45A. All Governors shall upon their appointment or election give a written undertaking to the Trustees to uphold the Object of the Academy Trust.

45A. The Minister may make regulations —
45A. 1 The University recognises that both female and male staff members sometimes experience situations of violence or abuse in their personal life constituting family violence that may affect their attendance or performance at work. The University accepts the definition of family violence as provided by the Family Violence Protection Act 2008 (Vic) and recognises that it includes physical, sexual, financial, verbal or emotional abuse by a family/household member.
45A. 3 For the purposes of endorsing the approval of a request for support from a staff member experiencing family violence, the Executive Director, Monash HR (or his/her nominated delegate) may require the provision of relevant documentary evidence satisfactory to the University of family violence. This may include a document issued by police, a court, a medical practitioner, a district or maternal and child health care nurse, a family violence support service, or a lawyer or a statutory declaration of the staff member.
45A. On 3 October 1996 the Commission filed proceedings in the Federal Court Darwin against four Northern Territory car rental companies and three individuals, alleging that they were involved in price fixing conduct. The Commission alleges that in 1994 and 1995 four car rental companies in Xxxxx Springs made an arrangement, or reached an understanding, to stop offering ‘Ayers Rock specials’. The Commission alleges that ‘Ayers Rock specials’ were discount rates of hire for travel from Xxxxx Springs to places including Ayers Rock. The Commission regards the alleged offences very seriously as they involve allegations of price fixing in the tourism industry, which is one of the most important industries for the Northern Territory (and Australian) economies. Proceedings have been instituted against:
45A. Real Property" shall mean all now owned and hereafter acquired real property of each Borrower, including leasehold interests, together with all buildings, structures, and other improvements located thereon and all licenses, easements and appurtenances relating thereto, wherever located, including the real property and related assets more particularly described on Schedule 1.45A hereto (but specifically excluding fixtures bearing or identified by the Calvxx Xxxix Intellectual Property).
45A. Not less than 60 days prior to the deadline for filing a tax appeal, Tenant shall notify Landlord that it intends to file a tax appeal. Within 30 days after receipt of such notice Landlord shall have the right to notify Tenant that it will file the tax appeal, but only if Landlord intends to file a tax appeal regarding 200 Xxxxxx Drive and/or the 200 Xxxx Xxxx Xxxx buildings in Tri-Park Corporate Park. By giving such notice, Landlord shall be obligated to file the tax appeal for the Demised Premises and 200 Xxxxxx Xxxxx and/or 200 Xxxx Xxxx Xxxx. Such appeal and the prosecution thereof shall be at Landlord's initial cost and expense; provided however, that if the appeal serves to reduce the real estate taxes on the Demised Premises, then Tenant shall, at the conclusion of the matter, reimburse Landlord for its prorata share (either one half or one third - depending upon the number of properties appealed) of alt costs and expenses incurred by Landlord in the prosecution of the appeal, including filing fees, court costs, legal fees and the cost of appraisals and expert witnesses but in no event shall such reimbursement exceed the savings realized by Tenant. In the event the appeal results in an increase in real estate taxes respecting the Demised Premises, then Tenant shall be obligated to pay such increase. Upon request, Landlord agrees to notify Tenant as to the status of the tax appeal. Notwithstanding the foregoing, in no event shall Tenant be permitted to file a tax appeal respecting the last 12 months of the term of this Lease, nor shall Tenant be permitted to enter into any settlement regarding a tax appeal which will affect the real estate taxes beyond the Expiration Date of this Lease.
