Within one hundred and eighty (180) days of the Effective Date, Bank of America shall implement an Auxiliary Aids and Services Policy and Procedure, pursuant to the terms of this section, to memorialize and enhance Bank of America's present procedures to ensure that Bank of America's printed materials are communicated effectively to Persons with Vision Impairments, to the extent required by the ADA.

Auxiliary Aids and Services for Printed Material. 4.1 Provision of Auxiliary Aids and Services for TCF Bank’s Printed Material. TCF Bank agrees to take the following steps to ensure that information related to consumer deposit accounts is effectively communicated to Persons with Visual Impairments: 4.1.1 No later than November 1, 2008, periodic statements for consumer deposit accounts will be available in Braille and Large Print to account holders with Visual Impairments who make a reasonable request for such formats as described below. TCF Bank will transmit data for the periodic account statements to the Braille and Large Print vendor within three (3) business days of the periodic statement date cut-off. All account statements will be produced and mailed to the customer within four (4) business days from receipt of the statement data by the vendor. 4.1.2 No later than March 31, 2009 periodic statements for consumer deposit accounts will be available in audio format to TCF Bank account holders with Visual Impairments who make a reasonable request for such format as described below. Audio format may include audio cd or audio tape, as determined by TCF Bank. TCF Bank will transmit data for the periodic account statements to the audio format vendor within three (3) business days of the periodic statement date cut-off. All account statements will be produced and mailed to the customer within four (4) business days from receipt of the statement data by the vendor. 4.1.3 No later than March 31, 2009, TCF Bank will provide Claimants with a draft policy outlining (i) the availability of Braille, Large Print, and audio period statements for consumer deposit accounts; (ii) the ways in which TCF Bank will effectively communicate information relating to consumer deposit accounts other than periodic statements to Persons with Visual Impairments; and (iii) the ways in which Persons with Visual Impairments may request Auxiliary Aids and Services. At a minimum, Persons with Visual Impairments shall be allowed to make requests at a TCF branch office or through the TCF toll-free customer service phone line during regular hours of operation. 4.1.4 The policy described in Section 4.1.3 shall ensure that Auxiliary Aids and Services are provided within a reasonable time period after a request has been made. Auxiliary Aids and Services for Printed Material. 5.1 Provision of Auxiliary Aids and Services for Printed Material. 5.1.1 No later than thirty (30) days from the Effective Date, Fleet will develop and provide to Counsel a draft of an effective policy for providing auxiliary aids and services to Persons with Vision Impairments. Counsel shall provide Fleet with comments thereon within fifteen (15) days of receipt. Fleet shall consider and use best efforts to incorporate the substance of all such written comments and suggestions that Counsel give pursuant to this section that are consistent with the ADA and this Agreement. No later than sixty (60) days from the Effective Date, Fleet will finalize its policy for providing auxiliary aids and services. No later than ninety (90) days from the Effective Date, Fleet will implement the policy. That policy will include, at a minimum, the following components: 5.1.1(a) Production of the following frequently used documents in alternative formats: personal deposit account agreements, personal deposit account fee schedules, banking brochures, and new account opening materials, which will be generally available to Persons with Visual Impairments at all Fleet branch offices. Alternative formats will include Braille, audiocassette, diskette or other electronic format, and large print, as appropriate. In addition, Fleet will make these documents accessible through its web site within ninety (90) days from the Effective Date. Fleet will provide at each of its branch offices sample statements in Braille, audiocassette, diskette or other electronic format, and large print formats. 5.1.1(b) An effective procedure whereby Persons with Vision Impairments may request and Fleet will provide bank statements in alternative formats, including Braille, audio cassette, diskette or other electronic format, and large print. 5.1.1(c) An effective procedure whereby Persons with Vision Impairments can request, and Fleet will provide, in alternative format (Braille, audio cassette, diskette or other electronic format, and large print) or some other effective form of communication, other documents that Fleet provides to its sighted customers. Fleet will use reasonable efforts to comply with requests for documents in an alternative format within fifteen (15) business days of the date of the request.

