Layoffs and reinstatement. Any member who has completed their six-month probationary period and becomes separated from their position because of lack of work, lack of money, or abolition of position shall be separated from employment according to their seniority and shall be reinstated in the same unit and in the same positions or positions similar to those formerly held by them according to such seniority, so that members with the most seniority shall be retained the longest and reinstated first. Members separated from positions under this paragraph shall be reinstated after being given written notice by first class mail prior to the appointment of any other applicants to fill such positions or similar positions, provided that the right to such reinstatement shall lapse at the end of the five (5)-year period following the date of such separation. Job postings and bidding: When a position covered by this Agreement becomes vacant, such vacancy shall be posted in a conspicuous place. The notice shall list the pay, duties and qualifications and shall remain posted for seven (7) days. Vacancy: A vacancy is an opening, which the City determines to fill, caused by promotion, demotion, retirement, resignation, transfer, termination, death or the availability of new positions. Probationary period: Each employee will serve a six-month probationary period, during which demotions, suspensions, and/or discharges or any other form of discipline are not subject to the Grievance and Arbitration Procedure, Article XIV.

In cases where qualifications and abilities are relatively equal, seniority shall be the determining factor. If at the end of the probationary period, it is determined that the employee is not qualified to perform the work, he/she shall be returned to his/her old position and rate. If there were no qualified applicants for the posted position, the City may fill the position from outside the bargaining unit.

  • Basic Conditions of Employment Act means the Basic Conditions of Employment Act, 1997 (Act No. 75 of 1997);

  • Health and Welfare Benefits means any form of insurance or similar benefit programs, which may include but not be limited to, medical, hospitalization, surgical, prescription drug, dental, optical, psychiatric, life, or long-term disability.

  • Rehabilitation Hospital means an Institution which mainly provides therapeutic and restorative services to Sick or Injured people. It is recognized as such if:

  • Homecare Worker means a provider, as described in OAR 411-031- 0040, that is directly employed by a consumer to provide either hourly or live-in services to the eligible consumer.

  • Medically Necessary Leave of Absence means any change in enrollment at the post-secondary school that begins while the child is suffering from a serious illness or injury, is medically necessary, and causes the child to lose student status for purposes of coverage under the Plan.

  • Health care worker means a person other than a health care professional who provides medical, dental, or other health-related care or treatment under the direction of a health care professional with the authority to direct that individual's activities, including medical technicians, medical assistants, dental assistants, orderlies, aides, and individuals acting in similar capacities.

  • Aging and People with Disabilities (APD means the program area of Aging and People with Disabilities, within the Department of Human Services.

  • Health care coverage means any plan providing hospital, medical or surgical care coverage for

  • Claims-made coverage means an insurance contract or provision limiting

  • Family and Medical Leave means a leave of absence for the birth, adoption or foster care of a child, or for the care of your child, spouse or parent or for your own serious health condition as those terms are defined by the Federal Family and Medical Leave Act of 1993 (FMLA) and any amendments, or by applicable state law.

  • Medical leave means leave from work taken by a covered individual that is made neces-

  • Health and Welfare Plans means any plan, fund or program which was established or is maintained for the purpose of providing for its participants or their beneficiaries, through the purchase of insurance or otherwise, medical (including PPO, EPO and HDHP coverages), dental, prescription, vision, short-term disability, long-term disability, life and AD&D, employee assistance, group legal services, wellness, cafeteria (including premium payment, health flexible spending account and dependent care flexible spending account components), travel reimbursement, transportation, or other benefits in the event of sickness, accident, disability, death or unemployment, or vacation benefits, apprenticeship or other training programs or day care centers, scholarship funds, or prepaid legal services, including any such plan, fund or program as defined in Section 3(1) of ERISA.

  • Medicare means the “Health Insurance for the Aged Act,” Title XVIII of the Social Security Amendments of 1965, as then constituted or later amended.

  • Credit unemployment insurance means insurance:

  • Paycheck Protection Program means loan program created by Section 1102 of the CARES Act.

  • Credit accident and health insurance means insurance on a debtor to provide

  • psychiatric emergency medical condition means a Mental Disorder that manifests itself by acute symptoms of sufficient severity that it renders the patient as being either of the following:

  • Diagnosis of autism spectrum disorder means medically necessary assessments, evaluations, or tests

  • income-related employment and support allowance means an income-related allowance under Part 1 of the Welfare Reform Act 2007;
