City’s DBE Program. In accordance with federal financial assistance agreements with the U.S. Department of Transportation (U.S. DOT), City has adopted a Disadvantaged Business Enterprise (DBE) Policy and Program, in conformance with Title 49 CFR Part 26, “Participation by Disadvantaged Business Enterprises in Department of Transportation Programs, Federal Highway Administration” (referred to herein as the “Regulations”). The City’s DBE program is available at the following website: xxxx://xxx.xxxxxxx.xxx/depts_servc/pub_works/con_adm/projadvnew.asp. This Agreement is subject to the Regulations. In order to ensure that City achieves its overall DBE Program goals and objectives, City encourages the participation of DBEs as defined in 49 CFR 26 in the performance of contracts financed in whole or in part with U.S. DOT funds. Pursuant to the intent of these Regulations, it is also the policy of the City to: (a) Fulfill the spirit and intent of the Federal DBE Program regulations published under U.S. DOT Title 49 CFR, Part 26, by ensuring that DBEs have equitable access to participate in all of City's DOT-assisted contracting opportunities. (b) Ensure that DBEs can fairly compete for and perform on all DOT-assisted contracts and subcontracts. (c) Ensure non-discrimination in the award and administration of City's DOT- assisted contracts. (d) Create a level playing field on which DBEs can compete fairly for DOT- assisted contracts. (e) Ensure that only firms that fully meet 49 CFR, Part 26 eligibility standards are permitted to participate as DBEs. (f) Help remove barriers to the participation of DBEs in DOT-assisted contracts. (g) Assist in the development of firms that can compete successfully in the marketplace outside the DBE Program.

  • The Program The Program is a comprehensive commercial energy efficiency program that offers financial incentives and financing for qualifying energy efficiency measures in commercial buildings to customers who are property owners, tenants or managers (customers) of ACE in New Jersey. Customers must receive ACE electric delivery service and be in good standing. Incentives are available to customers for the purchase and installation of qualifying energy-efficiency measures at the location where the qualifying project is to be installed. ACE will not offer financial incentives for the same eligible measure to those customers who have received financial incentives or rebates from other ACE energy efficiency programs.

  • In-Service Programs The parties to this collective agreement recognize the value of in-service education both to the employee and the Employer.   • CFR PART 200 Procurement of Recovered Materials A non-Federal entity that is a state agency or agency of a political subdivision of a state and its contractors must comply with section 6002 of the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act. The requirements of Section 6002 include procuring only items designated in guidelines of the Environmental Protection Agency (EPA) at 40 CFR part 247 that contain the highest percentage of recovered materials practicable, consistent with maintaining a satisfactory level of competition, where the purchase price of the item exceeds $10,000 or the value of the quantity acquired during the preceding fiscal year exceeded $10,000; procuring solid waste management services in a manner that maximizes energy and resource recovery; and establishing an affirmative procurement program for procurement of recovered materials identified in the EPA guidelines. Does vendor certify that it is in compliance with the Solid Waste Disposal Act as described above? Yes

  • Safety Program The Contractor shall design a specific safety program for the Work for the site(s). The Contractor shall establish and require all Subcontractors to establish reasonable safety programs. The Contractor shall also submit its standard monthly safety reports to the Owner and Design Professional. No imposition of responsibility on the Contractor for safety under this Contract shall relieve any subcontractor of its responsibility for safety of persons or property on or near the Project Site. The Contractor shall include in his plant he names of the person in charge of Safety.
