Beta Service. From time to time, Company may make Beta Service available to Subscribers at no charge. Subscriber may choose to try such Beta Service or not in its sole discretion. Use of Beta Service is at Subscriber’s sole risk and may contain bugs or errors. Subscriber may discontinue use of the Beta Service at any time, in its sole discretion. Further, Company may discontinue any and all Beta Service availability at any time in its sole discretion without notice. NOTWITHSTANDING THE REPRESENTATIONS, WARRANTIES AND DISCLAIMERS IN SECTION 6, BETA SERVICE AND DOCUMENTATION, ARE PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. COMPANY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. COMPANY SHALL HAVE NO INDEMNIFICATION OBLIGATIONS AND NO LIABILITY OF ANY TYPE WITH RESPECT TO THE BETA SERVICE UNLESS SUCH EXCLUSION IS UNENFORCEABLE UNDER APPLICABLE LAW IN WHICH CASE COMPANY’S LIABILITY WITH RESPECT TO THE BETA SERVICE PROVIDED SHALL NOT EXCEED $500.00.
Beta Service. Licensee acknowledges and agrees that from time to time new and upgraded features and releases shall be offered as a beta version of such Plan Offerings (“Beta Service”) and as such: (a) Licensee acknowledges that the Beta Service is not at the level of performance and compatibility of a final, generally released product offering and may not operate properly, may contain “bugs”, and may be substantially modified by GDSA prior to commercial release; (b) Licesee’s license to or ability to make use of such Beta Service pursuant to this Agreement expires upon availability of a commercial release of that Beta Service from GDSA and (c) Licensee agrees that such Beta Service is provided “as is, where is” without warranty or condition of any kind and GDSA disclaims any liability obligations to Licensee or any End User or any third party of any kind with respect to such Beta Service. Licensee acknowledges that GDSA has not made any representations, promises or guarantees that the Beta Service will ever be announced or made available to anyone in the future. Licensee will be asked to provide feedback regarding the Beta Service and Licensee hereby grants to GDSA a perpetual, royalty-free worldwide license to use and/or incorporate such feedback into any GDSA product or service (including the Beta Service) at any time at the sole discretion of GDSA.
Beta Service. From time to time, Xxxxx may make the Beta Services available to the Customer at no additional cost. The Customer may choose to try such Beta Services in the Customer’s sole discretion. Unless otherwise determined by Xxxxx, no Order Form is specifically required to enable the Customer’s use of Beta Services. Beta Services are intended for evaluation purposes and not for production use. Beta Services are not supported and may be subject to supplemental terms in addition to those set out in this Agreement, which will be presented to the Customer. Beta Services are not considered part of the Subscription Service, however, all restrictions and the Customer commitments under this Agreement shall apply to the Customer’s use of Beta Services. Unless otherwise stated, any Beta Services trial period will expire upon the earlier of six (6) months from the trial start date or the date that a version of the Beta Services becomes generally available without the applicable Beta Services designation. Xxxxx may discontinue Beta Services at any time in Xxxxx’x sole discretion and may never make Beta Services generally available. Xxxxx will have no liability for any harm or damage arising

Beta Service. From time to time, We may invite You to try Beta Services at no charge. You may accept or decline any such trial in Your sole discretion. Beta Services will be clearly designated as beta, pilot, limited release, developer preview, non-production, evaluation or by a description of similar import. Beta Services are for evaluation purposes and not for production use, are not
Beta Service. The Cloud Feature is released as a product that we are still testing and evaluating. The Cloud Feature may not be as reliable as our other services. The Cloud Feature is made available so that we can collect user feedback, and by using it, you agree that we may collect such feedback.
Beta Service. Securonix may, in its sole discretion, make available to Customer a preview, limited release, alpha, beta, or other pre-release version or feature of the Service for non-production use (each, a “Beta Service”). Customer’s use of a Beta Service will be for the term specified in the Order Form of statement of work for such Beta Service. Securonix may, in its sole discretion, discontinue the Beta Service, at any time for any or no reason. NOTWITHSTANDING ANYTHING IN THIS AGREEMENT TO THE CONTRARY, CUSTOMER ACKNOWLEDGES AND AGREES THAT BETA SERVICES ARE PROVIDED WITHOUT ANY WARRANTY OR ANY SUPPORT SERVICE (INCLUDING ANY UPDATES OR UPGRADES).
Beta Service. Threat Stack may offer part of the Service as a Beta Service. Threat Stack will determine the amount of time for testing, evaluation, conditions, and offering of the Beta Service. Threat Stack is not required to offer the features of the Beta Service in the Service. Client agrees to provide timely feedback to Threat Stack of all defects identified during Client’s use of the Beta Service.
Beta Service. From time to time, We may make Beta Services available at no charge, which You may choose to try in Your sole discretion. Beta Services are intended for evaluation purposes only, are not supported under our support plans, and may be subject to additional terms. Beta Services are not considered “Services” under this Agreement, but remain subject to the same restrictions and obligations as those applicable to the Services as provided in the Agreement. The Beta Services may contain unknown or unpredictable errors and defects which may impair the ability to use them or some of their features until such error or defect is corrected. We do not guarantee that an error or a defect identified or reported in the Beta Services will be corrected within a specific time or at all. You agree to waive (and You are hereby deemed to have waived) the exercise of any right, claim, recourse or remedy against Us in connection with the use of the Beta Services. We may discontinue Beta Services at any time in Our sole discretion and may never make them generally available.
Beta Service. 3.1 If Global-Roam notifies the Subscriber in writing that a particular version of the Service is a ‘preview’ or a ‘beta’ version, or if the Service or any part of it is otherwise identified as a ‘preview’ or a ‘beta’ version, then the Subscriber:
(i) acknowledges and agrees that the Service is still under development, and may not have passed through a complete quality control and assurance process;
(ii) may use the Service for the sole purposes of evaluating the functionality and performance of the Service;
(iii) must not use the Service in a production environment or for commercial use;
(iv) agrees that Global-Roam is not liable for any loss or damage (however caused, including by the negligence of Global-Roam) in connection with the Subscriber’s use of the Service.
