Compensation for Ordinary Losses. Settlement Class Members not selecting the cash payment, may claim up to $150.00 by submitting a valid and timely claim form and reasonable supporting documentation for ordinary losses demonstrably incurred, more likely than not, as a result of the Data Incident. Ordinary losses can arise from the following categories:
i. Out-of-pocket expenses incurred as a direct result of the Data Incident, including documented bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, gasoline for local travel, and bank fees, all of which must be more likely than not attributable to the Data Incident, must not have been previously reimbursed or subject to reimbursement by insurance or a third party, and that are reasonably described and supported by an attestation under penalty of perjury, which will be a part of the claim form.
ii. Fees for credit reports, credit monitoring, or other identity theft insurance product purchased between January 17, 2022, and the date of the close of the Claims Period that the claimant attests under penalty of perjury he/she incurred because of the Data Incident and not already paid for or reimbursed by a third party. All such fees must be supported by reasonable documentation substantiating the full extent of the amount claimed.
Compensation for Ordinary Losses. Defendant will reimburse documented out-of-pocket expenses incurred as a result of the Data Security Incident, up to a maximum of $350 per person upon submission of a claim and supporting third-party documentation, such as the following losses:
Compensation for Ordinary Losses. RMCHCS will reimburse documented out of pocket expenses incurred as a result of the Data Breach, up to a maximum of $500.00 per person, upon submission of a claim and supporting documentation, such as the following losses:
i. Bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, or gasoline for local travel;
ii. Fees for credit reports, credit monitoring, or other identity theft insurance product purchased between May 19, 2021 and the date of the Settlement Agreement;
iii. Compensation for up to 4 hours of lost time, at $15/hour, for a maximum of up to $60 per person, if at least one full hour was spent dealing with the Data Breach. Class members may submit claims for up to 4 hours of lost time with an attestation that they spent the claimed time responding to issues raised by the Data Breach. This payment shall be included in the $500 per person cap for Compensation for Documented Out-of-Pocket Losses and Lost Time.
iv. This list of reimbursable documented out-of-pocket expenses is not meant to be exhaustive, but is exemplary. Settlement Class Members may make claims for any documented out-of-pocket losses reasonably related to the Data Incident or to mitigating the effects of the Data Incident. The Claims Administrator shall have discretion to determine whether any claimed loss is reasonably related to the Data Incident.
Compensation for Ordinary Losses. Xxx Xxxx will reimburse documented out-of-pocket expenses incurred as a result of the Data Security Incident, up to a maximum of $500.00 to each Settlement Class Member upon submission of a claim and supporting third-party documentation, such as the following losses:
i. professional fees including attorneys’ fees, accountants’ fees, and fees for credit repair services; costs associated with freezing or unfreezing credit with any credit reporting agency; credit monitoring costs that were incurred on or after mailing of the notice of Data Security Incident, through the date of claim submission; and miscellaneous expenses such as notary, fax, postage, copying, mileage, and long-distance telephone charges
ii. Compensation for lost time up to four (4) hours at $20.00 per hour for a maximum of up to $80.00 per person. Class members may submit claims for up to four hours of lost time with an attestation that they spent the claimed time responding to issues raised by the Data Security Incident.
iii. This list of reimbursable documented out-of-pocket expenses is not meant to be exhaustive, rather it is exemplary. Settlement Class Members may make claims for any documented out-of-pocket losses reasonably related to the Data Security Incident or to mitigating the effects of the Data Security Incident. The Claims Administrator shall have discretion to determine whether any claimed loss is reasonably related to the Data Security Incident.
Compensation for Ordinary Losses. Settlement Class Members will be eligible for compensation for unreimbursed ordinary losses, as defined below, up to a total of $400.00 per claimant, upon submission of a valid Claim Form and supporting documentation (except for claims for lost time). Ordinary losses may include: (i) out of pocket expenses incurred as a result of the Data Incident, including bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, or gasoline for local travel; (ii) fees for credit reports, credit monitoring, or other identity theft insurance product purchased between the January 8, 2021 and the Claims Deadline; and (iii) up to four (4) hours of lost time, calculated at $20/hour, if at least one (1) full hour was spent dealing with the Data Incident, provided that the claimant certifies that the lost time was spent responding to issue raised by the Data Incident. The maximum amount any one claimant may recover under Claim A is $400.00.
