Accident and Incident Investigation. When a Pilot is involved in an accident or incident related to the operation of an aircraft while on duty, he may be held out of service pending the outcome of any investigation into the accident or incident undertaken by the Company, Transport Canada or the Canadian Transportation Accident Investigation and Safety Board. When held out of service, the Pilot and ACPA will be so notified in writing within 7 days along with the reasons. When the investigation is undertaken by the Company, the officers involved will make every attempt to issue a final report within 3 months. Both the Pilot involved and ACPA will be given the opportunity to participate fully in the investigation, will be informed on a regular basis on the course of such investigation and will be provided with a copy of any interim or final reports. A Pilot held out of service pending the outcome of an investigation will be paid and will receive Block Credits for the flights in his Block as if flown according to schedule. A Pilot not holding a Block will be paid and will receive Block Credits at the rate of 2h40 per day DN. When disciplinary or discharge action is considered following the issuance of an accident investigation report, satisfactory to the Company, the provisions of A7 will be applied from such date of issue. Prior to any form of investigation or interrogation by the Company following an accident or incident, the Pilots will make themselves available and will be afforded a medical examination and the results will be made available to the Company and Pilots. In cases involving aircraft accidents, Pilots will not be required to commit themselves orally or in writing to officials of the Company for a period of 24 hours following the accident unless they have the opportunity to be represented by ACPA. Throughout this procedure the Pilot involved and/or his designated ACPA representative(s) may, upon request, review any information contained in his files in conjunction with a designated representative of the Company.

Accident and Incident Investigation. Every injury or near-miss which involved or would have involved a worker going to a first aid attendant, doctor or hospital must be investigated by the Employer in accordance with the collective agreement, the OH&S Act and its regulations, and the Workers' Compensation Act.
Accident and Incident Investigation. Worker members of the local JHSC shall be trained in the company’s Accident/Incident Investigation Process. A worker representative from the local JHSC will participate in Accident/Incident Investigations in which a worker is killed, critically injured or where there was a reasonable potential for serious harm to a worker.
Accident and Incident Investigation. 76.1 In the event of any incident or accident, VARA may suspend a Pilot with full pay at the appropriate classification rate pending investigation of the incident or accident in accordance with clause 77 – Not Available for Operational Duties. Any such investigation shall be conducted as expeditiously as possible and the suspension period should not exceed 42 days where possible.
76.2 The conduct of an investigation is a fact-finding exercise. Depending on the circumstances, this may or may not be followed by the making of allegations against a Pilot and a disciplinary process.
76.3 Where a Pilot is subsequently cleared of all allegations, they will receive pay in accordance with their original roster and any RDOs lost (i.e. because they were required to attend a meeting in a disciplinary process on a RDO) will be re-credited in the current or next roster period.
76.4 At all stages in the process, the investigator and any relevant decision maker must adhere to the following principles:
(a) The Pilot will be kept informed of the progress of the investigation process;
(b) At any stage in the process, a Pilot can require that they be given two (2) business days’ notice of any meeting, including the reason for the meeting, to give them an opportunity to arrange representation, take advice and otherwise prepare.
(c) The Pilot is entitled to know the substance of any allegations of complaint made against them. For this purpose, the Pilot will be provided with at least a summary of the allegations at or before any meeting with VARA to discuss those allegations.
(d) The Pilot must be provided with an adequate opportunity to respond to any allegations put to them and VARA must consider the Pilot’s response. This will include allowing the Pilot to respond to allegations in writing after a meeting in which those allegations have been provided to the Pilot.
(e) Disciplinary investigations should be conducted as confidentially and promptly as is practicable and having regarding to the general principles of procedural fairness.
(f) Throughout any such investigation process, any person or organisation of the Pilot’s choice may represent the Pilot. Where appropriate, that person or organisation may be involved in the investigation process and submit a report on the investigation that will be considered by VARA in its deliberations.
Accident and Incident Investigation. Any accident or incident involving Contractor, Pueblo Transit, or any third party shall be immediately recorded and investigated by Contractor. Pueblo Transit shall be informed by telephone immediately following the occurrence of any accident or incident, and furnished with a written report within twenty-four (24) hours after the occurrence, regardless of fault. Accidents shall be recorded on a standard form and accompanied by police reports. Incidents involving passengers' behavior, threats and disputes shall be documented and reported to Pueblo Transit in narrative format. Contractor shall submit written documentation of its accident and incident handling procedures to Pueblo Transit at least five (5) days prior to the initiation of service delivery. Failure to comply with any of the above submittal and reporting requirements may obligate Pueblo Transit to enforce stated Performance Standards and Liquidated Damages.

21.2 Throughout any such investigation process, any person or Organisation of their choice may represent a pilot. Where appropriate, that person or Organisation may be involved in the investigation process and submit a report on the investigation that will be considered by The company in its deliberations.
21.3 The pilot shall have recourse to the dispute settlement procedure as detailed in clause 9.
Accident and Incident Investigation. The Contractor is responsible for the investigation of all accidents/incidents where employees and non- employees were injured to the extent that he/she/they had to be referred for medical treatment by a doctor, hospital or clinic and the results of the investigation shall be entered into the Accident/Incident Register. The Contractor is responsible for the investigation of all minor, non-injury incidents and near misses. The City of Cape Town, reserves the right to hold its own investigation into an incident or call for an independent external investigation.
