ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT. A. I freely acknowledge that I have or will voluntarily register (myself/my child) to participate in soccer or Futsal. I acknowledge that participation in the Activities entails both known and unanticipated risks that could result in serious and permanent physical and emotional injuries, death, damage to property, and injury to others including, without limitation, the risks of physical or emotional injury, sickness, death, property damage, falls, collisions with people and stationary objects, the unavailability of emergency medical care, and/or the negligence and/or deliberate act of another person. I understand that such risks are inherent in the Activities and that even with precautions and safety measures they cannot be eliminated without jeopardizing the essential qualities of the Activities. I also understand and specifically acknowledge that participation in the Activities includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19, and while particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist. I understand that the Released Parties (hereafter defined) shall have no obligation to provide medical assistance in the event an injury or illness occurs during the Activities. Understanding such dangers and risks, I hereby knowingly and voluntarily choose to participate in the Activities, and if applicable I give my permission for my child to engage in the Activities described above, and (myself/my child) fully assume(s) the risk of the Activities, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES. I acknowledge that this Participant Agreement applies, without limitation, to any other risks encountered before, during or after the Activities, whether or not the Participant knows or expects them to exist at the time of signing this Participant Agreement, including, but not limited to, driving to or from the Activities, in parking lots or access areas, being present in any Facility at which the Activities are held, slips, falls, stairs, exits, entrances, fire and/or any other occurrence or event, known or unknown.

As a result of the highly contagious novel coronavirus, COVID-19, federal, state and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Brimfield School District has put in place preventative measures to reduce the spread of COVID-19 including following the directives and guidelines from the Governor, the Illinois Department of Health, and Illinois School Board of Education. However, the Brimfield School District cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending and participating in athletics could increase your risk and your child(ren)’s risk of contracting COVID-19. You and/or your child(xxx)’s participation and attendance at an activity is voluntary. Further, you and your child(ren) are required to abide by directives designed to lower the risk of COVID-19 exposure which may include wearing masks, social distancing (6 feet apart), washing hands, non-sharing of equipment, wiping down all shared equipment after each use, limitations on spectators, etc. These directives will be provided to you by appropriate staff which could include, but is not limited to administration, coaching staff, other district personnel. If you fail to follow these directives, you will forfeit you and your child(xxx)’s right to continued participation in the activity. In consideration of being allowed to participate in the activity the undersigned acknowledges, appreciates, and agrees that: Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. If, however, I observe any unusual or significant hazard during my participation, I will not participate and bring such to the attention of PAC’s director immediately; and I, for myself and all of my heirs, assigns, and personal representatives, hereby release and hold harmless Philly Art Center, Art Mark LLC, its director, teachers and all employees and authorized representatives, (“Releasees”), with respect to any and all illness, disability, death or damage to any persons that may occur, whether arising from the negligence of Releasees or otherwise, either directly or indirectly, as a result of my participation in PAC programming; and I knowingly and freely assume all such risks of exposure to infectious diseases, both known and unknown, even if arising from the negligence of the Releasees or others, and assume full responsibility for my participation.