LaSalle agrees to provide Auxiliary Aids and Services to Persons with Vision Impairments or Blindness by March 31, 2005. LaSalle shall implement Policies, Practices and Procedures to facilitate the provision of such Aids and Services (hereinafter “Policies, Practices and Procedures”). LaSalle shall provide its proposed Policies, Practices and Procedures to Claimants on or before February 28, 2005. Claimants may provide written comments and suggestions to LaSalle within fifteen (15) days after receipt. LaSalle shall consider and use its best efforts to incorporate the substance of any such written comments and suggestions submitted by Claimants that are consistent with the ADA and this Agreement. LaSalle will implement its final Policies, Practices and Procedures within fifteen (15) days after receipt of the Claimants comments and suggestions. LaSalle may revise its Policies, Practices and Procedures from time to time following the Effective Date. LaSalle shall provide notice of such revisions to Claimants prior to implementation. Claimants may provide written comments and suggestions within thirty (30) days after receipt. LaSalle shall consider and use best efforts to incorporate the substance of any such written comments and suggestions provided by the Claimants that are consistent with the ADA and this Agreement.

Within one hundred and eighty (180) days of the Effective Date, UBOC shall implement an Auxiliary Aids and Services Policy and Procedure, pursuant to the terms of this section, to ensure that UBOC’s printed materials, as described in Section 4.3(c), are communicated effectively to Persons with Vision Impairments, to the extent required by the ADA. The time periods in this section 3 shall be extended for no more than sixty (60) days if there is unexpected delay in UBOC entering into a contract with an auxiliary aids and services vendor. In such circumstances UBOC will notify Claimant in writing. 3.2 Development of Auxiliary Aids and Services Policy and Procedure. 3.2(1) Within ninety (90) days of the Effective Date, UBOC will provide Claimant with a copy of a draft Auxiliary Aids and Services Policy and Procedure. Within fifteen (15) business days after receiving the Auxiliary Aids and Services Policy and Procedure, Claimant shall provide written comments and suggestions about the Policy and Procedure to UBOC. UBOC shall consider and use best efforts to incorporate the substance of all such written comments and suggestions that Claimant gives pursuant to this section that are consistent with the ADA and this Agreement. 3.2(2) Within one hundred and twenty (120) days of the Effective Date, UBOC shall finalize the Auxiliary Aids and Services Policy and Procedure, and shall 3.2(3) Within one hundred and eighty (180) days of the Effective Date, Bank shall commence providing Auxiliary Aids and Services to Persons with Vision Impairments. 3.3 Elements of the Auxiliary Aids and Services Policy and Procedure. (a) No more than forty-five (45) days after the Effective Date, Washington Mutual will provide Claimants with a copy of documents which memorialize its policies and procedures concerning the provision of Auxiliary Aids and Services. Nothing in Section 5.2(a) obligates Washington Mutual to create new documents reflecting its policies and procedures concerning the provision of Auxiliary Aids and Services. (b) Within thirty (30) business days after receiving the materials referred to in Section 5.2(a), Claimants shall provide written comments and suggestions, if any, about them to Washington Mutual. Washington Mutual shall consider and use good faith efforts to incorporate the substance of all such written comments and suggestions given by the Claimants, provided that such comments and suggestions are consistent with this Understanding and required by the ADA. Within sixty (60) business days after receipt of any such comments or suggestions, Washington Mutual shall provide the Claimants with a written response regarding Washington Mutual’s position on each such comment or suggestion. 5.3 Elements of the Auxiliary Aids and Services Policies and Procedures. With respect to Auxiliary Aids and Services, Washington Mutual shall provide the following: (a) Washington Mutual Shall Continue to Provide Effective Auxiliary Aids and Services of Its Choice. Auxiliary Aids and Services shall continue to be provided in the areas of ATM services, deposit accounts and lending to consumers. Washington Mutual will provide Auxiliary Aids and Services for its printed materials to Persons with Vision Impairments who request Auxiliary Aids and Services in a manner consistent with Sections 5.3(b) and (c). To the extent more than one Auxiliary Aid or Service is effective to communicate a particular printed material to Persons with Vision Impairments, Washington Mutual may select the effective method of its choice. 5.3(b) Methods for Persons with Vision Impairments to Request and Obtain Auxiliary Aids and Services.   • Packaging Materials and Containers for Retail Sale 1. When packaging materials and containers in which a good is packaged for retail sales are classified in the Harmonized System with the good, they shall not be taken into account in determining whether all non-originating materials used in the production of the good undergo the applicable change in tariff classification set out in Annex 4.03. 2. When the good is subject to a requirement of regional value content, the value of these packaging materials and containers shall be taken into account as originating or non-originating materials, as the case may be, in calculating the regional value content of the good.

