Compensation for Ordinary Losses. Settlement Class Members not selecting the cash payment, may claim up to $150.00 by submitting a valid and timely claim form and reasonable supporting documentation for ordinary losses demonstrably incurred, more likely than not, as a result of the Data Incident. Ordinary losses can arise from the following categories:
i. Out-of-pocket expenses incurred as a direct result of the Data Incident, including documented bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, gasoline for local travel, and bank fees, all of which must be more likely than not attributable to the Data Incident, must not have been previously reimbursed or subject to reimbursement by insurance or a third party, and that are reasonably described and supported by an attestation under penalty of perjury, which will be a part of the claim form.
ii. Fees for credit reports, credit monitoring, or other identity theft insurance product purchased between January 17, 2022, and the date of the close of the Claims Period that the claimant attests under penalty of perjury he/she incurred because of the Data Incident and not already paid for or reimbursed by a third party. All such fees must be supported by reasonable documentation substantiating the full extent of the amount claimed.
Compensation for Ordinary Losses. Defendant will reimburse documented out-of-pocket expenses incurred as a result of the Data Security Incident, up to a maximum of $350 per person upon submission of a claim and supporting third-party documentation, such as the following losses:
Compensation for Ordinary Losses. RMCHCS will reimburse documented out of pocket expenses incurred as a result of the Data Breach, up to a maximum of $500.00 per person, upon submission of a claim and supporting documentation, such as the following losses:
i. Bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, or gasoline for local travel;
ii. Fees for credit reports, credit monitoring, or other identity theft insurance product purchased between May 19, 2021 and the date of the Settlement Agreement;
iii. Compensation for up to 4 hours of lost time, at $15/hour, for a maximum of up to $60 per person, if at least one full hour was spent dealing with the Data Breach. Class members may submit claims for up to 4 hours of lost time with an attestation that they spent the claimed time responding to issues raised by the Data Breach. This payment shall be included in the $500 per person cap for Compensation for Documented Out-of-Pocket Losses and Lost Time.
iv. This list of reimbursable documented out-of-pocket expenses is not meant to be exhaustive, but is exemplary. Settlement Class Members may make claims for any documented out-of-pocket losses reasonably related to the Data Incident or to mitigating the effects of the Data Incident. The Claims Administrator shall have discretion to determine whether any claimed loss is reasonably related to the Data Incident.
Compensation for Ordinary Losses. Defendant will reimburse documented out of pocket expenses incurred as a result of the Data Security Incident, up to a maximum of $500.00 per person, upon submission of a claim and supporting documentation, such as the following losses:
i. Bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, or gasoline for local travel;
ii. Fees for credit reports, credit monitoring, or other identity theft insurance product purchased between September 30, 2020 and the date of the Settlement Agreement;
iii. Compensation for up to three (3) hours of lost time, at $20/hour, for a maximum of up to $60 per person, if at least one (1) full hour was spent dealing with the Data Security Incident. Class members may submit claims for up to three (3) hours of lost time with an attestation that they spent the claimed time responding to issues raised by the Data Security Incident. This payment shall be included in the $500 per person cap for Compensation for Documented Out-of-Pocket Losses and Lost Time.
iv. This list of reimbursable documented out-of-pocket expenses is not meant to be exhaustive, but is exemplary. Settlement Class Members may make claims for any documented out-of- pocket losses reasonably related to the Data Security Incident or to mitigating the effects of the Data Security Incident. The Claims Administrator shall have discretion to determine whether any claimed loss is reasonably related to the Data Security Incident.
