Operating Expenses Allocable to the Premises definition

Operating Expenses Allocable to the Premises means the same proportion of Landlord’s Operating Expenses for and pertaining to the Building and the Site as the Rentable Floor Area of the Premises bears to 95% of the Total Rentable Floor Area of the Building.
Operating Expenses Allocable to the Premises means the same proportion of the Operating Expenses for the Property as Rentable Area of Tenant’s Space bears to 100% of the Total Rentable Area of the Building. Operating Expenses shall not include the costs and expenses described in Exhibit D. Tenant shall pay to Landlord as additional rent Operating Expenses Allocable to the Premises, prorated in the case of any fraction of calendar year falling within the Term. Such payments shall be made at the times and in the manner hereinafter provided in this Section. Not later than ninety (90) days after the end of the first calendar year or fraction thereof ending December 31 and of each succeeding calendar year during the Term or fraction thereof at the end of the Term, Landlord shall render Tenant a statement in reasonable detail and according to usual accounting practices certified by a representative of Landlord. The statement shall show, for the preceding calendar year or fraction thereof, as the case may be, the Operating Expenses for the Property, and the Operating Expenses Allocable to the Premises. The statement shall also show for the preceding year or fraction thereof, as the case may be, the amount of operating expenses already paid by ▇▇▇▇▇▇ as additional rent and the amount of operating expenses remaining due from, or overpaid by, Tenant for the year or other period covered by the statement. Within thirty (30) days after the date of delivery of such statement Tenant shall pay to Landlord, or Landlord shall pay to Tenant, as the case may be, the balance of the amounts, if any, required to be paid pursuant to the above provisions of this Section with respect to the preceding year or fraction thereof except that Landlord shall credit any amounts due from it to Tenant as above provided against any sums then due from Tenant to Landlord under this lease. In addition, commencing with the first day of the first month following the delivery to Tenant of each statement referred to above and on the first day of each month thereafter Tenant shall pay to Landlord, on account toward ▇▇▇▇▇▇’s share of operating expenses anticipated for the then current year, one-twelfth of Landlord’s reasonable estimate of such share. Tenant or its representative shall have the right to examine ▇▇▇▇▇▇▇▇’s books and records with respect to the items included in the foregoing statements of Operating Expenses within 60 days following the furnishing by Landlord to Tenant of the statements. Operating Expenses Allocable to the Premises means the same proportion of the Operating Expenses for the Building (as hereinafter defined) as Rentable Floor Area of the Premises bears to 95% of the Total Rentable Floor Area of the Building. “Base Operating Expenses” means Operating. Expenses for the Building for calendar year 2009 (that is the period beginning January 1, 2009 and ending December 31, 2009). In addition, such costs shall exclude payments of debt service and any other mortgage charges, brokerage commissions, real estate taxes (to the extent paid pursuant to Section 6.2 hereof), and costs of special services rendered to tenants (including Tenant) for which a separate charge is made, but shall include, without limitation:

Examples of Operating Expenses Allocable to the Premises in a sentence

  • The amount so to be paid to Landlord shall be an amount from time to time reasonably estimated by Landlord to be sufficient to cover, in the aggregate, a sum equal to the Operating Expenses Allocable to the Premises for each calendar year during the Lease Term.

  • Except as expressly provided in subsection (B) above, Tenant shall not be required to pay any rent or use and occupancy charge with respect to the Additional Land Areas (provided, however, that Tenant shall be required to pay all maintenance costs and real estate taxes associated therewith as part of Operating Expenses Allocable to the Premises under Section 2.6 above).

  • Commencing at 12:01 AM on the Service Termination Date and continuing for the balance of the Lease Term as it may be extended, Tenant shall perform or cause to be performed by contractors first reasonably approved by Landlord the Specified Services (hereinafter called "Tenant's Performance of the Specified Services") and the costs of the Specified Services shall no longer be included in Operating Expenses Allocable to the Premises.

  • Consideration shall be given to periods of coverage under the laws of either Contracting State occurring before the entry into force of this Agreement, in order to determine the right to benefits under this Agreement; except that neither State shall take into account periods of coverage occurring prior to the earliest date for which periods of coverage may be credited under its laws.

  • For the Original Premises, Tenant shall continue to pay its Operating Expenses Allocable to the Premises and Landlord’s Tax Expenses Allocable to the Original Premises without regard for such base years.


