Export Control. You may not use, export, re-export, import, sell or transfer the Service or Apple Software, or any part thereof, except as authorized by United States law, the laws of the jurisdiction in which You obtained the Service or Apple Software, and/or any other applicable laws and regulations. In particular, but without limitation, the Service and the Apple Software may not be exported or re- exported (a) into any U.S. embargoed countries or (b) to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Department of Commerce’s Denied Persons List or Entity List or any other restricted party lists. By using the Service or Apple Software, You represent and warrant that You are not located in any such country or on any such list. You also agree that You will not use the Service or Apple Software for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture or production of nuclear, missile, chemical or biological weapons.
Export Control. When authorizations or formalities are required, especially concerning imports and export controls, for importing into the destination country or for the payment of the Products sold, obtaining these authorizations or accomplishing these formalities in a timely manner is the entire responsibility of the Customer. Each party represents and warrants to the other party that it shall perform its obligations under the Agreement, and the activities contemplated hereunder, including any use or distribution of the Products, in compliance with Applicable Law, the Products’ labeling, inserts, and manuals, and other Product- related information and materials published by Cepheid or any regulatory authority. Customer shall indemnify and hold Cepheid from and against all losses, liabilities, and expenses (including reasonable attorneys’ fees and costs) to the extent arising from any breach of the foregoing.
Export Control. When applicable The Supplier shall comply with Mexican, United States and European trade controls and sanctions laws and regulations, as well as the trade controls and sanctions of any other jurisdictions in which the Supplier operates.
