Comparison of Bids. 5.2.1 After the Bids have been opened and read, the bid prices will be compared and the result of such comparisons will be made available to the public. Comparisons of the Bids may be based on the Base Bid plus desired Alternates. The Agency shall have the right to accept Alternates in any order or combination.
5.2.2 The Agency reserves the right to waive technicalities, to reject any or all Bids, or any portion thereof, to advertise for new Bids, to proceed to do the Work otherwise, or to abandon the Work, if in the judgment of the Agency or its agent(s), it is in the best interest of the State.
5.2.3 An increase or decrease in the quantity for any item is not sufficient grounds for an increase or decrease in the Unit Price.
5.2.4 The prices quoted are to be those for which the material will be furnished F.O.
Comparison of Bids. Bids will be compared on the basis of lump-sum or unit prices stated in the BID. In the event that there is a discrepancy in the Bid between the lump-sum or unit prices written in words and figures, the prices written in words shall govern. The City agrees to examine and consider each Bid submitted in consideration of the Bidder’s agreements, as hereinabove set forth and as set forth in the BID.

Bids on Unit Price Contracts will be compared on the basis of a total estimated price, arrived at by taking the sum of the estimated quantities of such items multiplied by the corresponding unit prices, and including any lump sum Bids on individual items, in accordance with the Engineer's Estimate of quantities of such items multiplied by the corresponding units prices, and including any lump sum Bids on individual items, in accordance with the Engineer's Estimate of Quantities set forth in the Bid Form.
Comparison of Bids. 11.1 Bids will be compared on the basis of the experience and competence of the bidders and on the basis of the totals of the quantities listed in the proposal under the enumerated items at the unit prices or lump sums bid for these items. The Contract will be awarded to the lowest responsive, responsible and eligible bidder ON THE BASIS OF THE TOTAL BASE BID PLUS THE ADDITIVE ALTERNATE (if applicable) AS BUDGET ALLOWS, as determined by the Owner and/or its authorized representatives or agents. However, the Owner may reject any and all bids if it is in the public interest to do so.
11.2 The term, “Lowest responsive, responsible and eligible bidder,” shall mean the bidder whose bid is the lowest of those bidders possessing the skill, ability and integrity necessary for the faithful performance of the Work; who shall certify that he is able to furnish labor that can work in harmony with all other elements of labor employed or to be employed in the Work.
11.3 Bids should be made on each separate item of work shown in the bid with reasonable relation to the probable cost of doing the Work included in such items. The OWNER reserves the right to reject, wholly, any bid on which an item or items thereof are obviously unbalanced or appear to the OWNER to be so unbalanced as to affect or to be liable to affect adversely any interests of the OWNER. The attention of the bidder is called to the fact that unbalancing of bids may adversely affect the CONTRACTOR if certain portions for the Work are increased or decreased as provided in the Contract Documents.
11.4 A bidder shall state the proposed price for the work by which the bids will be compared. This price is to cover all expenses incidental to the completion of the work in full conformity with the Contract and Specifications. In the event that there is a discrepancy between the unit prices and the extended totals, the unit prices shall govern. In the event that there is a discrepancy between the lump-sum or unit prices written in words and numerical figures, the prices written in words shall govern. No bid will be accepted which does not contain a unit price or lump sum as indicated for each of the applicable items enumerated in the bid form.

The Procuring Entity shall determine to its satisfaction whether the Bidder that is selected as having submitted the best-evaluated and substantially responsive bid is qualified to perform the Contract satisfactorily. The determination shall be based upon an examination of the documentary evidence of the Bidder’s qualifications submitted by the Bidder, pursuant to ITB Clause 17. An affirmative determination shall be a prerequisite for award of the Contract to the Bidder. A negative determination shall result in disqualification of the bid, in which event the Procuring Entity shall proceed to the next best-evaluated bid to make a similar determination of that Bidder’s capabilities to perform satisfactorily. The Procuring Entity reserves the right to accept or reject any bid, and to annul the bidding process and reject all bids at any time prior to contract award, without thereby incurring any liability to Bidders.
