Applicable Code Requirements. The term “Applicable Code Requirements” means all laws, statutes, most recent building codes, ordinances, rules, regulations, standards, and lawful orders of all Authorities Having Jurisdiction over Judicial Council, Design Build Entity, any Subcontractor, the Project, the Site, the Work, or the performance of the Work.
Applicable Code Requirements. 3.7.1 Contractor shall perform the Work in accordance with the following Applicable Code Requirements:
.1 All laws, statutes, the most recent building codes, ordinances, rules, regulations, and lawful orders of all public authorities having jurisdiction over the City, Contractor, any Subcontractor, the Project, the Project site, the Work, or the prosecution of the Work.
.2 All requirements of any insurance company issuing insurance required hereunder.
.3 The Federal Occupational Safety and Health Act and all other Applicable Code Requirements relating to safety.
.4 Applicable titles in the State of California Code of Regulations.
.5 Applicable sections in the State of California Labor Code.
.6 All Applicable Code Requirements relating to nondiscrimination, payment of prevailing wages, payroll records, apprentices, and work day. Without limiting the foregoing, Contractor shall comply with the provisions regarding nondiscrimination, payment of prevailing wages, payroll records, apprentices, and work day set forth in Article 14.
3.7.2 Contractor shall comply with and give notices required by all Applicable Code Requirements, including all environmental laws and all notice requirements under the State of California Safe Drinking Water and Enforcement Act of 1986 (State of California Health and Safety Code Section 25249.5 and applicable sections that follow). Contractor shall promptly notify Owner’s Representative in writing if Contractor becomes aware during the performance of the Work that the Contract Documents are at variance with Applicable Code Requirements.
3.7.3 If Contractor performs Work which it knows or should know is contrary to Applicable Code Requirements, without prior notice to the City and Owner’s Representative, Contractor shall be responsible for such Work and any resulting damages including, without limitation, the costs of correcting Defective Work.
Applicable Code Requirements. Contractor shall perform the Work in accordance with all applicable code requirements.
Applicable Code Requirements. 3.8.1 The Design-Build Entity shall perform all work on the Project in accordance with the following Applicable Code Requirements and all code requirements listed in the Scope of Work:
3.8.1.1 All laws, statutes, the most recent building codes, ordinances, rules, regulations, and lawful orders of all public authorities having jurisdiction over the District, the Design-Build Entity, any Subcontractor, the Project, the Project site, the work on the Project, or the prosecution of the work on the Project.
3.8.1.2 All requirements of any insurance company issuing insurance required
3.8.1.3 Applicable sections in the State of California Labor Code.
3.8.1.4 All Applicable Code Requirements relating to nondiscrimination, payment of prevailing wages, payroll records, apprentices, and work day.
3.8.2 All products and components outlined herein must conform to all applicable codes, standards, and rating methodologies, including but not limited to, the following:
3.8.2.1 All equipment used for the Project, including the PV modules, must be certified by the California Energy Commission Emerging Technologies Buydown Program and must be listed on the following web site: xxxx://xxxxxxxxxxxxxxxxx.xxx/links/equipmentlinks.php
3.8.2.2 If PV modules using hazardous materials are to be provided by the Design- Build Entity, then the Design-Build Entity must ensure that any special maintenance requirements are met and that it uses proper disposal/recycling of the PV modules at the end of their useful life, in compliance with the EPA Landfill Disposal Requirements. The District shall not be responsible for any additional costs and/or responsibilities related to the maintenance or proper disposal of PV modules containing hazardous materials.
Applicable Code Requirements. All applicable federal, state and municipal laws, statutes, building codes, ordinances and regulations of governmental authorities having jurisdiction over the Project, Work, Site, Design Consultant, or the City.
Applicable Code Requirements. The Design Consultant shall prepare and submit to the City an outline of provisions of Applicable Code Requirements which apply to this Project. The outline shall include a written report and diagrammatic Drawings which delineate the design criteria. This graphic documentation of the design criteria shall be updated with each subsequent submittal.