More Definitions of Operating Expenses Allocable to the Premises

Operating Expenses Allocable to the Premises means the same proportion of Landlord’s Operating Expenses (as hereinafter defined) as Rentable Floor Area of the Premises bears to the sum of the Total Rentable Floor Area of the Building and any other buildings on the Property from time to time.
Operating Expenses Allocable to the Premises means the same proportion of Landlord’s Operating Expenses (as hereinafter defined) as the Rentable Floor Area of the Premises bears to 95% of the Total Rentable Floor Area of the Building. “Base Operating Expenses” means Landlord’s Operating Expenses for calendar year 2011 (that is, the period beginning on January 1, 2011 and ending on December 31, 2011). Base Operating Expenses shall not include (x) market-wide cost increases due to extraordinary circumstances, including but not limited to, Force Majeure (as defined in Section 14.1), boycotts, strikes, conservation surcharges, embargoes or shortages which apply only to the Base Year but no other year, other than the year immediately prior to the Base Year or the year immediately following the Base Year and (y) the cost of any Permitted Capital Expenditures (as hereinafter defined). “Base Operating Expenses Allocable to the Premises” means (i) the same proportion of Base Operating Expenses as the Rentable Floor Area of the Premises bears to 95% of the Total Rentable Floor Area of the Building.
Operating Expenses Allocable to the Premises means the same proportion of the Landlord’s Operating Expenses (as hereinafter defined) as Rentable Floor Area of the Premises bears to the Total Rentable Floor Area of the Building. “Base Operating Expenses” means Landlord’s Operating Expenses for calendar year 2015 (that is the period beginning January 1, 2015 and ending December 31, 2015). Base Operating Expenses shall not include (i) market-wide cost increases due to extraordinary circumstances, including but not limited to, Force Majeure (as defined in Section 14.1), boycotts, strikes, conservation surcharges, security concerns, embargoes or shortages (any of the foregoing being referred to as an “Extraordinary Expense”) and (ii) the cost of any “Permitted Capital Expenditures” (as defined hereinbelow in this Section 7.4). However, if a particular Extraordinary Expense continues for more than twenty-four (24) consecutive months, then during each year after calendar year 2015 in which it continues (and on a pro rata basis if it continues for part, but not all, of a subsequent year), Base Operating Expenses shall include such Extraordinary Expense. By way of example only, if there is a conservation surcharge that constitutes an Extraordinary Expense, and if such surcharge continues for more than twenty-four (24) consecutive months, then for every year after calendar year 2015 in which surcharge exists, Base Operating Expenses shall be increased (on a pro rata basis for partial years after the Base Year) by amount of such surcharge in calendar year 2015. “Base Operating Expenses Allocable to the Premises” means the same proportion of Base Operating Expenses as the Rentable Floor Area of Tenant’s Premises bears to the Total Rentable Floor Area of the Building. “Landlord’s Operating Expenses” means the cost of operation of the Property, including those incurred in discharging the obligations under Sections 7.1, 7.2 and 7.3. In addition, such costs shall exclude payments of debt service and any other mortgage charges, brokerage commissions, real estate taxes (to the extent paid pursuant to Section 6.2 hereof), and costs of special services rendered to tenants (including Tenant) for which a separate charge is made, but shall include, without limitation:
Operating Expenses Allocable to the Premises means 100% of Landlord’s Operating Expenses (as hereinafter defined).
Operating Expenses Allocable to the Premises means the same proportion of Landlord’s Operating Expenses for and pertaining to the Building and the Site as the Rentable Floor Area of the Premises bears to 95% of the Total Rentable Floor Area of the Building unless more than 95% of the Total Rentable Floor Area of the Building is actually occupied by tenants during a portion of calendar year 2016 in which event (the “Occupancy Percent Adjustment”) the foregoing “95%” in the foregoing computation shall be replaced by such higher actual occupancy percentage (pro rated for any portion of calendar year 2016) that such occupancy exceeds 95% if during any other portion of 2016 such occupancy is less than or equal to 95%).
Operating Expenses Allocable to the Premises with respect to each Portion of the Premises (exclusive of the Basement Storage Premises and Basement Put Premises) means the same proportion of the Operating Expenses for the Building (as hereinafter defined) as Rentable Floor Area of such Portion of the Premises (exclusive of the Basement Storage Premises and Basement Put Premises) bears to the Rentable Floor Area of the Building.
Operating Expenses Allocable to the Premises means (a) the same proportion of Landlord’s Operating Expenses for and pertaining to the Building as the Rentable Floor Area of Tenant’s Space bears to the Total Rentable Floor Area of the Building (which proportion as of the Commencement Date is 100%) plus (b) the same proportion of Landlord’s Operating Expenses for and pertaining to the Site as the Rentable Floor Area of Tenant’s Space bears to the Total Rentable Floor Area of the Buildings (which proportion as of the Commencement Date is 64.24%).
