Design services shall be conducted in phases as outlined herein. Phases may be combined to expedite design process when defined in Exhibit CProduction Schedule. Individual phases or groups of phases shall be authorized herein or by fully executed Supplemental Agreement.

Furthermore, A/E’s duties as set forth herein shall at no time be in any way diminished by reason of any approval by County nor shall A/E be released from any liability by reason of such approval by County, it being understood that County at all times is ultimately relying upon A/E’s skill and knowledge in performing the services required hereunder.

A/E’s REPRESENTATIONS. The A/E’s issuance of a Certificate for Payment shall constitute a representation to the Owner that to the best of the A/E’s knowledge, information and belief, based upon the A/E’s observations at the site, the data comprising the Application for Payment, and what is reasonably inferable from the observations and data, that the Work has progressed to the point indicated in the Application and that the quality of the work is in accordance with the Contract Documents. The foregoing representations are subject to minor deviations from the Contract Documents correctable prior to completion and to specific qualifications expressed by the A/E. The issuance of a Certificate for Payment will further constitute a representation that the Contractor is entitled to payment in the amount certified. However, the issuance of a Certificate for Payment shall not be a representation that the A/E has (a) made exhaustive or continuous on- site inspections to check the quality or quantity of the Work, (b) reviewed construction means, methods, techniques, sequences or procedures,
