Agreement and Definitions. This Agreement is entered into by and between the Board of Trustees of Community College District No. 512, Counties of Cook, Lake, Xxxx and XxXxxxx and the State of Illinois, hereinafter referred to as the “Board,” or the "College" and Xxxxxx College Adjunct Faculty Association, IEA-NEA, hereinafter referred to as “HCAFA,” as the exclusive collective bargaining representative for the bargaining unit employees defined as follows: Unit eligible “Adjunct Faculty” who are part-time instructional employees. Unit eligible “Adjunct Faculty Librarians and Counselors” hereinafter referred to as “Adjunct Librarians/Counselors.” This group includes the following classifications: Student Development Counselors, Athletic Academic Counselors, Learning Disability Specialists, and Librarians. Within this agreement it is understood that all references to “Adjunct Employees” will refer to unit eligible “Adjunct Faculty” and unit eligible “Adjunct Librarians/Counselors.”

(a) As a condition of, and in consideration for, from time to time accepting Orders (as defined below) and/or effecting Transactions (as defined below) in securities (including depository receipts and listed options), futures or foreign exchange at your direction and/or on your behalf or at the direction of or on behalf of your customer, you (the “Client”) agree to the terms and conditions set forth in this agreement (the “Agreement”). The Agreement includes all schedules, appendices attachments, documents incorporated by reference, and any other documents executed or agreed to by the Client with CESL in connection with the Services (as definedbelow).

2.2 Any terms in bold in these additional service conditions which are not defined in these conditions will have the same meaning as the defined terms set out in the merchant terms and conditions.
2.3 The merchant terms and conditions will apply to this additional service unless they contradict a term or condition in these additional service conditions, in which case the relevant term or condition in these additional service conditions will take priority.
2.4 Any notice or communication sent by you or us in relation to this additional service must be sent in line with the merchant terms and conditions.
2.5 In these additional service conditions some words have particular meanings. These are set out below.
(a) controls;
(b) is controlled by; or
(c) is under direct or indirect common control with; you or us (for example a subsidiary company) as appropriate.
