Applicable Code Requirements. The term “Applicable Code Requirements” means all laws, statutes, most recent building codes, ordinances, rules, regulations, standards, and lawful orders of all Authorities Having Jurisdiction over Judicial Council, Design Build Entity, any Subcontractor, the Project, the Site, the Work, or the performance of the Work.
Applicable Code Requirements. 3.8.1 The Design Build Entity shall perform all work on the Project in accordance with the following Applicable Code Requirements and all code requirements listed in the Scope of Work: (a) All laws, statutes, the most recent building codes, ordinances, rules, regulations, and lawful orders of all public authorities having jurisdiction over the City, the Design Build Entity, any Subcontractor, the Project, the Project site, the work on the Project, or the prosecution of the work on the Project. (b) All requirements of any insurance company issuing insurance required hereunder. (c) Applicable sections in the State of California Labor Code. (d) All Applicable Code Requirements relating to nondiscrimination, payment of prevailing wages, payroll records, apprentices, and work day. 3.8.2 The Design Build Entity shall comply with and give notices required by all Applicable Code Requirements, including all environmental laws and all notice requirements under the State of California Safe Drinking Water and Enforcement Act of 1986 (State of California Health and Safety Code Section 25249.5, and applicable sections that follow). The Design Build Entity shall promptly notify the City’s Representative in writing if the Design Build Entity becomes aware during the performance of work on the Project that the Contract Documents are at variance with Applicable Code Requirements. 3.8.3 If the Design Build Entity performs work which it knows or should know is contrary to Applicable Code Requirements, without prior notice to the City and the City’s Representative, the Design Build Entity shall be responsible for such work and any resulting damages including, without limitation, the costs of correcting Defective Work.

The District shall not be responsible for any additional costs and/or responsibilities related to the maintenance or proper disposal of PV modules containing hazardous materials.
Applicable Code Requirements. The Design Consultant shall prepare and submit to the City an outline of provisions of Applicable Code Requirements which apply to this Project. The outline shall include a written report and diagrammatic Drawings which delineate the design criteria. This graphic documentation of the design criteria shall be updated with each subsequent submittal.
