Compensation for Ordinary Losses. Settlement Class Members not selecting the cash payment, may claim up to $150.00 by submitting a valid and timely claim form and reasonable supporting documentation for ordinary losses demonstrably incurred, more likely than not, as a result of the Data Incident. Ordinary losses can arise from the following categories: i. Out-of-pocket expenses incurred as a direct result of the Data Incident, including documented bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, gasoline for local travel, and bank fees, all of which must be more likely than not attributable to the Data Incident, must not have been previously reimbursed or subject to reimbursement by insurance or a third party, and that are reasonably described and supported by an attestation under penalty of perjury, which will be a part of the claim form. ii. Fees for credit reports, credit monitoring, or other identity theft insurance product purchased between January 17, 2022, and the date of the close of the Claims Period that the claimant attests under penalty of perjury he/she incurred because of the Data Incident and not already paid for or reimbursed by a third party. All such fees must be supported by reasonable documentation substantiating the full extent of the amount claimed.
Compensation for Ordinary Losses. Compensation for unreimbursed ordinary losses fairly traceable to the Cybersecurity Incident, may be up to a total of $1,500.00 per person. Settlement Class Members must submit documentation supporting their Claims for ordinary losses. This documentation may include receipts or other documentation not “self- prepared” by the claimant that documents the costs incurred. “Self-prepared” documents such as handwritten receipts are, by themselves, insufficient to receive reimbursement, but can be considered to add clarity or support other submitted documentation. Settlement Class Members shall not be reimbursed for expenses if they have been reimbursed for the same expenses by another source, including compensation provided in connection with the identity monitoring services offered as part of the notification letter provided by LoanCare. These ordinary losses may include the following: i. Out of pocket expenses incurred as a result of the Cybersecurity Incident, including bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged Case 3:23-cv-01508-CRK-MCR Document 131-1 Filed 03/19/25 Page 20 of 59 PageID 1991 based on the amount of data used), postage, or gasoline for local travel; and ii. Fees for credit reports, credit monitoring, or other identity monitoring or insurance product purchased between November 19, 2023, and the date of the Claim Form Deadline.
Compensation for Ordinary Losses. ▇▇▇ ▇▇▇▇ will reimburse documented out-of-pocket expenses incurred as a result of the Data Security Incident, up to a maximum of $500.00 to each Settlement Class Member upon submission of a claim and supporting third-party documentation, such as the following losses: i. professional fees including attorneys’ fees, accountants’ fees, and fees for credit repair services; costs associated with freezing or unfreezing credit with any credit reporting agency; credit monitoring costs that were incurred on or after mailing of the notice of Data Security Incident, through the date of claim submission; and miscellaneous expenses such as notary, fax, postage, copying, mileage, and long-distance telephone charges ii. Compensation for lost time up to four (4) hours at $20.00 per hour for a maximum of up to $80.00 per person. Class members may submit claims for up to four hours of lost time with an attestation that they spent the claimed time responding to issues raised by the Data Security Incident. iii. This list of reimbursable documented out-of-pocket expenses is not meant to be exhaustive, rather it is exemplary. Settlement Class Members may make claims for any documented out-of-pocket losses reasonably related to the Data Security Incident or to mitigating the effects of the Data Security Incident. The Claims Administrator shall have discretion to determine whether any claimed loss is reasonably related to the Data Security Incident.
Compensation for Ordinary Losses. HBSC will provide compensation for unreimbursed losses, up to a total of $500.00 per person, to Settlement Class Members upon submission of an Approved Claim and supporting documentation (if necessary) of the following categories of claimed losses: a. Out-of-pocket expenses incurred as a result of the December 27, 2023 cybersecurity incident including, but not limited to, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), bank fees (documented), credit monitoring (documented), or late fees (documented), all of which must be more likely than not caused by and fairly traceable to the December 27, 2023 incident and that are supported by documentation if necessary and sworn attestation that substantiates the full extent of the amount claimed; b. Up to four hours of lost personal time, at $25/hour, spent responding to the December 27, 2023 incident. Settlement Class and Subclass members may submit Claims for up to four hours of lost personal time with an attestation that they spent the claimed time responding to issues resulting from the December 27, 2023 incident.
Compensation for Ordinary Losses. Defendant will reimburse documented out-of-pocket expenses incurred as a result of the Data Security Incident, up to a maximum of $350 per person upon submission of a claim and supporting third-party documentation, such as the following losses:
Compensation for Ordinary Losses. RMCHCS will reimburse documented out of pocket expenses incurred as a result of the Data Breach, up to a maximum of $500.00 per person, upon submission of a claim and supporting documentation, such as the following losses: i. Bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, or gasoline for local travel; ii. Fees for credit reports, credit monitoring, or other identity theft insurance product purchased between May 19, 2021 and the date of the Settlement Agreement; iii. Compensation for up to 4 hours of lost time, at $15/hour, for a maximum of up to $60 per person, if at least one full hour was spent dealing with the Data Breach. Class members may submit claims for up to 4 hours of lost time with an attestation that they spent the claimed time responding to issues raised by the Data Breach. This payment shall be included in the $500 per person cap for Compensation for Documented Out-of-Pocket Losses and Lost Time. iv. This list of reimbursable documented out-of-pocket expenses is not meant to be exhaustive, but is exemplary. Settlement Class Members may make claims for any documented out-of-pocket losses reasonably related to the Data Incident or to mitigating the effects of the Data Incident. Compensation for Ordinary Losses the Met Opera will provide compensation for ordinary unreimbursed Out-of-Pocket losses, up to a total of $750.00 per person, upon submission of a Claim Form and supporting third-party documentation, for the following losses reasonably incurred by the Participating Settlement Class Member because of the Met Opera Data Security Incident: (1) Documented Out-of-Pocket Losses incurred as a result of the Met Opera Data Security Incident, including bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, or gasoline for local travel; (2) Documented fees for additional credit reports, credit monitoring, or other identity theft insurance products purchased between September 30, 2022, and the Claims Deadline;

Fees for credit reports, Credit Monitoring, or other identity theft insurance product purchased between the date of the Data Security Incident and the date of the Claim Form Deadline.
Compensation for Ordinary Losses. Settlement Class Members will be eligible for compensation for ordinary losses, as defined below, up to a total of $100.00 per claimant, upon submission of a claim and supporting documentation, if applicable. Ordinary losses are: (i) out-of-pocket costs for up to one year of credit monitoring and/or identity theft protection, provided that the claimant certifies that the costs were incurred primarily as a result of the Laptop Incident between the date of the Laptop Incident and the Claims Deadline; (ii) out-of-pocket co-pays or deductible payments on Medicare, Medicaid or private insurance due to false medical insurance claims, provided that the claimant certifies that he or she has not been reimbursed by any other source for these payments; (iii) up to 2 hours of lost time (at $20.00 per hour) if at least one full hour was spent dealing with the Laptop Incident, provided that the claimant Electronically Filed - ▇▇▇▇▇▇▇ - Kansas City - December 30, 2020 - 01:40 PM certifies that the lost time was spent dealing with issues relating to the Laptop Incident; (iv) costs of credit reports purchased between the date of the Laptop Incident and the Claims Deadline, provided that the claimant certifies the credit reports were purchased primarily as a result of the Laptop Incident; and (v) other incidental expenses attributable to the Laptop Incident, provided that the claimant provides documentation of the charges and a narrative explanation plausibly establishing their relationship to the Laptop Incident. The maximum amount any one claimant may recover under Claim A is $100.00.
