Trial Software definition

Trial Software means Software that has been licensed to Customer solely for the purposes of evaluation or that is supplied for the purposes of training, beta testing, or other non-commercial use.
Trial Software means any Server Software downloaded or otherwise received from Pervasive for a limited time period for the purposes set forth in Section 2.3 below.
Trial Software is Server Software that is licensed to You for the purpose of internal evaluation and testing of the Server Software only. You may not distribute or deploy such Trial Software outside Your testing environment. In no event shall You use the Trial Software for development, production or commercial purposes.

Examples of Trial Software in a sentence

  • In no event shall You use the Trial Software for development, production or commercial purposes.

  • The term of this Agreement with respect to Trial Software is governed by the key delivered with the Trial Software at the time of download.

  • You may not distribute or deploy such Trial Software outside Your testing environment.

  • However, in no event will the term of the license for Trial Software be more than thirty (30) days from the date of installation without express written approval from Pervasive.

  • Trial Software is licensed for the purpose of evaluation, testing and benchmark runs of the Software only.

  • However, in no event will the term of the license for Trial Software be more than thirty (30) days from the date of installation without express written approval from Actian.

  • All such Pre- Production Releases and Trial Software are provided strictly on an “as-is” basis and for internal, non- commercial purposes and AVEVA disclaims all warranties, express or implied, for all Pre-Production Releases and Trial Software (including the warranty set forth in Section 12.1 or Section 12.2 above).

  • If the Trial Software provided to You under this Agreement is designated as pre-release or beta software by Actian (“Pre-Release Software”), then You acknowledge that such Pre-Release Software may contain faults.


More Definitions of Trial Software

Trial Software means any Server Software downloaded or otherwise received from Actian for thirty (30) days from the date of delivery (or such longer period if agreed by the parties in an Order or other writing signed by the parties) for the purposes set forth in Section 2.4 below.

Notwithstanding Section 8 below, the Trial Software is provided to You on an AS IS basis, and Actian hereby disclaims all warranties and conditions, whether express, implied or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. The Trial Software may be designated by Actian as pre-release or beta software, may contain faults, and Actian is under no obligation to make pre-release or beta software commercially available at any time.

Trial Software means any Software available for download by Licensee without requiring Licensee to execute and deliver an Order Schedule either to Turbonomic or to a third party, it being understood that upon Licensee’s execution and delivery of an Order Schedule, any Trial Software licensed hereunder shall immediately and with no action on the part of Turbonomic or Licensee cease being Trial Software hereunder and shall instead be considered Software for all purposes and subject to the terms hereof.

Related to Trial Software

  • Commercial Software means Software developed or regularly used that: (i) has been sold, leased, or licensed to the general public; (ii) has been offered for sale, lease, or license to the general public; (iii) has not been offered, sold, leased, or licensed to the public but will be available for commercial sale, lease, or license in time to satisfy the delivery requirements of this Contract; or (iv) satisfies a criterion expressed in (i), (ii), or (iii) above and would require only minor modifications to meet the requirements of this Contract.

  • Licensed Software includes error corrections, upgrades, enhancements or new releases, and any deliverables due under a maintenance or service contract (e.g., patches, fixes, PTFs, programs, code or data conversion, or custom programming).

  • Third Party Software means software which is proprietary to any third party (other than an Affiliate of the Contractor) which is or will be used by the Contractor for the purposes of providing the Services.

  • Oracle Software means any software agent, application or tool that Oracle makes available to You for download specifically for purposes of facilitating Your access to, operation of, and/or use with, the Services.

  • Open Source Software means software or similar subject matter that is distributed under an open source license such as (by way of example only) the GNU General Public License, GNU Lesser General Public License, Apache License, Mozilla Public License, BSD License, MIT License, Common Public License, any derivative of any of the foregoing licenses, or any other license approved as an open source license by the Open Source Initiative or as a free software license by the Free Software Foundation.

  • Tyler Software means our proprietary software, including any integrations, custom modifications, and/or other related interfaces identified in the Investment Summary and licensed by us to you through this Agreement. • “we”, “us”, “our” and similar terms mean Xxxxx. • “you” and similar terms mean Client.

  • Software Products and “Software” are interchangeable and mean software, computer source codes and other computer programs.

  • Software Error means a reproducible defect or combination thereof in the Software that results in a failure of the Software when used in accordance with the Documentation. Software Errors do not include those errors caused by (a) Licensee’s negligence, (b) any unauthorized modification or alteration Licensee makes to the Software, (c) data that does not conform to Licensor’s specified data format, (d) operator error, or (e) use not conforming to the Licensor’s supported technical environment specified in the Documentation.

  • Embedded Software means one or more software applications which permanently reside on a computing device.

  • Contractor Software means software which is proprietary to the Contractor, including software which is or will be used by the Contractor for the purposes of providing the Services.
