instruction for a brief duration when:

  • Zero tolerance means that the school will not tolerate the possession of any weapon by any person. The term “weapon” is defined as any object or substance which by its design, threatened use, or use could cause bodily injury or property damage, including any object which could reasonably be mistaken for a weapon. The division director and dean of student life shall use their discretion when interpreting the use and intent of such articles at school.
