Operations Term definition

Operations Term means the period beginning on the first day immediately following the end of the Initial Term and ending on July 31, 2027, unless earlier terminated in accordance with this Lease, and subject to extension for the Renewal Term in accordance with Section 3(b). The first month of the Operations Term shall commence on the Initial Delivery Date or Buyer Completion Date (as applicable) and end on the last day of the first full calendar month thereafter (i.e., the calendar month in which the Initial Delivery Date or Buyer Completion Date, as applicable, occurs if the Initial Delivery Date or Buyer Completion Date, as applicable, is the first day of a calendar month, but otherwise the period between the Initial Delivery Date or the Buyer Completion Date, as applicable, and the last day of the first full calendar month following the calendar month in which the Initial Delivery Date or the Buyer Completion Date, as applicable, occurs).
Operations Term shall have the meaning set forth in Exhibit B, Section B-2(c). “Party” and “Parties” shall have the meaning set forth in the preamble.

Examples of Operations Term in a sentence

  • Lessee shall have the unilateral right to terminate this Lease at any time during the Operations Term without penalty, subject to the removal obligations in Exhibit B, Section B-6(g), upon written notice to Lessor; provided, however, that in the event of such termination, the Lessor is entitled to retain all payments made by Lessee prior to the date of such termination.

  • Lessor shall have the right to graze livestock on the Leased Premises during the Development Term; provided, however, that during the Construction Term and Operations Term, Xxxxxx’s right to graze livestock on the Leased Premises shall be subject to the prior written consent of Lessee in Xxxxxx’s sole discretion.

  • The Decommissioning Term shall commence on the termination or expiration of the Operations Term, and any extensions thereto, or any other termination or expiration of this Lease, and shall continue for a period of ninety (90) days whereupon this Lease shall expire and shall be of no further force or and effect, except that such termination shall not release or modify any of the obligations of the Parties arising prior to such termination.

  • The Operations Term shall be for an initial period of twenty-five (25) years from the date such Solar Facility begins commercial operation (the “Commercial Operations Date”).

  • The Operations Term shall commence on the date specified in a written notice to Lessor that Lessee elects to initiate the Operations Term as of a date so specified in such notice, or the date the Lessee determines the Solar Facility is capable of commercial operations, whichever shall occur earlier.

  • Lessee shall have the unilateral right to extend the Operations Term for two (2) additional five (5) year periods on the same terms herein upon written notice to the Lessor.

  • The Construction Term shall expire on the earlier of the commencement of the Operations Term or termination of Lease.


More Definitions of Operations Term

Operations Term means the period commencing on the Substantial Completion Date to and including the date that is the earlier of 10 years after the Scheduled Substantial Completion Date and the Termination Date, unless such term is otherwise extended in accordance with Section 27.2 of the Project Agreement.
Operations Term means the period commencing on the Substantial Completion Date to and including the date that is the earlier of 10 years after the Substantial Completion Date and the Termination Date, unless such term is otherwise extended in accordance with the terms of the Project Agreement.

Operations Term will commence on the day specified by Tenant in a written notice to Landlord (“Operations Notice”) that the Hydrogen Project will commence operations, as measured by the date the Hydrogen Project’s hydrogen production equipment is officially commissioned to begin the production of hydrogen and the Hydrogen Project has been operating fully for ten (10) continuous days at a minimum of eighty percent (80%) of its nameplate capacity) (the “Operations Date”) and will continue until the date that is twenty seven (27) years from the Operations Date. Tenant will have the right to conditionally extend the Operations Term, as set forth in Section 2.1 and Table 1, for six (6) separate and successive terms of five (5) years (each, an “Operations Term Extension”) which shall expire at the end of such applicable Operations Term Extension, unless further extended. At any time during the Operations Term with written notice to the Landlord, the Tenant reserves the right to terminate this Lease in accordance with Section 16.1. In accordance with Section 3.3, Tenant shall pay to Landlord one or more non-refundable rent payments, (the “Operations Rent”) associated with use of the Leased Premises during the Operations Term and any Operations Term Extension. During the Operations Term, the Tenant shall have exclusive possession of the Leased Premises, the right to do all things necessary to operate the Hydrogen Project on the Leased Premises and to exercise its other rights under this Lease.

Related to Operations Term

  • Operation Period means the period commencing from COD and ending on the Transfer Date;

  • Project Term the period from the Operation Commencement Date to the Expiry Date or the Termination Date, whichever occurs first, which is further described in Clause 3;

  • Motor Sport Activities means any motor sport activities or Recreational Services which are permitted or approved which CAMS regulates or administers by CAMS or otherwise under the responsibility / control of CAMS;

  • Operational Period means the period starting with the date and time a Certificate is issued (or on a later date and time certain if stated in the Certificate) and ending with the date and time on which the Certificate expires or is earlier revoked.

  • Commercial Operations Date or "COD": The date on which Facility first achieves Commercial Operations.

  • Operating Period for any Element of the Project shall mean the period from (and including) the COD of such Element of the Project, up to (and including) the Expiry Date and for the Project, shall mean the period from (and including) the COD of the Project, up to (and including) the Expiry Date;

  • Exploration Period means the period mentioned in Article 3 during which Exploration Operations may be carried out by the Contractor as provided in Article 3 hereof.

  • Services Commencement Date means the date delivery of the Services shall commence as specified in the Key Provisions. If no date is specified in the Key Provisions this date shall be the Commencement Date;

  • Commercial Operation Date means the date on which a Material Project is substantially complete and commercially operable.

  • Implementation Period means the period from the date of signing of the Agreement and up to the issuance of Final Acceptance Certificate for the project.

  • Permitted Activities The primary activities of the trust created pursuant to this Agreement which shall be:

  • Development Term means the period commencing on the Closing Date and ending on the earlier of (a) the Option Closing Date or (b) the date the Option terminates or expires other than by exercise.

  • Maintenance Term means the period of time for which Customer has purchased Maintenance Services, as evidenced by the Purchase Order delivered by Customer in connection therewith, together with all renewals effected in accordance with Section 4 of this Agreement.

  • Construction Period means the period commencing from the Appointed Date and ending on the date of the Completion Certificate;

  • Scheduled Commercial Operation Date shall have the meaning ascribed to it in Clause 5.4.1;

  • Development Period means the period from the date of this Agreement until the Appointed Date;

  • Service & Term XOOM Energy Ohio, LLC (“XOOM” or “Company”) agrees to act as your exclusive natural gas supplier and will provide competitive retail natural gas service to you. The Term of this Agreement will begin on the next available meter read date after processing of the request by XOOM and your gas utility, and will continue for the Contract Term as set forth in the accompanying Contract Summary, which is incorporated into this Agreement. Acceptance into the Program:These terms and conditions are subject to your acceptance into the program by both XOOM and your local utility. You will be promptly notified if you are not accepted into the program. Switching fees may apply to you under your local utility’s tariff if you are accepted into the program by both XOOM and your local utility.

  • Operations Plan means the document by which PURCHASER notifies STATE of the plans and schedule for completing the operations described in the contract. It also contains the names of the subcontractors, PURCHASER's Authorized Representatives, and STATE's Authorized Representatives. Permit means any permit required by a federal, state, or local government agency before operations under this contract may lawfully begin or continue. Permit includes an incidental take permit under the federal Endangered Species Act.

  • Lease Period means each of the consecutive periods throughout the Basic Term and any Renewal Term ending on a Lease Period Date, the first such period commencing on and including the Delivery Date.

  • Active business operations means all business operations that are not inactive business operations.

  • Contract Term means period of performance set forth in the paragraph entitled “Term” contained in Exhibit E.