Compensation for Ordinary Losses the Met Opera will provide compensation for ordinary unreimbursed Out-of-Pocket losses, up to a total of $750.00 per person, upon submission of a Claim Form and supporting third-party documentation, for the following losses reasonably incurred by the Participating Settlement Class Member because of the Met Opera Data Security Incident:
(1) Documented Out-of-Pocket Losses incurred as a result of the Met Opera Data Security Incident, including bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, or gasoline for local travel;
(2) Documented fees for additional credit reports, credit monitoring, or other identity theft insurance products purchased between September 30, 2022, and the Claims Deadline;
Compensation for Ordinary Losses. All Settlement Class 5 Members may submit a claim for documented out-of-pocket losses including, for 6 example, lost time, unreimbursed losses relating to fraud or identity theft, 7 unreimbursed costs of credit monitoring incurred between the time of the Data 8 Incident and the time the claim is submitted, and unreimbursed bank fees, postage, 9 or gasoline for travel (“Ordinary Losses”) and time spent remedying issues related to 10 the Data Incident (“Attested Time”), up to $500 per individual. The Settlement Fund 11 will be used to pay valid and timely submitted claims for each of the following 12 categories:
13 a) Documented out-of-pocket expenses incurred as a direct 14 result of the Data Security Incident, namely, postage, copying, scanning, faxing, 15 mileage and other travel-related charges, parking, notary charges, research charges, 16 cell phone charges (only if charged by the minute), long distance phone charges, data 17 charges (only if charged based on the amount of data used), text message charges 18 (only if charged by the message), bank fees, accountant fees, and attorneys’ fees, all 19 of which must be fairly traceable to the Data Security Incident and must not have 20 been previously reimbursed by a third party. Expenses must be attested to and 21 supported by documentation substantiating the full extent of the amount claimed; and
22 b) Reimbursement for Lost Time (“Attested Time”): 23 Settlement Class Members may submit claims to be compensated for lost time they 24 reasonably spent responding to the Data Security Incident. Settlement Class 25 Members may claim up to three (3) hours of time compensated at the rate of $30 per
Compensation for Ordinary Losses. All Settlement Class Members who submit a Valid Claim are eligible for up to a total of $1,500 per person for unreimbursed ordinary losses that are fairly traceable to the Data Incident. You must submit documentation supporting your Claim for ordinary losses, which may include receipts or other documentation that show the costs incurred. “Self-prepared” documents such as handwritten receipts are, by themselves, insufficient to receive reimbursement, but can be considered to add clarity or support other submitted documentation. You will not be reimbursed for expenses if you have been reimbursed for the same expenses by another source, including compensation provided in connection with the credit monitoring product offered as part of the notice letter previously provided by Defendant. Ordinary losses may include the following: Compensation for Lost Time: Settlement Class Members with time spent remedying issues related to the Data Incident may receive reimbursement of $25 per hour up to five hours (for a total of $125) with an attestation (a legal term meaning signing a formal document) including a brief description of the action(s) taken in response to the Data Incident. Compensation for Extraordinary Losses: Compensation for extraordinary losses, up to a total of $10,000, per Settlement Class Member, if the extraordinary loss is: OR
Compensation for Ordinary Losses. All Settlement Class Members who submit a valid claim pursuant to § IV.2.6 using the Claim Form (Exhibit A to this Settlement Agreement) are eligible for reimbursement for up to $250.00 for the following two types of ordinary losses:
Compensation for Ordinary Losses. Any Class Member who makes a valid claim and suffered losses shall be paid up to $350 per person in compensation, if:
1. The loss is an actual, documented, and unreimbursed monetary loss;
2. The loss was more likely than not caused by the Data Incident;
3. The loss occurred before 90 days from the date that notice is mailed to the Class Members;
4. The Class Member made reasonable efforts to avoid, or seek reimbursement for, the loss, including but not limited to exhaustion of all available credit-monitoring insurance, identity-theft insurance, or any other insurance available to them;
5. The Class Member provides third party documentation to support the recovery sought;
6. The Class Member provides an attestation to each of the foregoing that also includes a written description of how the loss came to be and a statement that the documents showing the loss are authentic; and
7. The Claims Administrator, after reviewing the claim and attestation for qualification, completeness, and plausibility, approves the loss as valid.
Compensation for Ordinary Losses. Beaumont will provide compensation for unreimbursed losses, up to a total of $250 per person, upon submission of a claim and supporting documentation, such as the following losses:
i. Out of pocket expenses incurred as a result of the Data Breach, including bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, or gasoline for local travel;
ii. Fees for credit reports, credit monitoring, or other identity theft insurance product purchased between April 17, 2020 and the date of the order granting preliminary approval to the settlement; ocument Submitted for Filing to MI Oakland County 6th Circuit Court.
