Assumption of Risk and Responsibility. In recognition of the inherent risks of the Activity which I, and any minor children for which I am responsible, will engage in, I/we confirm that I am (we are) physically and mentally capable of participating in the Activity and/or using equipment. I/We participate willingly and voluntarily and I/we understand that the Company cannot guarantee that any facility or equipment is free of risk. I/We also assume responsibility for damage to or loss of my/our personal property, and in no event shall the Company’s liability with respect to personal property exceed the lesser of the actual value or $100.00. I/We also assume risk for accidents or injuries caused by my/our own negligence or errors whether or not such negligence is comparative or contributory. I am (we are) aware of the meaning of the terms "Unroped Climbing" (aka "Bouldering"), "Top Rope Climbing,” and "Lead Climbing" and understand the differences between the activities. I/We accept that lead climbing is the most dangerous due to the hazard to both leader and follower. I/We agree to be "checked out" on climbing and belaying skills prior to participation, and that I/we have read, understand, and will follow all MetroRock General Policies and Climbing Policies. I/We acknowledge that wearing appropriate clothing and footwear are basic safety precautions, and that wearing a UIAA approved helmet may help assist in the prevention of head and/or neck injuries. I/We understand that the sport of indoor rock climbing is not the same as the sport of outdoor rock climbing, that outdoor rock climbing requires additional skills and instruction that I/we cannot obtain by indoor rock climbing, and that no amount of experience and instruction in indoor rock climbing will provide me/us with the skills or instruction necessary for outdoor rock climbing. I/We assume the risk(s) of any and all personal injury, accidents and/or illness, including, but not limited to, sprains, torn muscles and/or ligaments; fractured or broken bones; eye damage; cuts, wounds, scrapes, abrasions, and/or contusions; dehydration, oxygen shortage (anoxia); head, neck, and/or spinal injuries; heat exhaustion and/or heat stroke; shock, paralysis, and/or death that are not caused directly and solely by the negligence or willful misconduct of the Company or its employees, agents, or affiliates. Assumption of Risk and Responsibility. My Child’s attendance at the Facility and participation in and/or observance of the Activities is voluntary and I fully assume the risk of any personal injury, illness or death occurring to my Child and the risk that any personal property belonging to myself or my Child is lost, stolen or damaged even if such injury illness, death, loss or damage is caused by the negligence or willful acts or omissions of any of the Releasees or any other person and whether same occurs while participating in or observing the Activities or in any other area of the Facility (such as in the entrances, exits or washrooms) or even outside of the Facility on the premises located at 0000 Xxxxx Xxxxx, Xxxxxxxx, XX 00000 (such as on the sidewalks or parking areas).
Assumption of Risk and Responsibility. Participant fully understands and appreciates the risks of injury that may occur in ice skating or in the course of preparing for, participating in and traveling to or from the Events and Activities. The risks of injury that may occur include, but are not limited to, the risk of, serious bodily injury, viral infections, bacterial infections and risk of other communicable diseases and illness, permanent disability, paralysis and death (collectively referred to herein as “Risks”). Participant acknowledges that Participant voluntarily engages in such Events and Activities with adequate knowledge of such Risks; and agrees that Participant fully assumes all such Risks and all legal and financial responsibility for (a) any and all injuries or damages, whether to person or property, that Participant may in any manner sustain in connection therewith or in the conduct and management of the Events and Activities, including such injury or damage that may result from the negligence of U.S. Figure Skating or from some other cause and (b) all treatment, hospitalization and other care rendered to Participant in the event of Participant’s illness, injury or other emergency circumstance in connection with participation in the Events and Activities, subject to any applicable insurance coverage.
Assumption of Risk and Responsibility. Caterer hereby assumes any and all risk of personal injury and property damage attributable to its willful or negligent acts or omissions and the willful or negligent acts or omissions of its officers, employees, and agents. Caterer also assumes such risk with respect to the willful or negligent acts or omissions of its subcontractors or persons otherwise acting or engaged to act on behalf of Caterer in furtherance of Caterer fulfilling its obligations under this Agreement. Caterer acknowledges and agrees that Caterer is cognizant of all inherent dangers and risks involved in providing Catering Services, including but not limited to bodily injury.
Assumption of Risk and Responsibility. Notwithstanding and recognizing all of the risks, inherent or otherwise, associated with the Program, Participant HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF ACCIDENT, ILLNESS, PHYSICAL INJURY, DEATH, PROPERTY DAMAGE, and all HARM or DAMAGE (collectively “Injury”), whether known or unknown, arising out of or related to the Program(s) however caused even if caused by the NEGLIGENCE OR CARELESSNESS OF YTT, Released Parties, or otherwise, including, without limitation, the risks and inherent or unexpected dangers associated with training for, traveling to/from, competing in and otherwise participating in the sport of triathlon. Participant further assumes full responsibility for any Injury resulting from any known or unknown medical or physical condition of Participant.
