Changes to Airport. Tenant acknowledges and agrees that (a) City shall have the right at all times to change, alter, expand, and contract the Airport, including the Terminal Building Complex;
Changes to Airport. Tenant acknowledges and agrees that City shall have the right at all times to change, alter, expand, and contract the Airport, including the Terminal Building Complex, and that City has made no representations, warranties, or covenants to Tenant regarding the design, construction, pedestrian traffic, enplanements, airline locations, or views of the Airport or the Premises. Without limiting the generality of the foregoing, Tenant acknowledges and agrees that the Airport is currently undergoing, and may from time to time hereafter undergo, renovation, construction, and other Airport modifications, and may from time to time adopt rules and regulations relating to security and other operational concerns that may affect Tenant’s business. Although City will use reasonable efforts to minimize the effect of such changes on Tenant’s business, Tenant acknowledges that such activity may have some effect on its operations located at the Airport. Such construction and renovation programs might involve barricading, materials storage, noise, the presence of workers and equipment, rearrangement, utility interruptions, and other inconveniences normally associated with construction and renovation. Although City will use reasonable efforts to minimize the effect of such changes on Tenant’s business, Tenant acknowledges that such activity may have some effect on its operations located at the Airport, and Tenant shall not be entitled to any rent credit or other compensation therefor. At any time and from time to time, City may, without the consent of Tenant, and without affecting Tenant’s obligations under this Lease, at City’s sole discretion, (a) change the shape, size, location, number and extent of the improvements in any portion of the Airport, including without limitation the concourses, piers, boarding areas, concession areas and security areas located within the Terminal Building, (b) build additional stories above or below the Airport buildings, including of the Terminal Building, (c) eliminate or relocate public entrances to the Premises so long as there is at all times one public entrance to the Premises, (d) construct multi-level, elevated or subterranean parking facilities, and (e) expand or contract the Airport, including redefining the Airport boundaries so as to include additional lands within the Airport or exclude lands from the Airport or both. Changes to Airport. Operator agrees that it shall not allow any condition, nor authorize the conduct of any activity by a Driver, which shall materially or adversely affect the development, improvement, operation, or maintenance of the Airport or its facilities, nor shall Operator nor its Drivers use or permit the Airport to be used in any manner which might interfere with the landing and take- off of aircraft from the Airport or otherwise constitute a hazard to the general public, or to Airport 's tenants or customers; or the customers, agents , invitees, contractors, representatives and employees of those tenants. Operator agrees that it shall not allow any condition, nor permit the conduct of any activity, which shall materially or adversely affect, infringe upon, block or interrupt the operations and business activity of other airport tenant or operator. Operator understands and agrees that Airport may pursue Airport development, improvements and maintenance activities from time-to-time that may affect areas of the Airport. Operator agrees to work cooperatively and in good faith with the Airport and other tenants, operators and contractors in development, improvement and maintenance activities to minimize any disruptions. If requested by the Airport, Operator shall cooperate with and assist the Airport to the greatest extent possible in the development and implementation of any plans, designs, ingress/egress, or transition that may arise in connection with such Airport development, improvement, and maintenance activities. Airport may temporarily or permanently close, re-route, or consent to the closing or re-routing of any method of ingress or egress on the Airport or any or all portions of the Airport without compensation of any kind to Operator. Airport will use its best efforts to provide reasonable notice to Operator prior to any changes pursuant to this Section 1.4.

Company acknowledges and agrees that: (a) City shall have the right, at all times, to change, alter and expand the Airport, including the terminals, roadways and designated pick-up, drop-off and staging areas; and (b) City has made no representations, warranties and/or covenants to Company regarding the design, construction, passenger or automobile traffic, or views of the Airport. Without limiting the generality of the foregoing, Company acknowledges and agrees that: (y) the City may from time to time undergo renovation, construction and other Airport modifications; and (z) the City may from time to time adopt rules and regulations relating to security or other operational matters that may affect Company’s business.

Without limiting the generality of the foregoing, Xxxxxx acknowledges and agrees that the Airport (i) is currently undergoing, and may from time to time hereafter undergo renovation, construction, and other Airport modifications; and (ii) may from time to time adopt rules and regulations relating to security and other operational concerns that may affect Tenant’s business. Although City will use reasonable efforts to minimize the effect of the Master Plan Expansion and other Airport changes on Tenant’s business, Tenant acknowledges that such activity may have some effect on cargo operations occurring at the Airport.

Company acknowledges and agrees that: (a) Authority will have the right, at all times, to change, alter and expand the Airport, including the terminals, roadways and Designated Area; and (b) Authority has made no representations, warranties and/or covenants to Company regarding the design, construction, passenger or automobile traffic, or views of the Airport. Without limiting the generality of the foregoing, Company acknowledges and agrees that: (a) the Airport may from time to time undergo renovation, construction and other Airport modifications; and (b) Authority may from time to time adopt Rules and Regulations, Policies, Standard Procedures, and Operating Directives relating to security or other operational matters that may affect Company’s business.

Permittee acknowledges and agrees that (a) City shall have the right at all times to change, alter, expand, and contract the Airport; (b) City has made no representations, warranties, or covenants to Permittee regarding the design, construction, pedestrian traffic, or views of the Airport or the Premises. Without limiting the generality of the foregoing, Permittee acknowledges and agrees that the Airport (i) is currently undergoing, and may from time to time hereafter undergo, renovation, construction, and other Airport modifications; and (ii) may from time to time adopt rules and regulations relating to security and other operational concerns that may affect Permittee’s business. Although City will use reasonable efforts to minimize the effect of the Master Plan Expansion and other Airport changes on Permittee’s business, Permittee acknowledges that such activity may have some effect on Permittee’s operations.
