Compensatory Time. (a) Employees entitled to be paid cash for overtime may request compensatory time off at the applicable rate. Management may grant or deny such request and if granted, shall endeavor to schedule the time off within a reasonable time. Unused compensatory time off earned during the accrual “Year A” may be carried over until the end of accrual “Year B”, but not thereafter. Unused Year A compensatory time off which has not been used by the end of Year B, through no fault of the employee, will be paid off in cash at the base hourly rate of pay then prevailing. Compensatory Time. a. At the discretion of the District, compensatory time off may be granted in lieu of overtime pay at the rate of one-and-one-half (a) Employees entitled to hours for each overtime hour worked, provided that such time off is taken within the time period allowed by applicable State and Federal law. Notwithstanding any other provision, for non-sworn unit members, this section shall become effective January 1, 2015. b. One hundred thirty (130) hours of overtime each annual period beginning July 1 and ending June 30 of the following year, shall be paid cash for overtime may request allowed as compensatory time off at the applicable rate. Management may grant or deny such request rate of each hour of overtime equaling one and if grantedone-half (1½) hours regular time off, shall endeavor to schedule the time off within a reasonable time. Unused provided, however, that employees who do not want compensatory time off may elect to receive regular overtime pay. The maximum number of overtime hours which can be earned during the accrual “Year A” may be carried over until the end of accrual “Year B”, but not thereafter. (e) On any separation from service unused allowed to use earned compensatory time off in conjunction with scheduled vacations, holidays, or at other times where such use would not unduly disrupt work schedules. However, the District retains the right to schedule the use of compensatory time off so as not to interfere with the operation of the work unit. Granting and/or scheduling use of compensatory time off shall not be done on an arbitrary or discriminatory basis. Any compensatory time accrued but unused during each annual period shall be paid to the employee as a cash payment (subject to the legally required deductions and not less than the hourly rate at which earned, including all legally required differentials, increments, etc.) following the end of each annual period, upon leaving a bargaining unit class, or upon retirement or separation from District employment if earlier. Such cash payment shall be at the hourly rate in effect during the pay period in which it is paid. If the employee promotes out of the bargaining unit, the cash payment will be paid off in cash in a lump sum with the final paycheck at the employee’s, then, base raterate of the bargaining unit position last occupied. End-of-year cash payments of earned compensatory time off shall be made in the October pay period.

(g) Employees entitled to be paid cash for overtime may request compensatory time off at the applicable rate for a minimum accrual per employee of a rolling twenty-four (24) hours. This contractual minimum is not intended as a restriction on any manager or supervisor who, pursuant to any Department policy or otherwise, has the discretion to permit compensatory time accrual in excess of the twenty-four (24) hour rolling limit. The failure of a manager or supervisor to permit compensatory time accrual above the established minimum herein shall not be subject to the grievance procedure. Compensatory time off granted for work under subsection (f) above shall be permitted to exceed the applicable accrual. However, subsequent requests for compensatory time that would exceed the minimum accrual are not required to be granted.

(g) Employees entitled to be paid cash for overtime may request compensatory time off at the applicable rate for a minimum accrual per employee of a rolling twenty-four (24) hours. This contractual minimum is not intended as a restriction on any manager or supervisor who, pursuant to any Department policy or otherwise, has the discretion to permit compensatory time accrual in excess of the twenty-four (24) hour rolling limit. The failure of a manager or supervisor to permit compensatory time accrual above the established minimum herein shall not be subject to the grievance procedure. Compensatory time off granted for work on a floating holiday or under subsection (f) above shall be permitted to exceed the applicable accrual. However, subsequent requests for compensatory time that would exceed the minimum accrual are not required to be granted.
