Substantial Completion or Substantially Complete definition

Substantial Completion or Substantially Complete means complete construction, except for minor and ancillary alterations or additional work, so as to be available for the issuance of a certificate of occupancy pursuant to codes of the Town.
Substantial Completion or Substantially Complete means the stage in the progress of the Work when the Work or designated portion thereof is sufficiently complete in accordance with the Contract Documents so that the City can occupy or utilize the Work for its intended use and a temporary certificate of occupancy and any other permits and orders necessary for occupancy have been issued by the proper governmental authority. Warranties called for by this Agreement or by the Contract Documents shall commence on the Substantial Completion date.
Substantial Completion or Substantially Complete means Phase 1 or Phase 2, as the case may be, of the Project can be occupied for its intended use.

Substantial Completion or Substantially Complete means the stage in the progress of the Work when the Work or designated portion thereof is sufficiently complete in accordance with the Contract Documents so that the City can occupy or utilize the Work for its intended use and a temporary certificate of occupancy and any other permits and orders necessary for occupancy have been issued by the proper governmental authority, provided that if issuance of a temporary certificate of occupancy, permits, or orders is withheld or delayed through no fault of Construction Manager, the Work shall be deemed Substantially Complete if the remaining requirements for Substantial Completion are satisfied. Warranties called for by this Agreement or by the Contract Documents shall commence on the Substantial Completion date.

Substantial Completion or Substantially Complete means complete renovation of the shell and core, with finished interiors of common areas to the point of qualification for the issuance of certificates of occupancy pursuant to codes of the City, except for minor and ancillary alterations or additional work (including, without limitation, typical punch list items), and shall include complete construction of the shell and core with respect to any new structures erected by Developer as part of the Project, it being understood that, notwithstanding anything to the contrary in this Agreement, Developer’s initial plan for the Project is limited to the improvement and renovation of structures existing in the Development Area as of the date of this Agreement.
Substantial Completion or Substantially Complete means the date on which the Work, or an agreed upon portion of the Work, is sufciently complete in accordance with the Contract Documents so that Owner can occupy and use the Project or a portion thereof for its intended purposes, provided, however, that the Performance Testing requirements identifed in section 5.14.2 of the DEP have been successfully completed.

Substantial Completion or Substantially Complete means when the construction of the Building has been substantially performed, as such term is defined in the Construction Lien Act, R.S.O. 1990, C. 30, as amended, and required approvals have been obtained from all Authorities to permit occupancy by the Tenant of the Leased Premises.
