Construction and Commissioning. Subject to § 4.6 (Termination Where Commissioning Not Completed), the Seller shall use reasonable endeavours to construct the Facility and commence Commissioning of the Facility as soon as is reasonably practicable following the Effective Date, but no later than the Scheduled Commissioning Date.

Construction and Commissioning. 4.3.1 Parties will construct and commission the Project in accordance with the Planned RFO in order to enable an actual flow of substances from a Party’s Facilities to the other Party’s Facilities on the Actual RFO.
Construction and Commissioning. Construction and commissioning of all CWW Assets by the Customer on the Project (Works) must be undertaken as follows:
(a) Works must be performed by service providers engaged by the Customer who have the relevant accreditation from CWW, for the category of asset being constructed, in accordance with the process detailed on CWW's website, as may be amended by CWW from time to time (Accredited Contractors).
(b) The Customer must prepare Works-specific construction plans and procedures as required for the Project. CWW will provide its comments on the procedures and plans which must then be addressed by the Customer in updated procedures and plans. This process will be repeated until CWW approves the final procedures and plans. As at the date of this Contract, the Works-specific construction plans and procedures include but are not limited to the following plans and procedures: • inspection-and-test plans (ITPs); • timeline schedules; • site safety and environmental plans (SSEMPs); • construction risk management plans; • test and commissioning plans; • quality assurance plan; • risk mitigation; • customer communication; • contingency plan.
(c) At least 14 days prior to Works starting, the Customer must submit to CWW the pre-construction verification form required by CWW and organise a pre-start meeting that CWW will attend.
(d) The Customer must carry out and complete the Works in accordance with the approved final design, the construction, commissioning, risk mitigation and customer communication and contingency plans and procedures and CWW's other notified requirements for the associated works.
(e) CWW may inspect and audit the Works, including at the agreed witness and hold points, which must be facilitated by the Customer. CWW must comply with the Customer's standard requirements in connection with site access and safety.
(f) The Customer must provide to CWW all required forms in connection with the Works, including for testing, witness and hold points, confirmation of compliant construction, as-constructed verification forms, etc. The Customer must also provide to CWW as-constructed documentation for the Works in the form reasonably required by CWW.