Assumption of Risk and Responsibility. In consideration of, and in recognition of the inherent risks associated with the activity and the use of the facility, I, and/or on behalf of any minor children which I am responsible for, agree, on behalf of myself, my/our heirs, representatives, successors, executors, administrators and assigns, to hereby release, waive, discharge and agree not to sue its officers, directors, shareholders, agents and employees, for any and all claims or demands, obligations and/or causes of action of any nature whatsoever which I may have against its officers, directors, shareholders, agents and employees, on account of any personal injury, property damage, death or accident of any kind, arising out of or in any way connected with use of the facility or equipment, whether my/our use is supervised or unsupervised and I/we agree to indemnify and hold harmless the persons or entities mentioned in this paragraph from any and all liabilities or claims made by other individuals or entities as a result of my/our actions.
Assumption of Risk and Responsibility. Caterer hereby assumes any and all risk of personal injury and property damage attributable to its willful or negligent acts or omissions and the willful or negligent acts or omissions of its officers, employees, and agents. Caterer also assumes such risk with respect to the willful or negligent acts or omissions of Caterer’s subcontractors or persons otherwise acting or engaged to act at the instance of Caterer in furtherance of Caterer fulfilling Caterer’s obligations under this Agreement. Caterer acknowledges and agrees that Caterer is cognizant of all of the inherent dangers and risks involved in providing Catering Services, including but not limited to bodily injury.
Assumption of Risk and Responsibility. My participation in this activity is purely voluntary. I agree to accept and assume responsibility for all risks existing in this activity, even those risks arising out of negligence on the part of the Foundation, or other third parties. I accept and assume full responsibility for myself and all passengers on the Sailboat, including any minor children, for any and all claims including, but not limited to, bodily injury, accident, illness, paralysis, death or loss of personal property even if caused, in whole or in part, by the negligence or other fault of the Foundation, its officers, directors, employees, agents, subsidiaries, legal representatives and assigns. I agree to the foregoing because I understand that the Sailboat, water bodies and areas in and around Sailboat can be hazardous to both persons and property, thereby posing a substantial risk of damage to property and injury and even death to persons. Assumption of Risk and Responsibility. I/We agree to assume responsibility for all risks including those listed and others not identified. My participation in the activity is voluntary. All participants in my party have been made aware of the risks and I will be responsible for them. I am not impaired by alcohol or drugs, and I do not have any disability or condition that may impair my safe operation of the watercraft. We elect to participate in the rental use in spite of the risks and potential dangers of operation on and around the water. I/We understand that at the total discretion of Gordons WaterSports Inc. this rental agreement can be terminated when and if there is a question as to the competency or condition of the operator or when weather conditions prevent the safe operation of the watercraft. I/We understand that any film, video, photo or image of we/us while operating the rental watercraft may be used for promotional or social media purposes.
Assumption of Risk and Responsibility. In consideration for allowing the child identified below (the "Participant") to enter and participate in activities at the Billy Beez facility located at Billy Beez – Westfield Valencia Town Center, 00000 Xxxxxxxx Xxxx, Xxxxxxxx, XX, 00000 ("Billy Beez"), I represent that I am the parent and/or legal guardian of the Participant and, by signing this agreement as such and on behalf of the Participant, I hereby knowingly and fully assume all risks, known and unknown, and all responsibilities for any injury, loss or damage sustained by Participant arising out Participant's presence on the Billy Beez premises, including, without limitation, death or disability, even if such injury, loss or damage is caused, in whole or in part, by the negligence of Billy Beez, its owners, affiliates, officers, directors, agents and employees (the "Released Parties"). I understand that such known and unknown risks associated with Participant's presence on the Billy Beez premises and those associated with participation in activities at Billy Beez include, but are not limited to, those associated with climbing on structures, playing on slides and running around with other children. I acknowledge that the foregoing describes some, but not all, of those risks, and I understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, permanent disability, death or property damage. Authorization: Should Participant sustain any injury or acquire any illness while on the Billy Beez premises, I hereby authorize any medical treatment deemed necessary for treatment of any such injury or illness. In the event that more serious medical procedures are required I understand that attempts will be made to contact me and, in the event I am unable to be contacted within a reasonable period of time, I authorize any duly licensed medical practitioner to perform such procedures as may be medically necessary to treat the condition.
