Anticorruption Measures. The Borrower shall comply with IFAD Policy on Preventing Fraud and Corruption in its Activities and Operations.
Anticorruption Measures. The Borrower shall: (a) undertake necessary measures to create and sustain a corruption-free environment; (b) ensure that its anticorruption laws and regulations and ADB’s Anticorruption Policy (1998) are strictly enforced and are being complied with during Project implementation, and that relevant provisions of ADB’s Anticorruption Policy (1998) are included in all bidding documents for the Project; (c) facilitate ADB’s exercise of its right to investigate, directly or through its agents, any alleged corrupt, fraudulent, collusive or coercive practices relating to the Project; (d) ensure that the Project Executing Agency conducts periodic inspections on the contractors’ activities related to fund withdrawals and settlements; and (e) ensure that all contracts financed by ADB in connection with the Project include provisions specifying the right of ADB to audit and examine the records and accounts of the Project Executing Agency and all contractors, suppliers, consultants and other service providers as they relate to the Project.
Anticorruption Measures. Each Party shall ensure that criminal or administrative measures exist to address corruption in its government procurement. These measures may include procedures to render ineligible for participation in the Party’s procurements, either indefinitely or for a stated period, suppliers that that Party has determined to have engaged in fraudulent or other illegal actions in relation to government procurement in a Party’s territory. Each Party shall also ensure that it has policies and procedures in place to eliminate, to the extent possible, or manage any potential conflict of interest on the part of those involved in or having influence over a procurement.

The Borrower shall cause PEPCO to ensure that ADB’s Anticorruption Policy (1998, as amended to date) is followed throughout the implementation of the Support Project, it being understood that ADB reserves the right to investigate, directly or through its agents, any alleged corrupt, fraudulent, collusive or coercive practices relating to the Support Project and the Facility. All bidding documents and contracts in connection with the Support Project shall include provisions specifying the right of ADB to audit and examine the records and accounts of and all contractors, suppliers, consultants and other service providers as they relate to the Support Project. The Borrower shall extend full cooperation and all necessary assistance, including access to all relevant contracts, accounting and bookkeeping records, as well as engagement of independent experts that may be needed for satisfactory completion of such investigations. An independent audit of procurement activities shall be carried out as required by ADB during the implementation of the Support Project, and any external costs related to such audit/investigations are be borne by PEPCO.

Tajikistan shall (i) undertake necessary measures to create and sustain a corruption-free environment, and (ii) ensure that its anticorruption laws and regulations and the ADB Anticorruption Policy (1998) are strictly enforced and are being complied with during Project implementation. ADB shall reserve the right to investigate directly, or through its agents, any possible corrupt, fraudulent, collusive or coercive practices relating to the Project.

During Project implementation, the Borrower shall follow, through MOF, ADB’s Anticorruption Policy, it being understood that ADB reserves the right to investigate, directly or through its agents, any alleged corrupt, fraudulent, collusive or coercive practices relating to the Project. The Borrower shall ensure, through MOF, that (a) periodic inspections of the contractors’ activities related to fund withdrawals and settlements are carried out, (b) relevant provisions of ADB’s Anticorruption Policy are included in all bidding documents for the Project, and (c) all contracts financed by ADB in connection with the Project include provisions specifying the right of ADB to audit and examine the records and accounts of MOF and all contractors, suppliers, consultants and other service providers as they relate to the Project.

Anticorruption Measures. The State shall ensure compliance and shall cause LPA to ensure compliance with IFAD Policy on Preventing Fraud and Corruption in its Activities and Operations and shall ensure that the compliance provisions are extended to the entities/organizations/parties and contractors.
Anticorruption Measures. The Recipient, through MRTT, shall ensure that ADB’s Anticorruption Policy (1998, as amended to date) and the Recipient’s anticorruption policy are followed. Consistent with its commitment to good governance, accountability and transparency, ADB reserves the right to investigate, directly or through its agents, any alleged corrupt, fraudulent, collusive, or coercive practices relating to the Project. To support these efforts, the Recipient, through MRTT, shall ensure that relevant provisions of ADB’s Anticorruption Policy are included in the bidding documents for the Project. In particular, all contracts financed by ADB in connection with the Project shall include provisions specifying the right of ADB to audit and examine the records and accounts of MRTT and all contractors, suppliers, consultants, and other service providers as they relate to the Project. MRTT shall also ensure, in accordance with the Recipient’s regulations and requirements, during Project implementation that (i) appropriate officials are resident in the Project offices for bidding, construction, and operations; (ii) an internal audit unit is established within MRTT; (iii) a two-contract system is adopted where the winner of a Works contract must also sign an anticorruption contract with the employer; and (iv) periodic inspection of contractors is undertaken to ensure that fund withdrawal and settlement procedures are followed. MRTT shall initiate liaison meetings, if necessary, to discuss warnings about or information on corrupt practices.
