APPLICABLE GOVERNMENT DIRECTIVES.
a. The Chair, on behalf of the Board of Directors, is responsible for ensuring that the Agency operates in accordance with all applicable TB/MBC, PSC and government directives, as well as applicable Ministry financial and administrative policies and procedures. Appendix 2 to this MOU provides a list of applicable directives and policies.
b. The Ministry will inform the Agency of amendments or additions to directives, policies and guidelines that apply to the Agency; however, the Agency is responsible for complying with all directives, policies and guidelines to which it is subject.
c. In addition to complying with the MBC Realty Directive, the Agency shall comply with the Ministry of Infrastructure Realty Policy including any appendices to this policy when acquiring space for accommodation and program purposes. The Ministry will ensure that the Agency is provided with any updates to this policy.
d. The CEO is responsible for ensuring that clear expectations are established for transfer payment recipients, and for ensuring effective diligence when setting up and monitoring transfer payment contracts to ensure public services are delivered, commitments are fulfilled, and the right controls are in place to ensure the prudent use of taxpayers’ money.
e. The inclusion of alcohol in the provision of hospitality is integral to the business of the Agency. Any such expenses shall be in compliance with, and receive prior approval from, the appropriate authority according to the Travel, Meal and Hospitality Expenses Directive. The Agency’s mandate may require the inclusion of alcohol in providing hospitality as part of business practices. The Agency has been given TB/MBC Special Status for Service of Alcohol at Hospitality Events due to the Agency’s role in attracting inward investment to the province promoting Ontario in national and international markets and engaging in business activities with domestic and foreign companies and partners. Such hospitality is considered a business courtesy and is part of demonstrating that Ontario is a business-friendly jurisdiction in a highly competitive industrial marketplace.

b. The Ministry will inform the Commission of amendments or additions to directives, policies and guidelines that apply to the Commission; however, the Commission is responsible for complying with all directives, policies and guidelines to which it is subject.
APPLICABLE GOVERNMENT DIRECTIVES a. The ministry will ensure that the Agency is provided with any updates to this policy.
d. The provision of hospitality that includes alcohol under the Travel, Meal and Hospitality Expenses Directive is integral to the business of the Ontario French-language Educational Communications Authority. • The Ontario French-language Educational Communications Authority delivers educational programs and services to benefit Ontario’s learners and citizens. The Agency has responsibility to make prudent fiscal decisions to ensure its ability to deliver on this mandate. • The provision of hospitality is central to the Agency’s plans to increase its self- generated revenues in future fiscal years, and, by extension, the Agency’s financial sustainability. The Government and Ministry have encouraged the Agency to increase its ability to self-generate revenues to help offset cost pressures. • Events that could include the service of food and beverages (including alcoholic beverages) to guests are central to the Agency’s ability to self-generate revenue. • The Agency must continue to secure appropriate Ministry approvals, as per the Travel, Meal and Hospitality Expenses Directive, to provide hospitality that includes alcohol.

b. The Ministry will inform OEFC of amendments or additions to Applicable Government Directives.

d. The inclusion of alcohol in the provision of hospitality is integral to the business of the Agency. Any such expenses shall be in compliance with, and receive prior approval from, the appropriate authority according to the Travel, Meal and Hospitality Expenses Directive. The Agency’s mandate may require the inclusion of alcohol in providing hospitality as part of business practices. The Ministry recognizes that the ability to occasionally provide hospitality including alcohol is an acceptable business practice and is critical to fundraising and revenue generation efforts for sponsorship, donor events and promotions of sales of OSC products and services. Such events are permitted by the Ministry. OSC earned revenues will be used to fund such events and in no case will Government funds be used to purchase alcohol.
APPLICABLE GOVERNMENT DIRECTIVES.
a. The Chair, on behalf of the Board, is responsible for ensuring that HSSOntario operates in accordance with all Applicable Government Directives, as well as applicable Ministry financial and administrative policies and procedures. Appendix 3 to this MOU provides a list of Applicable Government Directives and policies.
b. HSSOntario is responsible for complying with all Applicable Government Directives to which it is subject that have been listed in this MOU or have been directly provided to HSSOntario or posted to XXXXX. The Ministry will use best efforts to communicate (i) all updates or changes to the list in Appendix 3, and (ii) any new directives, policies or guidelines not on the Appendix that applies to HSSOntario, as soon as possible to permit HSSOntario time to review and comply with any new requirements.
c. The Ministry agrees to communicate such changes or new requirements directly with the CEO of HSSOntario or by notice to the CEO that such changes or new requirements have been posted to and are available on XXXXX.
d. In addition to complying with the MBC Realty Directive, HSSOntario shall comply with the Ministry of Infrastructure Realty Policy including any appendices to this policy when acquiring space for accommodation and program purposes. The Ministry will ensure that HSSOntario is provided with any updates to this policy.
APPLICABLE GOVERNMENT DIRECTIVES.

b. The Ministry will inform the LCBO of amendments or additions to Applicable Government Directives; however, the LCBO is responsible for complying with Applicable Government Directives.
c. In addition to complying with the MBC Realty Directive, the LCBO shall comply with the Ministry of Infrastructure Realty Policy including any appendices to this policy when acquiring space for accommodation and program purposes. The Ministry will ensure that the LCBO is provided with any updates to this policy.
d. The LCBO is considered an ‘Other Included Entity’ under the Procurement Directive and will comply with sections 3 and 8 of the Procurement Directive.
