Advertising and Marketing Materials. Unless You have Our prior written consent in each instance, You acknowledge and agree that You and Your solicitors may not use any advertisement or marketing materials that contain the name, logo or service marks of the Trust or the Society or any variation of the aforementioned. You agree that You and Your solicitors may not state or imply that You or they are the Trust or the Society. You agree to comply with all Our rules and guidelines regarding advertising and written materials. You acknowledge that Our printed materials – as well as any other tangible forms of Our advertising and marketing materials – belong to Us, and You agree to return them to Us immediately upon demand.
Advertising and Marketing Materials. During the term of this Agreement, the Contractor shall not use “Chicago Housing Authority”, “CHA”, or any other language that references the Chicago Housing Authority in any advertising or marketing materials without prior written approval from CHA, which approval shall not be unreasonably withheld. Such approval will be deemed granted if CHA does not respond to a submission within 5 business days from receipt of such submission. This paragraph is not intended to include bids or proposals submitted by Contractor in response to Requests for Proposals issued by other housing authorities or other governmental agencies or entities.
Advertising and Marketing Materials. Servicer acknowledges and agrees that Fund Agent, each Fund, and any party controlling, controlled by or under common control with Fund Agent or the Funds shall not be responsible for (i) any information contained in any advertising or marketing materials prepared by Servicer, except for information provided in writing by Fund Agent and/or the Funds specifically for that purpose; or (ii) the compliance or failure to comply by Servicer or its agents with any applicable federal or state law or any rule or regulation of any administrative or self-regulatory organization with jurisdiction over Servicer or any such agent, except to the extent that Servicer’s or such agent’s failure to comply with any such law, rule or regulation is caused by Fund Agent, or the Funds’ failure to comply with any applicable law, rule or regulation or its breach of this Agreement.
Advertising and Marketing Materials. We will provide You with reasonable amounts of initial opening advertising and marketing materials which may include, but are not limited to, video and audiotapes, multimedia, print-ready advertising materials, posters, banners, and other items. You may purchase from Us additional copies of advertising and marketing materials at reasonable cost. You may develop and produce additional advertising and marketing materials, at Your own expense, but any advertising and marketing materials must be approved in writing by Us in advance of Your use of such materials. We will approve or disapprove of materials submitted by You within fifteen (15) days of receipt. We also reserve the option of utilizing and providing to other franchisees, without payment to You other than awards and suitable recognition, advertising and marketing materials developed by You upon advance notice to You.
Advertising and Marketing Materials. NMPR will provide Distributor, at no charge to Distributor, samples of sales and marketing literature that NMPR has developed in connection with its marketing of the Products, such as catalogs, brochures, flyers, advertisements and other sales literature or video presentations concerning the qualities, properties, advantages and uses of the Products. If available, samples of this literature will be made available in English, French and/or Spanish. Distributor will be free to use any or all of the content of this literature in developing and producing its own sales and marketing literature to be used in conjunction with the sale of the Products by Distributor. Distributor will be responsible for all expenses associated with the creation and reproduction of its sales and marketing literature and all labeling associated with Distributor's "brand name" for NMPR's products. Distributor agrees to submit copies of all proposed MSDS sheets, sales and marketing materials to NMPR's compliance department prior to use in the marketplace.

All advertising and marketing material used or proposed to be used in connection with the business of the ESGL Group complies with all legal and regulatory requirements in all material respects in all countries in which such material is used or proposed to be used. There are no grounds under which such material could be challenged or give rise to any complaint or liability for any reason whatsoever including, without limitation, defamation, trade libel, copyright, moral rights or any analogous law.
Advertising and Marketing Materials. Intelius shall have the exclusive right to sell advertising on the Co-Branded White Pages; provided, however, that YPC shall have the right to review and approve all advertising and marketing materials used on the Co-Branded White Pages, and any marketing materials related to post-transaction offers on the Intelius Web Sites made to users originating from the Co-Branded White Pages, which approval shall not be unreasonably withheld. For purposes of this Agreement, advertisements shall include Banner Advertisements, anchor tenancies, sponsorships, e-commerce promotion, and all other types of advertisements and other revenue generating partnerships or relationships with third parties directly on the Co-Branded White Pages at any time, as more particularly described on Exhibit F (the “Advertising Guidelines”). YPC may amend or modify the Advertising Guidelines at any time in writing in its sole discretion. Nothing in this Agreement shall restrict YPC’s right to (1) display links to any Web Site owned and/or operated by YPC (or portions thereof), including the YPC Web Sites, or (2) display branding elements of YPC or its Affiliates that are incorporated into the Graphical User Interface. Intelius shall update the Graphical User Interface of the Co-Branded White Pages at any time in connection with this Section 4.8 within thirty (30) days of receipt of written notice from YPC.

Biocompatibles shall submit for approval by IsoRay all promotional literature, ad copy, and marketing collateral items to be used by Biocompatibles with respect to the promotion of Products, including all such items that use any of the Trademarks for the Products, and shall obtain IsoRay’s approval prior to dissemination or use of such items. IsoRay shall approve or disapprove, in writing, all items submitted pursuant to the preceding sentence within fifteen (15) days after receipt, and shall not unreasonably withhold said approval. Biocompatibles shall provide IsoRay with at least three (3) copies of all approved materials concurrent with their deployment by Biocompatibles.