Compensation for Ordinary Losses. Centerstone will provide compensation for unreimbursed losses, up to a total of $500.00 per person, upon submission of a Claim Form and supporting documentation, for the following losses:
(1) Documented Out-of-Pocket Losses incurred as a result of the Centerstone Data Breach, including bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, or gasoline for local travel;
(2) Documented fees for additional credit reports, credit monitoring, or other identity theft insurance products purchased between November 2021 and the date of the close of the Claims Period;
(3) Up to 4 hours of Attested Time, at $15/hour, if at least one full hour was spent dealing with the Data Breach.1 For Attested Time, a sworn attestation from the Class Member detailing how the time was spent shall constitute sufficient supporting documentation. The attestation may be made in electronic form and may be compiled by a selection of options from a menu that will also include an “other” option that the class member can fill-in.
Compensation for Ordinary Losses. Settlement Class Members will be eligible for compensation for ordinary losses, as defined below, up to a total of $250 per person, upon submission of a claim and supporting documentation, if applicable. Ordinary losses are: (i) out-of-pocket costs for up to three years of credit monitoring and/or identity theft protection, provided that the claimant certifies that the costs were incurred primarily as a result of the Data Incident, between date of the Data Incident and the Claims Deadline; (ii) out-of-pocket co-pays or deductible payments on Medicare, Medicaid or private insurance due to false medical insurance claims, provided that the claimant certifies that he or she has not been reimbursed by any source for these payments ; (iii) up to 3 hours of lost time (at $20/hour) if at least one full hour was spent dealing with the Data Incident, provided that the claimant provides documentation or a narrative explanation plausibly establishing that the time was spent dealing with issues relating to the Data Incident; (iv) costs of credit reports purchased between date of the Data Incident and the Claims Deadline, provided that the claimant certifies the credit report was purchased primarily as a result of the Data Incident; and (v) other incidental expenses attributable to the Data Incident, provided that the claimant provides documentation of the charges and a narrative explanation plausibly establishing their relationship to the Data Incident.
Compensation for Ordinary Losses. Dominion National will provide compensation for unreimbursed losses, up to a total of $300 per person, upon submission of a claim and supporting documentation, including the following losses:
i. Out of pocket expenses incurred as a result of the Data Security Incident, including bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, or gasoline for local travel;
ii. Fees for credit reports, credit monitoring, or other identity theft insurance product purchased between August 14, 2019 and the Notice Date; and
iii. Up to 5 hours of lost time, at $20/hour, if at least one full hour was spent dealing with the Data Security Incident. A certification by the claimant describing the time spent will be sufficient supporting documentation.
Compensation for Ordinary Losses. UKG will provide compensation for unreimbursed personal losses, not including lost wages, up to a total of $1,000.00 per person, to Settlement Class Members upon submission of an Approved Claim and supporting documentation (if necessary) of the following categories of claimed losses:
a. Out-of-pocket expenses incurred as a result of the December 2021 KPC Cyberattack including, but not limited to, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), bank fees (documented), credit monitoring (documented), or late fees (documented), all of which must be more likely than not caused by and fairly traceable to the December 2021 KPC Cyberattack and subsequent interruption of applications hosted in the KPC and must not have been previously reimbursed by a third party, and that are supported by documentation if necessary and sworn attestation that substantiates the full extent of the amount claimed;
b. Up to four hours of lost personal time, at $25/hour, spent responding to the December 2021 KPC Cyberattack. Settlement Class and Subclass members may submit Claims for up to four hours of lost personal time with an attestation that they spent the claimed time responding to issues resulting from the December 2021 KPC Cyberattack and have not been previously reimbursed by a third party for this time, including time spent responding to interruption of applications hosted in the KPC.
Compensation for Ordinary Losses. Settlement Class Members will be eligible for compensation for ordinary losses, as defined below, up to a total of $250.00 per claimant, upon submission of a valid claim form and supporting documentation, if applicable. Ordinary losses may include (i) unreimbursed losses relating to fraud or identity theft; professional fees including attorneys’ fees, accountants’ fees, and fees for credit repair services; costs associated with freezing or unfreezing credit with any credit reporting agency; credit monitoring costs that were incurred on or after May 15, 2020, through the date of preliminary approval; and miscellaneous expenses such as notary, fax, postage, copying, mileage, and long-distance telephone charges; and (ii) up to 6 hours of lost time (at $20.00 per hour) comprised of 3 hours of attested time and up to an additional 3 hours with documentation, provided that the claimant certifies that the lost time was spent in response to the Data Incident. The maximum amount any one claimant may recover under Claim A is $250.00.
