Air Transportation Services. Volaris will provide the Passenger with domestic air transportation services from a point of origin to a point of destination, subject to the terms, conditions and policies of this agreement, as well as the terms conditions and policies published on the Web Site and available on the passengers´ attention offices located at airports. , all of which are accepted by the Passenger upon contracting the services through any of Volaris’ sale channels. In consideration of the air transportation services provided by Volaris, the Passenger will pay Volaris a fixed price, as well as all applicable taxes and charges such as the Value Added Tax, the Airport Usage Tax, Security Inspection Charge, or any other charges that may be applicable from time to time, which can be reviewed by the Passenger using the Web Site, the Call Center or at Volaris sale channels inside the Airports, where available.

Air Transportation Services. The Charter Agreement entitles the Charterer to an air transportation service in accordance with the relevant air transport legislations. Both the Charterer and/or third parties to be named by the Charterer shall be entitled to this service if their health condition allows them safe air transportation without jeopardizing their existing health condition. The number and weight of baggage that can be carried depends on the number of the passengers, the aircraft booked and expected weather conditions. The pilot is entitled to reduce the maximum baggage allowance (weight) per passenger for safety reasons, on a case-by-case basis. The chartered air transportation service shall comprise transportation by air on the booked aircraft and with the legally defined crew, from the agreed point of departure to the agreed point of destination, or to the alternate airport if due safety, weather, other operational reasons or force majeure aircraft was not able to land to agreed point of destination. Costs for de-icing, or for sheltering the aircraft in a hangar to avoid de-icing, are not included in the price of the flight. Air Pink is entitled to charge for these expenses separately, upon presentation of documentary proof, except for de-icing or sheltering the aircraft in a hangar to avoid de-icing, at base airport Belgrade.

Air Transportation Services. The Proponent shall require that air transportation services Suppliers for the Project have a base of operations in the Province. For the purposes of this Section, “base of operations” means aircraft management and maintenance facilities and personnel in connection with the provision of such services. Notwithstanding the foregoing, the Government acknowledges that the Proponent will not require its Suppliers of air transportation services utilizing C-130 Hercules and C-5 Cargo aircraft (or their equivalents) to have a base of operations in the Province with respect to such aircraft; provided that, if such aircraft are used on a regular basis to service the Mine site, they will be loaded, unloaded and refueled at an airport in the Province if such loading, unloading or refueling services are required and can be performed at an airport in the Province on a competitive basis.

Air Transportation Services. Volaris will provide the Passenger with international air transportation service from one place to another subject to this Passenger International Air Transportation Service Agreement (the “Agreement”), as well as Volaris’ terms and conditions of service, policies and procedures located on Volaris’ Web Site at xxx.xxxxxxx.xxx or at any of Volaris’ ticket sale offices, whenever Volaris operates under the Y4 designator code and in any case where Volaris has a legal liability to the Passenger in relation the Passenger’s flight. For flights and services which are neither operated by Volaris nor a code share flight, we act solely as an agent for the operator of that flight or the applicable service provider. In addition to this Agreement, each airline and supplier will have its own terms and conditions. You must read both these Conditions of Carriage and the terms and conditions of the relevant airline, available from us upon request, before you complete your booking with us. On some services we have arrangements with other carriers known as “code shares”. This means that even if you have a reservation with us and hold a ticket where our name or Airline Designator Code is indicated as the carrier, another carrier may operate the aircraft. If such arrangements apply we will advise you of the carrier operating the aircraft at the time you make a reservation whenever your reservation is made directly with us or, if made through an Authorized Agent, we shall try to make sure that the Authorized Agent gives you such information. Air Transportation Services. 2.1. The Charter Agreement entitles the Charterer to an air transportation service in accordance with the relevant air transport legislation. In case a Charter Agreement is concluded, BUSINESS JETS shall be obliged to provide the flight requested with a properly equipped and fuelled aircraft with crew, from the agreed point of departure to the agreed destination at the agreed time. BUSINESS JETS shall be entitled at any time to replace the aircraft suitable for the flight, which is based on a Charter Agreement concluded between BUSINESS JETS and the Charterer. 2.3. The Charter Agreement shall include transportation of passengers` baggage unless otherwise agreed. The number and weight of bags that can be carried depends of the destination, the number of passengers, the aircraft booked and expected weather conditions. The pilot is finally entitled to reduce the maximum baggage allowance per passenger for safety reasons, on case by case basis. Under these circumstances, the Charterer shall not be entitled to terminate the Charter Agreement. 2.4. Should BUSINESS JETS be forced to make an unscheduled stop due the unforeseeable events, such as poor weather conditions, BUSINESS JETS shall be entitled to demand that the Charterer reimburse all additional cost resulting. 2.5. BUSINESS JETS may cancel or delay a flight without being liable to pay any cancellation fee or compensation whatsoever in the event that the regarding flight cannot be performed or completed due any cause beyond the control of BUSINESS JETS, including – but not limited to – strikes, lock out, civil commotion, war or warlike operations or imminence thereof, riots, civil war, blockade, embargo, act or omissions of governmental authorities including all civil authorities, Force Majeure, fire, flood, fog, frost, ice, storms, epidemics, quarantine, hijacking, requisition of aircraft by public authorities, breakdown or accident to aircraft, or if the safety of passengers is deemed by the aircraft commander or BUSINESS JETS operational supervisors to be in jeopardy. In case of such constellations BUSINESS JETS shall be under no obligation or liability towards Charterer beyond refund of the agreed charter price for such cancelled flight deducted by cancellation fees that may apply. 2.6.
