Ineligible Expenses definition

Ineligible Expenses means Ineligible Expenses as defined in Appendix A;

Ineligible Expenses means expenses that are not eligible for payment under this Agreement, as listed in section 4.2,

Ineligible Expenses has the meaning given to it in Section 4.4 of Schedule “A”.

Examples of Ineligible Expenses in a sentence

• Alberta Innovates will have no liability or obligation to reimburse the Applicant for any Project Costs incurred after the effective date of termination and may require the Applicant to return any portions of the Investment which were spent on Ineligible Expenses.

• It is a condition of the Investment that Alberta Innovates has the right to require the Applicant to repay to Alberta Innovates any portions of the Investment which were used to cover Ineligible Expenses, and such amount shall constitute a debt immediately owing and repayable on demand by the Applicant to Alberta Innovates.

• Eligible and Ineligible Expenses (92.205; 92.206; 92.214): All such expenses shall be in conformance to the approved project budget.

• Please do not request TDC pay for items that are on the list of Ineligible Expenses (see pages 5-6).

• It is a condition of the Investment that Alberta Innovates has the right to require the Applicant and/or the Service Provider to repay to Alberta Innovates any portions of the Investment which such Party used to cover Ineligible Expenses, and such amount shall constitute a debt owing and repayable by the Applicant to Alberta Innovates.

More Definitions of Ineligible Expenses

Ineligible Expenses shall have the meaning defined in Exhibit B to this Agreement.

Ineligible Expenses means expenses not reimbursable by the Grant under the Program, the Guidance, or the Guidelines; expenses not timely requested; expenses for which insufficient explanation or documentation is provided; and expenses for which reimbursement is not requested in accordance with the submission instructions established by the Program;

Ineligible Expenses means any cost that does not qualify as an Eligible Expense. For avoidance of doubt, "Ineligible Expenses" Includes all of the following: i. any cost incurred prior to the Project Start Date, except where Alberta Innovates has provided written approval to include the cost as an Eligible Expense; ii. transactions between Related Persons; iii. allowance for interest on debt; iv. losses on investments, bad debts and expenses for collection charges; v. losses on other projects or activities not related to the Project;

Ineligible Expenses means any cost that does not qualify as an Eligible Expense. For avoidance of doubt, "Ineligible Expenses" Includes all of the following:

Ineligible Expenses means expenses (as further described in Appendix B) that do not meet the Eligibility Requirements for reimbursement and are not eligible for reimbursement by the IESO pursuant to Section 4.

Ineligible Expenses means expenses which are ineligible for operational grant funding, this includes, but is not limited to:

Ineligible Expenses means fees and/or expenses incurred by any Person, including professionals in the Bankruptcy Cases and the Creditors’ Committee (a) in preventing, hindering or delaying Administrative Agent’s or Lenders’ enforcement or realization upon any of the Collateral, except such fees and/or expenses incurred by the Credit Parties specifically and solely to contest whether an Event of Default has occurred and exists, (b) in applying for or consummating use of cash collateral or sale of any Collateral without Administrative Agent’s prior written consent (except to the extent permitted by this Agreement), (c) in incurring Indebtedness without Administrative Agent’s prior written consent (except to the extent permitted by this Agreement), (d) in connection with any action which contravenes a right or protection of Administrative Agent and Lenders under the Loan Documents, (e) in connection with objecting to or consenting in any manner, or in raising any defenses to, the validity, extent, perfection, nonavoidability, priority or enforceability of the Obligations or any Liens or claims with respect thereto, or any other rights or interests of Administrative Agent and Lenders, or in asserting any claims or causes of action or any nature or type against Administrative Agent or Lenders, (f) that are excluded by virtue of the applicable Financing Order.
