Abuse of Authority. The term ‘‘abuse of authority’’ means an arbitrary and capricious exercise of authority by a contracting official or employee that adversely affects the rights of any person, or that results in personal gain or advantage to the official or employee or to preferred other persons.

Abuse of Authority. Exists when an individual uses his/her expressed or implied authority or position to undermine, sabotage or otherwise interfere with the career of another employee or the provision of goods and services to clients. This definition includes such blatant acts of misuse of power as intimidation, threats, blackmail and coercion and applies to the distribution of work assignments or training opportunities, promotional opportunities, performance evaluations or the provision of references. Abuse of authority also includes favouritism of one employee to the disadvantage of another.
Abuse of Authority. “Abuse of authority” is a kind of harassment wherein an instructor or pilot employed or retained by BFC misuses the power inherent in their position to unfairly endanger the position or status of an Associate or Member of BFC, undermines them, threatens them, or in any way improperly interferes with their participation in a BFC-related activity. It should not be confused with the legitimate instruction and training duties, regardless of whether the individual disagrees with the said action or finds such action(s) to have been unreasonable or inappropriate. It is more than a critical comment regarding a student or trainee’sperformance.
Abuse of Authority. The Employer, the employees, and the Union recognize that all persons employed by the Employer stand to benefit from working in an environment free from abuse of authority. (a) For the purpose of this Article and Article 12 [Complaint Procedure], abuse of authority means improperly using a position of authority to endanger another person’s job, undermine their job performance, or negatively interfere with their career. It includes humiliation, intimidation, threats and coercion. Conduct involving the exercise of responsibilities or authority related to the provision of advice, the assignment of work, coaching, performance evaluation, appropriate disciplinary and other supervisory or leadership functions does not constitute abuse of authority.

Abuse of Authority. GSEs shall have the right to work in an environment free from abuse of authority. The University, and its academic units, provide for grievance mechanisms for graduate students to report and seek redress for abuse of authority. GSEs covered by this Agreement maintain the rights and obligations set forth in the University Grievance Policy for Graduate Students, and any local unit grievance policies, as may be amended from time to time. A GSE may choose to grieve a complaint of abuse of authority related to their employment through the University’s existing process set forth above. If the GSE pursues the complaint through the University process, any decision will be final and binding. In the alternative, a GSE may grieve a complaint of abuse of authority related to their employment through the process set forth in Article 9, Grievance and Arbitration.

  • Scope of Authority Committee meetings will be used for communications between the parties, to share information and to address concerns.
