I dissent. Xxx Xxxxxxx, Union Nominee Dissent of Employer Nominee I have reviewed the Award of the Chair and I respectfully dissent on the issue of Staffing. The issue of Staffing was an issue in dispute in the previous round of bargaining, which was ultimately determined by Arbitration. In the Arbitration Award, the Chair of the Arbitration Board, Mr. Xxxxxxx Xxxxxx at page 3 of his award concluded that “… The Table of comparable provisions demonstrates that the staffing obligations at the home significantly exceed virtually every comparator …”. At page 4 Xx. Xxxxxx concluded, “In these circumstances, it is appropriate to take a step toward bringing these staffing obligations in line with sector norms …”. He then awarded that effective the first pay period in February 2014, staffing would be reduced from 120 to 106 shifts per pay period. In this round of bargaining, Rideaucrest was proposing that staffing be further reduced from 120 to 70 shifts per pay period and ONA was proposing the status quo. ONA’s statistics indicate that Rideaucrest has staffing language that is more onerous than 60 of 74 homes for the aged in the province, and no home in the geographic area has more restrictive staffing language than Rideaucrest. Based on these facts, the Chair of the Arbitration Board should have awarded a further step than Arbitrator Xxxxxx did to bring staffing obligations more in line with sector norms. ONA indicated that for all homes for the aged the average time per day is 17.4 minutes of RN care. If that average was applied to Rideaucrest, staffing would be reduced from 106 shifts to 92 shifts per pay period. This would still provide staffing in the top half of the province and staffing that would be better than regional comparators. The Chair should have at least awarded this change coupled with the guarantee that no current RN would be displaced by such a reduction.
