Reimbursement for Lost Time. All Settlement Class Members may submit a claim for reimbursement of Lost Time up to three (3) hours at a rate of $25.00 per hour. A claim for Lost Time may be combined with a claim for reimbursement for Out-of-Pocket Losses and Transaction Losses.

Reimbursement for Lost Time. Settlement Class Members with time spent remedying issues related to the Data Security Incident (“Lost Time”) can submit a claim for reimbursement of $25 per hour with an attestation. Claims made for Lost Time are subject to a five (5) hour cap and are combined with reimbursement for Monetary Losses subject to the $6,000 aggregate individual cap and subject to a pro rata decrease based on the amount remaining in the Settlement Fund following payment of the Fee Award and Expenses, Administration and Notice Costs, CAFA Notice, costs of Financial Account Monitoring, and claims for Reimbursement of Monetary Losses.
Reimbursement for Lost Time. Settlement Class Members may submit claims to be compensated for lost time they reasonably spent responding to the Cyberattack. Settlement Class Members may claim up to five (5) hours of time compensated at the rate of $21.37 per hour. All such lost time must be fairly traceable to the Cyberattack, reasonably described, and supported by an attestation under penalty of perjury that the time spent was reasonably incurred dealing with the Cyberattack.

Reimbursement for Lost Time. Settlement Class Members who have expended time remedying issues related to identity theft directly caused by the Security Incident are eligible for reimbursement as follows: Settlement Class Members may submit a Claim Form, including supporting documentation of their lost time, for up to five (5) hours at a rate of ten dollars ($10.00) per hour if the Settlement Class Member has first enrolled in the services provided by RailWorks through Identity Guard (or another substitute provider) prior to incurring the lost time. The Claim Form must be submitted within 60 days of the last date on which the Settlement Class Member expended time or [60 DAYS AFTER DATE OF REMINDER NOTICE] whichever is later, but in no event later than April 1, 2023. In order to obtain reimbursement, a Settlement Class Member must certify under penalty of perjury that (i) he/she enrolled in the identity theft protection services provided by RailWorks (either prior to this litigation or as part of this Settlement) prior to incurring the lost time; and (ii) he/she has not been previously reimbursed by any other source (such as insurance) for the lost time.

Reimbursement for Lost Time. An engineer is not to be held off unnecessarily. Layover time will be used as far as practicable. An engineer who is found blameless or an engineer who is called by the Railway as a witness will be compensated to the extent of wages he would have earned except for his absence as a result of being held off to attend hearing. Termination Of Employment When an engineer is discharged or resigns, he shall within five (5) days be paid, and as soon as possible on request, be given certificate of service.