  • Packing Materials and Containers for Shipment Packing materials and containers in which the good is packed for shipment shall be disregarded in determining whether-- (i) the non-originating materials used in the production of the good undergo an applicable change in tariff classification set out in subdivision (t) of this note; and (ii) the good satisfies a regional value-content requirement.

  • Goods and Services 4.3.1. The Supplier shall ensure that the Goods and/or the Services provided are fit for the purposes that may reasonably be inferred from the technical specifications and in accordance with the timetable for performance defined in the Contract. In any event the Supplier commits himself to achieve performance and results stipulated in the Contract. 4.3.2. The Goods and/or Services shall be delivered in a state of full completion with the complete “Documentation” (any operation and maintenance manuals, drawings, calculations, technical data, logic diagrams, progress reports, quality documentation, conformity certificates, test reports, bill of lading, certificates of origin, export control classification list number as per any applicable export regulation - such as the European Council Regulation 428/2009 (as amended) and/or the U.S. Export Administration Regulations (“EAR”), percentage of U.S. origin content, U.S. Export Control Classification Number (“ECCN”) or U.S. Munitions List category (“USML”) (if applicable) export authorizations and licenses, Harmonized Tariff Code - and any such other documents required under the Contract and/or applicable Laws) associated therewith as well as all instructions, recommendationsandother indicationsnecessaryin orderfor themtobeused correctly and under the appropriate safety conditions. If so required by the Purchaser, the Supplier shall submit any such Documentation to the Purchaserwith sufficient timeforreview andapproval by the Customer, in accordancewith the time-lines agreed between the Purchaser and the Customer. Where the Documentation provided by the Supplier is not compliant with Purchaser’s contractual requirements, the Supplier must make the necessary modifications, and indemnify the Purchaser for any costs, liabilities or penalties incurred by the Purchaser as a result of the non-compliance and/or delay. 4.3.3. Goods or Services that donotmeetall the requirements set in this Article 4.3 shall be considered as having a Non-Conformity as per Article 10 of these General Conditions and may be recorded as a non-conformity event (NCE) as defined in the Supplier Quality Manual. 4.3.4. If the Supplier is not certain that the results of the Services or Goods comply with the requirements defined in this Article 4.3, it shall inform immediately the Purchaser thereof in writing, providing all the needed indications concerning the risks of non- compliance and the measures that the Supplier intends to take in order to remedy the situation. The Purchaser shall notify its acceptance or rejection of the Supplier’s proposals as soon as possible and in writing. 4.3.5. If the Purchaser assesses on its part that the Supplier is not performing the Services and/or supplying the Goods in accordance with the Contract, itmay require the Supplier to indicate to it, in writing, the measures that the Supplier intends to take to remedy the situation. The Purchaser shall notify the Supplier in writing as soon as possible of its acceptance or rejection of the Supplier’s proposals.

  • Developer Attachment Facilities Developer shall design, procure, construct, install, own and/or control the Developer Attachment Facilities described in Appendix A hereto, at its sole expense.
