Collection Containers. 4.1 CDD is to provide the number of collection containers specified in the Schedule to the Client at the Location. 4.2 Property in, and ownership and title to, the collection containers shall remain with CDD at all times. 4.3 The Client shall ensure that, for the duration of the Term, the collection containers remain at the Location and are safely and readily accessible and freely available for collection by CDD. 4.4 At the conclusion of the Term or otherwise upon termination of this Agreement, the Client, at its own cost, will return, or will arrange for the return of, the collection containers to CDD. 4.5 The Client will ensure that the collection containers are maintained in good order and repair or condition and are appropriately insured, and when necessary, will make good, any loss, theft or damage (fair wear and tear excepted) to the collection containers for the duration of the Term. 4.6 The Client agrees during the Term to use the collection containers only for the purpose set out in this Agreement and to maintain the collection containers in a safe and proper working condition whilst the collection containers are at the Location. 4.7 CDD is, upon providing reasonable notice in advance to the Client, entitled to enter the Location and inspect the collection containers. 4.8 If the Client is in default of payment or otherwise breaches this Agreement (and fails to remedy that breach within 7 days of having received written notice from CDD requiring remedy), CDD may remove the collection containers from the Location.
Collection Containers. A. Contractor shall provide bins for storage of materials which shall be designated and constructed to be watertight and prevent the leakage of liquids. All containers with a capacity of 1 cubic yard or more shall meet all applicable federal regulations on solid waste bins safety. B. The containers shall be clearly labeled to indicate their designation for collection of solid waste recyclables, or green waste and shall list the types of materials to be stored in the container for collection. At the City’s request, Contractor shall work cooperatively with the City to develop an acceptable presentation of the logo on the containers. C. The Contractor is to provide free of charge to customers if previous container is rendered unserviceable by means other than the customer’s action. D. Residential refuse collection shall be provided using approximately 20-, 32-, 65-, and 95- gallon wheeled carts with securable attached lids. Residential green waste collection shall be provided using approximately 32-, 65-, and 95 gallon wheeled carts with securable, attached lids. City specified size and type (i.e., wheeled carts) for residential refuse and green waste containers. Contractor shall select the size and type of container to be provided for residential recyclables collection and type of container to be provided for residential recyclables collection and commercial collections services.

Collection Containers. A. Contractor shall provide industry-standard Bins for storage of materials which shall be designated and constructed to be watertight and prevent the leakage of liquids. All Containers with a capacity of l cubic yard or more shall meet all applicable federal regulations on Solid Waste Bin safety. B. Containers shall be clearly labeled to indicate their designation for Collection of Solid Waste, Recyclables, or Compostable Materials and shall list the types of materials to be stored the container for Collection. C. The Contractor is to provide all Containers to Customers at no charge. Replacement Containers shall be provided free of charge to Customers if previous container is rendered unserviceable by means other than the Customer's action no more than once per year. D. All Carts shall be wheeled Carts with securable, attached lids and a handle to allow for easy movement. E. All newly purchased Containers shall have standard colors: Black or Grey for Solid Waste, Blue for Recyclables, and Green for Compostable Materials Containers. For Carts, the color shall be the body color. For Bins and Debris Boxes, the color shall be either the body color or a painted band. F. Contractor shall select the Container manufacturer. G. Contractor to maintain, repair, clean, paint, and replace Containers as needed to maintain a clean, attractive, functional, new-like condition. All graffiti shall be removed within one (1) week of notice to Contractor. H. Contractor shall, at no charge, replace any Containers which become unusable by reason of normal wear and tear or damaged by Collection operations. Contractor shall not be responsible for replacement or repair of Containers which are stolen or damaged by any event not caused by Contractor. I. Contractor shall make a diligent effort to replace all Carts (Residential, Multi- Family and Commercial) that bear the logo of other hauling companies. At the end of five (5) year from the Effective Date of the Agreement Contractor shall provide City with an inventory of Carts that still bear the logo of other hauling companies. This information will be used to determine options for replacement of remaining Carts. Any replacement Carts shall be consistent in their labeling (i.e., Solid Waste (Black or Grey), Recyclables (Blue), Green Waste (Green)). Collection Containers. Contractor shall allow Member Agency Facilities to select a 491 Collection service method that best suits the needs of its Premises. Specifically, the 492 Contractor shall offer the following choices to Member Agency Facilities: 493 a. Cart service. Contractor shall allow Member Agency Facilities to use Carts for 494 Recyclable Materials Collection. Contractor shall provide each Customer with a 495 choice of one or more Carts with capacity ranging from thirty (30) to ninety (90) 496 gallons (or similar sizes). 497 b. Bin service. Contractor shall allow Member Agency Facilities to use Bins for 498 Recyclable Materials Collection. Contractor shall provide each Customer with a 499 choice of one or more Bins with capacity ranging from 1 to 8 cubic yards (or 500 similar sizes). 501 c. Centralized Cart or Bin service. Contractor shall allow Member Agency 502 Facilities to use Carts or Bin for Recyclable Materials Collection that are shared 503 by the Occupants of two (2) or more adjacent Member Agency Facilities. In 504 such case, Contractor shall provide one or more Carts or Bins to such Premises 505 as requested by Customer(s). 506 d. Drop Boxes and Compactors. Contractor shall allow Member Agency Facilities 507 to use Drop Boxes or Compactors for Recyclable Materials. In such case, 508 Contractor shall provide Customers with a choice of Container capacities 509 ranging from ten (10) to fifty (50) cubic yards. Contractor shall offer Customers 510 the option to purchase or lease Compactors through Contractor or an outside 511 vendor. Regular maintenance of Compactors shall be provided by Contractor 512 (or outside vendor) as frequently as needed to keep the Compactors in good 513 working order and functioning at high compaction levels.
Collection Containers. Contractor shall supply one new refuse and one new recycling cart to each customer. Each cart shall be ninety-five (95) gallons in size unless the resident requests carts smaller in size. Contractor shall contact each customer to determine the size of the carts which Contractor shall deliver to each customer. A customer may change cart sizes once a year without charge by contacting the Contractor. If an additional cart (more than 2) is requested by the customer, the charge for additional carts shall be negotiated directly between the customer and Contractor. Damaged carts not suitable for use shall be replaced free of charge if the damaged cart is returned to the Contractor by the customer for an exchange.
