Phase 2 Services definition

Phase 2 Services means the Relocation Services required from the Consultant pursuant to Section D of the Scope of Services.

Phase 2 Services means the services to be provided under Section 2.2.2 of this Agreement.

Examples of Phase 2 Services in a sentence

• Design Builder shall commence the Phase 2 Services portion of the Work within five (5) calendar days after the Phase 2 Commencement Date.

• No portion of the Work, with respect to the Phase 2 Services to be provided hereunder shall be performed prior to the Phase 2 Commencement Date, unless expressly approved in advance by Owner in writing.

• The Work shall commence within five (5) days of Design-Builder’s receipt of Owner’s Notice to Proceed for Phase 2 Services (“Date of Commencement”) if the Proposal is accepted and the Contract Price Amendment is amended to this Agreement unless the parties mutually agree otherwise in writing.

• With respect to Phase 2 Services to be provided by Design Builder hereunder, Owner shall pay Design Builder the fixed lump sum amount (“Lump Sum Price”) to be established in the Lump Sum Contract Price Amendment to the Agreement (the “Lump Sum Amendment”).

• Award of the contract for Phase 1 services does not guarantee that the chosen firm will continue through Phase 2.• Exercise of Phase 2 Services will be at the sole discretion of the University and will be assigned using an Executive Design Professional Agreement (EDPA) if it is determined that the project delivery will be Lump-Sum or CM at Risk.

• As part of the Phase 1 Services, Contractor shall participate in GMP Negotiations for the Phase 2 Services.

• Phase 2 Services Schedule commences upon 1) the execution of the Final Agreement for Phase 2 Services by both parties, and 2) the receipt of a Notice-to-Proceed (NTP) from the Owner.

• Design-Builder acknowledges that this Agreement is to be administered on an “open book” arrangement relative to Costs of the Work, including the development and agreement upon the Contract Price for Phase 2 Services; provided that if Owner and Design-Builder convert to or agree to a lump sum form of compensation for the Phase 2 Contract Price (“Fixed Contract Price”), then the provisions of this Section 7.6 shall not apply to such Fixed Contract Price and any adjustments made on a lump sum basis.

• The Consultant may invoice the Authority only for actual time spent providing Phase 2 Services at the Loaded Hourly Rates and for those limited costs and expenses expressly set forth in Section 3 of the Agreement.

• D.2 Phase 2 Issuance of Notice to Proceed Once an Expected Hours Proposal has been approved by the Authority, the Authority shall, in its sole judgment and discretion, determine the date for its issuance of an NTP with the Project Assignment for Phase 2 Services.

Phase 2 Services are described and designated in Exhibit 3.1 as Phase 2 Services. Client may elect to commence Phase 2 Services during the Term by providing R1 with at least [***] written notice prior to the date on which Client seeks Phase 2 Services to begin (the “Phase 2 Commencement Date”); provided, however, that: (a) the Phase 2 Commencement Date must be between, and inclusive of, [***]; and (b) once designated by Client, any delay or other modification of the Phase 2 Commencement Date shall be subject to mutual agreement of the Parties. The Phase 2 Services will be considered part of the Services for the purposes of this Services Agreement beginning on the Phase 2 Commencement Date, subject to amendment of the Services Agreement pursuant to Section 23.11 to add and modify terms and conditions relevant to the performance and receipt of the Phase 2 Services. For clarity, until the Phase 2 Commencement Date (if any), the term “Services” shall be deemed to exclude any Phase 2 Services.

Phase 2 Services means the services described in Part II of Appendix [Q];

Phase 2 Services means front end services for office-based Service Recipients, as further described in Exhibit 3.1.

Phase 2 Services means the Standard Services to be carried out on the Phase 2 Trains by the Maintainer. Maintenance Services and shall include the Additional Services to the extent that the Owner notifies the Maintainer at any time pursuant to Part 2 of Exhibit 1 (Train Maintenance Specification) that it wishes the Maintainer to carry out any such Additional Services;
