If any part of the Property lies seaward of the coastal construction control 172 line (“CCCL”) as defined in Section 161.053, Florida Statutes, Seller will provide Buyer with an affidavit or 173 survey as required by law delineating the line's location on the Property, unless Buyer waives this requirement 174 in writing. The Property being purchased may be subject to coastal erosion and to federal, state, or local 175 regulations that govern coastal property, including delineation of the CCCL, rigid coastal protection structures, 176 beach nourishment, and the protection of marine turtles. Additional information can be obtained from the Florida 177 Department of Environmental Protection, including whether there are significant erosion conditions associated 178 with the shoreline of the Property being purchased. 179 □ Buyer waives the right to receive a CCCL affidavit or survey.

Coastal Construction Control Line. If all or part of any transferred real property is located seaward of the Coastal Construction Control Line as defined in Section 161.053, Florida Statutes (the “CCCL”), Florida Law requires the seller thereof to provide the buyer thereof with an affidavit, or a survey meeting the requirements of Chapter 472 of the Florida Statutes, delineating the location of the CCCL on the subject real property at or prior to the closing of the transfer of such real property, unless the purchaser thereof waives such requirement in writing. In the event that the foregoing sentence is applicable to the transfer and sale of any real property transferred hereunder, Purchaser hereby waives the right to receive a CCCL affidavit or survey.

Buyer is aware that the Unit and/or portions of the Condominium Property may be located in coastal areas partially or totally seaward of the Coastal Construction Control Line as defined in Section 161.053, F.S. and, as such, the Condominium Property may be subject to coastal erosion and to federal, state, or local regulations that govern coastal property, including the delineation of the Coastal Construction Control Line, rigid coastal protection structures, beach nourishment, and the protection of marine turtles. Additional information can be obtained from the Florida Department of Environmental Protection, including whether there are significant erosion conditions associated with the shoreline of the property being purchased. Buyer is fully apprised of the character of the regulation of property in such coastal areas and Buyer hereby waives and releases any right to receive at closing a survey delineating the location of the Coastal Construction Control Line with respect to the Unit and the Condominium Property in accordance with Section 161.57, F.S.

Therefore, the Timberlands may be subject to coastal erosion and to federal, state or local regulations that govern coastal property, including the delineation of the CCCL, rigid coastal protection structures, beach nourishment and the protection of marine turtles. Additional information can be obtained from the Florida Department of Environmental Protection, including whether there are significant erosion conditions associated with the Timberlands. Florida law requires Seller to provide Purchaser with an affidavit, or a survey, meeting the requirements of Chapter 472 of the Florida Statutes, delineating the location of the CCCL on the Timberlands at or prior to Closing, unless Purchaser waives this requirement in writing. Purchaser hereby waives the right to receive a CCCL affidavit or survey.
Coastal Construction Control Line. Because Buyer may obtain its own updated survey, Buyer hereby waives the requirements of Section 161.57, Florida Statutes which would otherwise require the Seller to furnish an affidavit or survey locating any coastal construction control line on the Land.

I am fully apprised of the character of the regulation of property in such coastal areas and I hereby waive and release any right to receive at closing a survey delineating the location of the Coastal Construction Control Line with respect to the Unit and the Condominium property in accordance with Section 161.57, Florida Statutes.
