Inherent Risks are described below in the paragraph headed “Assumption of Inherent Risks”; Released Parties are together HaO and its affiliates and its and their respective directors, officers, employees, agents, contractors, insurers, spectators, equipment suppliers, and volunteers; VENUE and its directors, officers, employees, agents, contractors, insurers, equipment suppliers, and volunteers; all HaO event sponsors, organisers, promoters, directors, officials, property owners, and advertisers; governmental bodies, charities and/or municipal agencies whose property and/or personnel are used; and any or all parent, subsidiary or affiliate companies, licensees, officers, directors, partners, board members, supervisors, insurers, agents, equipment suppliers, and representatives of any of the foregoing. Releasing Parties are together my spouse, children, parents, guardians, heirs, next of kin, and any legal or personal representatives, executors, administrators, successors and assigns, or anyone else bringing a Claim against HaO or the Released Parties on my behalf. Paragraph headings shall not affect the interpretation of this Agreement. Unless the context otherwise requires, words in the singular shall include the plural and in the plural include the singular.
Inherent Risks means the level of risks that exists in an organisation prior to the adoption or implementation of internal security controls or measures designed to avoid or mitigate them.
Inherent Risks are risks, both known and unknown, that cannot be eliminated completely (without changing the challenging nature of the Event) regardless of the care and precautions taken by Capstone Event Group LLC (references to Capstone Event Group LLC include the limited liability entity and the Released Parties). I also understand that the Event is extremely strenuous and includes the accompanying risks and dangers generally present in activities designed to stress the body and test mental and physical endurance and stamina. I understand that these hazards may be magnified due to the fact that the Event is often conducted under what may be less than ideal conditions and circumstances. I understand and acknowledge that the Inherent Risks include, but are not limited to: 1) contact or collision with persons or objects (e.g., collision with spectators or course personnel), contact with other participants, contact or collision with motor vehicles or machinery, and contact with natural or man-made fixed objects; 2) encounters with obstacles (e.g., road and surface hazards); 3) equipment-related hazards (e.g., broken, defective or inadequate competition equipment, unexpected equipment failure, imperfect course conditions); 4) weather-related hazards (e.g., extreme heat, extreme cold, humidity, ice, rain, fog);

Assumption of Inherent Risks The HaO event is meant to be an extreme test of robustness, strength, stamina, camaraderie, physical and mental determination that takes place in one place in one day. It is not a race against other contestants, but rather a challenge with oneself and the course. The object is to finish the course. The venue is part of the challenge and the HaO event will be held in hostile environments that might include extreme heat or cold, snow, fire, water, mud, rocks, changes in terrain and obstacles. Some of the challenges/activities include runs, military style obstacles, going through pipes, traversing cargo nets, manoeuvring through barbwire, climbing walls, encountering electric voltage, swimming in cold water, throwing or carrying heavy objects, and traversing muddy & rocky areas. In summation, the HaO event is a hazardous activity that presents a huge physical and mental challenge to participants. HaO will use reasonable care and skill to provide a venue that is fit and suitable for the event bearing in mind the paragraph above. Inherent Risks. As a PARTICIPANT in the Mud-Stash event, I, the UNDERSIGNED, understand the following: • I understand that the course is such an extreme test of human physical and mental limits that I may not be able to safely complete it, even if I am sufficiently fit, healthy, skilled, and physically trained to safely participate; I also understand that it is my responsibility to continuously monitor my own physical and mental condition during the Event. • I understand that the Event, whether recreational or competitive, presents many unique challenges heightened by the rough, ever- changing conditions and terrain, and I understand that conditions may change and become more hazardous during the time I am participating at PNS. • I understand that the Event is an inherently dangerous activity with risks too numerous to list, which include, but are not limited to, the steep, slippery, uneven condition of roads and trails which contain rocks, trees, ledges, soft sand, mud, slippery grass, water and other bumps, ruts, stumps, brush (all of which can be hidden or obscured by vegetation), collisions with other participants, pedestrians and mountain vehicles or other man-made objects on the course, including obstacles, gates and finish line equipment; and the failure of mechanical components. • I understand that falls are a common occurrence of the activity. • I understand that water obstacles may contain waterborne bacteria and parasites and I may become ill if I swallow, inhale or am exposed to contaminated water; symptoms of which include cramps, nausea, fever and severe diarrhea. • I understand that even minor injuries can become life-threatening emergencies when they occur far away from rescue personnel and it takes a great deal of time for rescue personnel to locate and reach an injured participant. • I understand that other risks of the Event include, but are not limited to, erratic or negligent behavior of the participant or of other participants; sudden changes in weather, weather-related occurrences, and acts of nature; failure of equipment; and judgment errors by staff (including error in judging the ability of participants, failure to anticipate developing problem situations, and failure to anticipate sudden changes in weather conditions). • I understand that the risks of observing and being on the premises for all persons include, but are not limited to, standing too close to the course; being struck by participants or objects; slipping and falling (on slick, wet, ...
